Barry Morphew appeared in an Alamosa County Court courtroom on Tuesday afternoon, wearing street clothes including a flannel shirt and blue jeans, instead of his jail uniform, even though he remained in custody of the Alamosa County Sheriff's Office. He was arrested on June 20 in Arizona and extradited to Colorado after a grand jury indictment.

The judge said that she wouldn't reduce the bail amount but did modify the terms of the bond. The bond was changed to a cash surety or property bond. That means that a bail bond company posts the bail on the defendant's behalf for a non-refundable fee, typically 10-15% of the total bail amount, which means that he could pay $300,000 for the bond.

The judge also added additional conditions to the bond terms for Barry Morphew:

  • He must surrender his passport
  • He may not leave Colorado for any reason
  • He will wear a GPS monitor
  • He cannot leave his home for any reason except to appear in court, meet with his attorneys, attend a doctor's appointment, or for a medical emergency.
  • He must use only his name of Barry Morphew
  • He must only drive vehicles registered to him
  • He may not possess or control any firearm.

I'm glad there are open courts and livestreaming.

To expose how much of the American justice system has tipped to theatre.

What happened to officers of the court, seeking truth?

Is creating subterfuge really an art? To be celebrated?

"It couldn't have been Barry because he didn't have a current prescription for BAM."

Who does that serve?

And now comes the fancy footwork to kick the trial down the road.

If he makes bail, his only freedom is on this side of trial, a luxury he's exploited for five years. His attorneys get paid, not by the job, but by the hour. One year delay, two year delay.

Every day there's no trial is a day he gets to be free.

You can't move around assets prior to going into a nursing home but I guess you can if you want to hide assets from the court when you're charged with 1st degree murder.

Disappointing day.

BM further admitted to Investigators/Grusing that he also could have tossed his remaining vials of Rx "BAM" (animal tranquilizer) from his garage bench during his multiple trash runs on that fateful Mother's Day 2020!

And he claimed to use it as recently as the month prior.... in the breezeway....

Now he gets to control and manipulate the people who don't leave his corner to gain assets enough to buy his way out of jail. Again.

And if he can't follow the rules, they pay.

Something not right about that.

A literal joke if he can make bail.

Judges make bail unreasonable for petty 🤬🤬🤬 crimes but now two times mr.murderer I mean morphew has a chance at bail. Smh

I'm all for recusing this resting face Judge tomorrow!

She had an after-lunch, 40-minute hearing, and couldn't refrain from swigging her Starbucks?? Talk about Courtroom Decorum, NOT!

Allowing Morphew relaxed and attainable bail conditions without even restricting him to the County-- just the state of Colorado, seriously? I just can't...

I can't believe the string of bad luck we've had with the judges on this case.

New Rule: Never trust a judge who drinks Starbucks on the bench.

All of us on #TeamSuzanne now have cause for concern.

We've all seen how bad rulings can affect this case.

IMO the Judge gave heavy weight to the Morphew daughters’ support of BM in her decision. I thought she had an emphatic tone when she mentioned their support. Can’t really explain it in words but suffice to say after hearing that, I had a feeling Judge was going to reduce and/or adjust the bond conditions.

And as I understand it in my non legal/legalese, a bail bondsman can put up the bond for a 10-15% fee which means BM would only have to come up with $300k cash. I think he’ll have no trouble paying that amount and likely be out/free by end of day.
I’m very disappointed, to say the least.

IMO he doesn’t deserve to be free/out on bond. If he gets a bondsman or whatever/whoever helps him out and pays $300k or thereabouts and freed, hope he eventually screws up doesn’t comply with the bond conditions or something.

He committed first degree murder of his wife! and belongs in a cage. Ughhhhh I better stop and go take a walk, this is unreal. I really feel for the Moorman siblings, AM, DM, MBM has to be so hard on all of them.

Poor Suzanne, may she have the last, final word at trial.

On the upside, we learned that the prosecution recently handed the defense yet another 4 terabytes' worth of fresh discovery, which means they're continuing to add to the already "voluminous" (to quote the defense attorney) amount of evidence they have against him.

I'm hugely encouraged by the apparent work this new prosecution team has put into the financial angle.

I'm thinking a sizable chunk of that 4 terabytes is related to Barry's questionable financial moves.

In addition to the $300K bond fee, let's not forget that the Surety posting BM's bond will seek $3M for collateral from somebody.

Just ask Fotis Dulos' "best friend" (A Curry) who signed a $3M Promissory Note to his Surety as collateral for his bond, and after his default, not only lost the fee she put up, but was also sued for the collateral! This suit is still pending in CT.

His lawyer actually said that there is "factual evidence he is innocent ". I wonder what his definition of factual is ? Or did he get confused? Because its a total flippin fantasy that this guy is innocent of killing Suzanne.

Regarding bail :

On the whole I find the judge smart and reasonable. I liked how she pointed out that bail/bond is NOT about his guilt or innocence, that's for trial.

But, this judge set the 3m cash bail understanding the info - the info has not really changed. So did she set in high in order to negotiate? Is that customary?

I do disagree with her weighing the daughters opinion of their fathers guilt or innocence above the thoughts and opinions of the other victims, the Moorman siblings, while making the bond decision. The siblings are in a much better place to accurately assess the situation. Children often side with the surviving parent.

So the bail is set at $3m still but allows for surety not all cash. I don't love it but at least I understand how the judge got there

Didn’t the Grand Jury recommend the $5 million bond to the judge after their indictment? Did I dream that? If it were any of the rest of us we would be under the jail. Infuriating and so disappointing. Still, Justice will eventually prevail.
