Casey To Serve One Year Probation

I can only hope that KC sucks JB, and the entire DT, dry! I imagine that they're all trying to grab a piece of the pie, but there's only so much to go around. Eventually, everyone must have to get back to work. But what do I know. Obviously, I don't have their ability to make something out of nothing.

An "anonymous source" says Casey has a book deal? I'll believe it when I see it. A reputable publisher would have had to have lost his mind to give her a book deal. I hope he's prepared to close up shop and reopen under a new name because the public backlash will bankrupt his business.

I just figured out why HHJP ordered her to report by the 26th. Isn't the hearing on the money owed to the state on the 25th? He is going to have her attorneys right there to question them about her intent to report, and if she called by then.

I think the DT is setting some ridiculous precedents. If every convicted individual appealed every single judgment and sentence, for little to no reason, we would have to pay a lot more in taxes to hire all the new lawyers and judges we would need. It already takes 10-15 years to carry out a death sentence!

JB is intent on pushing this to the ends of the earth! He's making a mockery of the entire judicial system and I wish someone would stop him. Now I read that in the case of Anthony Sowel, his team is going to appeal based on Sowel winking at a juror! It's just too crazy.

Sadly this is where society has come too. The spirit of the law has died a death long ago. Leaving only the letter of the law. And the letter of the law is very clear. Everyone, no matter how hated gets an impartial trial. With the right of appeal on any issue. No matter how dumb. No matter how much it costs. When the value of "the one" in society heavily outweighs the value of the whole of society, this is what you get. Sadly the victim, Caylee is no longer alive to be "a one" now. She can not appeal her injustice. The courts do not help victims anymore.IMO Just the accused. Does anyone else see something very wrong with this reality we now have???

I wish I could believe that allowing KC until the 26th to report was done for righteous reasons but, sadly, I cannot. I think she was allowed that much time so that a motion for stay could be filed. When I combine this unnecessary leeway provided KC by the court on the probation reporting date with the fact that sentences ran concurrently when they easily could have been ordered to run consecutively...well, to me it hints at the court's attempt to save face without really inconveniencing the felon.

I will change my view on this if a couple things happen, i.e. KC's motion for a stay is denied, firstly, and secondly, she does not get an atypical probation--one that's on paper only (to appease the public) in which she is not required to do what others on probation are required to do.

I just don't understand how anyone can do probation in jail. The whole idea of probation is an individual going from an environment of total control (jail) in which the individual has no control, to an environment in which the individual now has control over their actions, but must prove to the court that they are able to to do the right thing..............maintain a job, follow all laws, and meet financial obligations.

An individual can't exercise the freedom to illustrate to the court that they're capable of handling freedom and obeying laws if they're in an environment where they have no freedom.

Completely agree. Probation fulfilled while confined does indeed seem to defeat the entire purpose. Judge Perry seems to agree with us as well. ;) Hopefully, his order to enforce Judge Strickland's original order (assuming the appeal will fall flat on its face in Daytona Beach) will perhaps set precedent and help to turn this bizarre and absurd phenomenon around as it affects many FL cases, not just this one. We can dream, right? ;)

Now why would Baez want to kick JP's order upstairs especially in light of the comments about the DT? I wouldn't want my name and reputation getting slammed twice in the State where I'm practicing law. More career suicide, if you ask me. So...go ahead Baez.

The problem is, you're thinking like an intelligent, reasonable person. ;)

Yes, my bet is that someone from the DT brought that most hated article to his attention.

You are right it was brought up by the DT. So it seems she will continue to hide because her address is sealed if I read the probaton order correctly. Too bad Caylee couldn't hide.:maddening:

I'm confused how you can even appeal a sentence? Baez and his client turned in a guilty plea. I thought when you do that, you are also accepting the sentence handed down. It was as clear as a bell. What am I missing here? Baez tried to get something past the court and it was caught, simple as that.

I expect her to argue that her probation time must have started at the moment the trial ended.:banghead::banghead::banghead:

If that were true, she's already violated her probation by not reporting to her probation officer.

Works for me!

According to an item posted on WESH.com today, the grounds for appeal are that the defense doesn't believe that Judge Perry has jurisdiction to order Ms. Anthony to serve probation. See below.

But I thought he admitted he was aware of this mistake and chose to look the other way. He was present and right next to her when she was sentenced and heard what the judge said. Why does he insist on wasting more taxpayer money? He's the one who advised his client to turn in a guilty plea, thus accepting the judges sentence.

Idk, each and everyday, I sit back and wonder what they're spiking the watercoolers with in the courthouses down there, lol.

As far as 'accepting the judge's sentence', I think it's fair to say that Mr. Baez is a "that was then, and this is now" kind of guy, if you catch my drift.

Yes, he did admit that he was aware that Judge Strickland's order wasn't followed, but based on Mr. Hornsby's comment:

In that challenge, Anthony is expected to argue that Perry does not have jurisdiction to order probation now.

"It's going to boil down to the the simple fact can you do probation in jail?" Orlando attorney Richard Hornsby said.

...it appears that the classic 'double jeopardy' is what they'll be arguing, regardless of whether or not they acknowledge the error.

From a strategic standpoint, I see Mr. Baez taking advantage of any and every opportunity available to him that would help to prevent Ms. Anthony from having to return to FL (including his insistence that her life is in danger if she returns, etc.), even if it means filing an appeal that, on the surface considering his admission seems to make no sense. But I think he does this as he has reason to not want her returning to Orlando (some of which are probably personal :floorlaugh:) including not having her available for depositions in other cases, etc. JMO. Hope this helps. :)

Believe me, my post was completely sarcastic. Silly me, why would I think that any plain common sense would prevail anywhere around this group. I hope her DT is laughed right out of the court of appeals. She deserves nothing less than anyone else. IMO

Well, FCA could handle it herself! Oh wait that would defeat the purpose of not going back to Orlando. Wait! The appeals court is in Tallahasee! Yes, she could handle it herself!!:floorlaugh:

Love the message, but 1 correction in your post. The appeals court is in Daytona Beach, less than an hour from Hopesprings Dr.

I wonder what's going on with the appeal? Are they playing chicken and delaying it as long as possible so her appeal would be delayed longer but gambling that it will be filed and a stay granted before the 26th??

No appeal show up in the listings today or on any major news sites? Anybody?

Wouldn't be surprised if there is no appeal. Probably working out a way for Casey to show up very early ,like this week ,and totally throw everyone off.
I wouldn't even be surprised if they do it at night or on the weekend for safety.
