Casey defense team wants tough questions asked of prosecutors??

Lyons has a long and well established history of fighting the DP, and being very against it. Which you really cannot criticize. SHe does not believe in the DP and has chosen a career path that puts this to productive use defending the accused in capital cases. Quite admirable. I assume that she took the case because it is the most public DP forum in the nation right now. Which as motives go is probably the least swarmy out of the entire defense cast of characters (ok ok it also promotes her book tha comes out soon, but at least her interests do not seem to be completely counter to he clients.)

So understand she does not need to review the evidence or case materials to personally know that it is not an appropriate DP case, simply because there is NEVER an appropriate DP case in how she looks at things. That is the basis of her lawyering.

Personally I think she is in for an incredibly rude surprise in this case though. Her normal and highly succesful approach to getting juries to choose against the DP is to appeal to their heartstrings, to try and make the defendent as human as possible, as sympathetic as possible, etc. To make them a person that the jury would not choose to sentance to death. But in this case there is no way she can overcome the victim. As soon as she starts bawling in front of the jury box all the SA has to do is pop in a video of Caylee singing or playing, and any sympathy she had is gone. Her normal approach simply cannot work in this case.

I think they have fingerprints....since they specifically ruled out C, G, and L and not KC. Why not rule out KC, too, unless they couldn't?

ITA. The only fingerprints we heard that were ruled out were those stated above. Unless I'm mistaken, we never heard about KC's and don't forget about the 700 pages of discovery given to the defense 3 weeks ago that haven't been released to the public. Why not? I am 100% convinced that the SA has a smoking gun and that is why the DP is back on the table. They would never have used it as a strategic move, especially when it costs the state millions to try a DP case. They wouldn't risk it. I say KC's fingerprints are on the duct tape along with the dog hair, fibers from the house, etc. My friends, I say we don't even begin to know what the SA has. All that ridiculousness from the defense team yesterday was just that - ridiculous. You know the old saying - the best defense is an offense.
 
I got the feeling when KC never once looked at her parents in the courtroom yesterday that she is blaming her parents for the situation she is in and is doing her best to make them suffer by not acknowledging their presence whatsoever.....after all, they spilled their guts to LE when they first realized Caylee was missing and now KC is facing the DP....ALL because of them (in her mind)!

I think KC is quite the b*tch to her parents....as she's always been to them!!

I agree, yours is the most likely scenario,but as I said on the SODDI thread,KC might be spilling the A's skelatons to JB to add to the "throw everything out there and see if it sticks" defense.
KC's disdain for her parents may mean they are being thrown under the bus ,also. CA was the last one seen with Caylee,for sure,and both the A's have lied ,lied lied.
 
Maybe she will---if AL struts her stuff enough to make KC look up to her. KC has probably learned all the lawyerin she can from old JB. If this old gal can "teach" KC some of the law and make JB look like the numb-skull he is. Hey, I can see KC wanting to follow in AL's shoes. I think she is bout ready for to move on to somebody else. She will tire of JB soon---she gets tired of them quick---look at her friend/boyfriend history.

Maybe so MAMABEAR...KC seems to like "dancing" with women, perhaps she will develop a "crush" on the new DP attorney! :crazy::crazy:
 
I totally agree. Documents have been released under the Sunshine Law and that is perfectly legal. I have yet to see anyone from sthe prosecutor's office go on The Today Show or Geraldo At Large or on any news show. However, Mr. Baez doesn't hesitate to put himself out there claiming his client is innocent. The man doth protest too much imo. He has turned himself into a laughable character. jmo

I must admit he puts me in mind of Fred Flintstone.:)

And then AL will pop in a video of KC singing and dancing as a little girl who traded in her adolescence to be a single mom. . .but she still had that unfulfilled need to also dance sometimes, but she always took Caylee with her. . .until that day of "the incident." (And where was JG that day of the incident?)

I really feel that if the defense tries to use Jesse as a scapegoat, it's going to backfire on them. These jurors will get a good look at the witnesses in this trial, they will see Casey, her parent's, and all of the dysfunction they generate. They will learn of Casey's many lies to Jesse and others. They will see Jesse and how he wanted to be w/ Casey, even after he found out Caylee was not his. They will realize exactly what the defense is trying to pull and they will not like it, IMO.

I can see the SA closing with the video of Caylee singing "Please Don't Take My Sunshine Away" to her grandpa and then saying "and ladies and gentlemen of the jury, that's precisely what Casey Anthony did - she took Caylee's sunshine away, forever."

Well done. This brought tears to my eyes.

I would be furious as a juror if AL tried to elicit sympathy for KC.

She (KC) was the one that took the sunshine that was Caylee Marie out of all of their lives.
 
I'd like to know why the DP was ever taken off the table personally. I'm sorry I missed everything today. One concern (not really lol) I have regarding AL is her ability to bond with Casey. The small clip I saw on JVM, KC must have adjusted her hair 30 times in a 60 second clip while her body language leaned away from the new lawyer brought on to save her life. It won't really matter what the lawyer has to say, if KC's body language contradicts that. I couldn't take my eyes away and missed the entire audio of the clip.

I also got the impression that KC didn't like the new attorney.
Her smile seemed fake and she quickly turned away from her.
It may be that she knows she can't con or manipulate her.
 
I'm sure hoping that's not the defenses mitigating circumstances. I don't feel Casey was abused.... so many people can look & find something disfunctional in their upbringing.

There isn't anything from her upbringing that I see that could substanuate killing her child. CA & Casey had a deeply co-dependant relationship. Casey getting a real job & moving out would have resolved most her issues.

She just wanted to stay where it was easy & she had power over CA by holding Caylee over her head. Casey did just that until from my opinion CA 'had enough & was going to boot her out & go for custody'. Casey did what sadly many spouses in divorce/custody battles do... she planned if that were ever to occur she'd ensure CA never gets Caylee. I think the last straw was June 15th for CA and Casey enacted the plan. jmo


I'm not saying that is a viable defense. What I am saying is I think it will come in during the penalty phase with this particular lawyer. Whether you call it abuse or dysfunction, no matter how subtle or severe, when it comes to the death penalty, most attorneys will try it.

I watched the video of the defense team ( their comment's after the hearing). Mr M. (atty from California) said that we should ask the state, or the reporters should ask the state why they brought back the DP, after it had been waivered. I believe LKB made a comment about Casey being prosecuted like she is Ted Bundy. I am sure the state has their reason for bringing back the DP...I believe that reason to be the use of Duct Tape in the murder of a child. A child that was the Defendant's daughter.

I have no right to ask the state anything, they have the burden of prooof at trial, not before. Whatever evidence they put to the GJ was enough to get a Murder Indictment...The Defense doesn't want to show their hand before trial, I am pretty sure the state doesn't either. It's simple, if the state doesn't have enough evidence to convince a jury of 12 Orange County, FL citizens, Casey will walk or there will be a mistrial. If the state has the goods, and I believe they do, Casey will pay for the murder of her defenseless daughter.
 
Lovely post if it got on there. They have NO ground to walk on. It is just so bizarre for this to even be happening?! This has to be stopped that this nobody family thinks they are King Tut? What is going on here?

I think that may just be the problem in this case - and perhaps behind the reason for all the desperate attempts the Anthonys have given to visit KC unrecorded. (I mean, what's left to corroborate and who would believe it from such impeached credibility anyway?)

They know JB will do nothing more than get her the green mile walk.

AL has brains, but since she does not look like a DJ at Fusian, there is no convincing KC that her white knight is really an Amazon...
 
Yes, Casey's attorneys want the case dismissed, too. Yep, everybody go home and forget about this case. Defense is hoping to "hokiss pokiss" it away. Defense will forever find fault and whine like children. IMO, they need a time out in the corner.
 
If I am not mistaken the new atty. during this media moment stated she would be filing several motions over the next few months as to why this is not a DP case. What I found interesting was when she stated somewhere along the lines of her motions will be very clear as she is a Prof. and is impeccable about her writings.

Did anyone else catch this. And do you think this was a jab at JB for the way his motions have been filed.

Maybe she got tired of JB writing his depos in crayon. :banghead:

I believe JB is picking up the taint of word salad employed by Ms. A, and her relatives. They often use words incorrectly.

I think he meant " I emplore you..." but used the incorrect word. People who fancy themselves well educated often use words they hear , but fail to get the word correct. but that's just my opinion .

But, one also doesn'y say, "implore upon."

Is one required to take English 101 as a prerequisite to law school? :waitasec:

"Her story just doesn't jive with the facts." Anyway, I really enjoyed your post ... I find linguistics fascinating!

Try the medical field. I once got a request for an MRI to "rule out an axillary mass in the vagina."

Given that "axillary" refers to the armpit........

Turned out the order should have said, "adnexal."

And, the typos get even funnier than that!
