I've never denied that CA is a combative individual who thinks she can make up her own rules as she goes along, and I agree that this depo would probably have gone much more smoothly in a courtroom, with the imminent threat of contempt of court hanging over CA's head. I still think however, that IMO, JM reacted unprofessionally to her shenanigans and responded in a retaliatory manner.

That's the beauty of Websleuths - all can agree to disagree.

Having said that, it appears that all the lawyers posting on this thread agree that Mr. Morgan acted professionally.

What was supposed to have been the unprofessional part?

I had a depo recently...the guy kept pretending not to understand plain English...I would say, "well, did you HOPE he would say no?" "did you WANT him to say no?" etc. He would say, "I don't know what you mean by HOPE," "I don't know what you mean by WANT," etc.

So I said, "OK, these are common 4-letter English words. You want me to list all the 4-letter English words I know until I hit on one you've heard of??" And he said, "OK, OK, I know what WANT means."

Was that unprofessional? ;)
 
What is this "confession" stuff? There was no bullying that I saw, and there certainly nothing about a confession. Cindy is her OWN worst enemy. She does not need any prompting.

The suit is based on an allegation that KC has defamed ZG. Near the end of the depo, JM pressures CA to admit that she was the vehicle through which KC's alleged slander was published, but then he goes further by trying to get CA to admit that she also slandered ZG herself, even though ZG has made no such allegation and has not sued CA. That is what I meant by a confession.

OneLostGirl you always make me laugh with your posts! (I think I've mentioned this several times before - you sure don't seem "lost" to me with your spot-on analysis... ;))

I don't see anything unprofessional or bullying about that. It would be very easy to respond to, if you hadn't been going around slandering someone. Either (1) you would have determined that your daughter was lying about Zani and would not have spread her lies around the world, or (2) you would have believed your daughter and spread her story around in hopes of saving your granddaughter from the evil Zani the Nanni.

Where CA runs into trouble is that she figured out her daughter was lying but kept on repeating those lies in hopes that other people would blame ZG for what her daughter did.

The above post is incorrect. Mr. Morgan did not "pressure" anyone, least of all Cindy A. :doh: Cindy A. did admit that she caused information re: ZG to be published, ergo she can expect to be added as a defendant or for a new suit to be filed against both she and her homeowner's insurer. "Publication" is a necessary element of the legal principle of defamation - simply uttering something that isn't true to one person is insufficient to support a lawsuit for defamation.

As another poster, Themis, already pointed out, this line of Q&A was simply brilliant on the part of Mr. Morgan. ;)

Exactly. Like I said, so far, all the attorneys weighing in on this thread see no unprofessionalism on the part of Mr. Morgan.
(I'd almost bet that most of us think he was beyond patient in many respects...)

As I've emphasised, I am just expressing my own personal opinions here, from my perspective and beliefs. Clearly JM's actions are considered by his professional peers to be well within the limits of appropriate professional conduct and so I take that as a given, and with the utmost respect. It doesn't alter the fact that I have a personal opinion that differs though.

I am not an attorney, but even I can't see how JM kept himself collected in the face of CA's actions. She was outragous. I saw such venom spewing forth from her. :snake:

OMG------I don't know about unprofessional-------but thats the best LOL I've had all day---thanks.

As a layman or layolewoman----sometimes we don't get what is really happening in these depos and all the legal stuff. But I reasoned this depos stuff out as:

KC brought ZG into this mess and KC needed to step up and publicly and legally say this one was not the one she was talkin about. At the same time or soon after CA started spouting that this was the ZG. KC had a chance for this to be over and say this wasn't the same one----no she decided to show how smart she was and cross-filed (or what ever it's called). She thinks that puts her in charge.

Did you know that if ZG doesn't get her name cleared that she (ZG) could somehow slip right back into this mess?????? It could happen. Why not nip it in the bud. Only she (ZG) has a right to be the only one to screw up her name. Poot I had a hard time keepin my nose clean on my own without some sow pullin me into their mess.

A depo is just like a court room but the Judge isn't there. You are possed to go in---shut up---sit down--------answer questions. That is the law. If you don't then you end up before the Judge and may go to jail.

There are laws of the land that we have to abide by, whether we like it or not. We have 3 choices, Abide by the law---go to jail or leave the Country. (before you break the law, that is). One person or family can NOT make the laws of the land. The laws are already set.

The lawyers sitting in a depo knows what they can do and ask before they start to speak. The witness (CA or GA) had their lawyer there and could say the words "objection" and Morgan would let him say why he objects. If the 2 lawyers still don't agree then they go before the Judge or they can settle it there. From what I have seen of Morgan----man, I would want that dude on my side.

Now, you don't say---> "Not gonna answer that"---"You say that again and I'm gonna get up and walk outta here"---YOUR lawyer CANNOT answer the questions for you (BC did in fact answer at least one question--I heard him.) CA and GA are NOT allowed--by law--to act the way they acted. I think that Morgan's bunch, under the circumstances, did a great job of staying calm. I can't wait for CA and GA to be in front of a Judge and act the way they did at the depos-----I hope the Judge saw that video of the depos so he can wear his boots so he can get ready to kick some :behind:.:blowkiss:
 
I watched her depo once when it was first released, and aside from the obvious lies that garnered so much attention, there were 2 things she said that sorta stuck out but I don't know if they've been mentioned yet (if they have... sorry)
1) CA said GA was mistaken about the day he followed her on the expressway and that SHE TOLD HIM it was a different day. (I guess G said, oh ok honey you are right)
2) CA said on 6/15 they were watching Caylee in the pool and as soon as KC got home she wanted to go in the pool too but CA said no, it's too cold now & Caylee's getting out, or something like that. (Probably just to piss off KC)

I think it really indicates just how controling CA may be, and may have treated Caylee like gold but KC like crap.

Oh no way! George looked so smug and condenscending when he was correcting Mitnik on the correct way to say Zanny (or Zany, lol.) That interview might be where Mitnik got his way of saying it. I'm off to listen to that interview again.

Mitnik did ask him at some point if he had reviewed anything before showing up for the deposition. I laughed out loud on that one.
