Well the defense sure got off on a very bumpy start today. JMO

Lol. Judge was told to have a good weekend and his response was “Well, we’ll see.”

Is there a chance of a claim of ineffective counsel in the future?
Judge has to talk to Moran as if he’s a child. Constantly. JMO
I hate to say this but I've been wondering the same since the beginning. Defense can't find things, doesn't remember things etc......

Cheers all. It was fun and funny. See you next week.

So Dr Ha will either come back and testify with compensation or do remote testimony. JMO

Last thing I heard on the record is Defense needs to make a decision on either making travel arrangements for this witness or witness will testify remotely ( which Prosecutor is fine with).

Night all. Be safe. Be kind.

I had to go out for a couple of hours. Looks like this witness was no better than the last. I have a lot of catching up to do…

The defense only had a couple witness's today and none of them helped their case in any meaningful way today.

The third and final witness only got a couple of things in before the end of the day. Nothing of any importance yet from Dr Ha but maybe we will see more enlightening testimony from him sometime in the future. JMO

I was thinking about that earlier today but I just don't see it yet.

What I do see is the judge stopping himself when getting angry with the defense. He cannot show any kind of anger at the defense because that could become a problem with bias and he knows it.

If there's any kind of appearance that he's getting overly emotional with the defense that could be grounds for a later appeal. JMO

It sounds like he’s saying that the reason the dog didn’t smell Dylan on the pillowcase was because Dylan emitted different smells at Elaine’s house vs. Mark’s house and the dog liked the smell he emitted at Elaine’s house better? I’m being facetious, but that’s honestly what it’s sounding like to me.
Maybe Mark should have offered up the Nerf football for scenting purposes. According to him, didn't Dylan's weeping cold sores get all over it?

I was really surprised that the wildlife expert wasn’t on the stand longer. Wasn’t very in depth. Do you think they wanted to get Dr. Ha in so they maybe cut it short? Knowing what we know now about Ha only being available today. Man it was a mess.JMO

I actually googled ineffective counsel and read that there have been lawyers that fell asleep and showed up drunk at trial and even that didn’t prove it. It has to be more like your lawyer didn’t advise you correctly about pleas you could have taken or some such.

The prosecution was very adamant that Dr Ha not testify. They gave some very good reasons why the judge should rule in their favor.

I think that the judge would have liked to side with the prosecution and not allow any testimony from Dr Ha but for one big reason.

If the judge disallowed Dr Ha there would be no way the defense would be able to get a replacement for him in this trial. That would mean the defense would not be able to respond to a big part of the States case. HRD dog evidence.

The only thing the judge could do is to allow Dr Ha to testify but limit what he can say in front of the jury. Other wise you have a big point for an appeal. JMO

You are correct.

A lot of defendants have crummy public defenders who do a lousy job and they don't get a do over. Defendants are entitled to free lawyers not great lawyers. JMO

Went back and watch prosecution question Bruce Anderson. He chewed him up and spit him out! Anderson is an idiot.

The defense needed someone to bolster their claim that a coyote could have carried Dylan's skull from the main remains location site to where it was found.

They should have only used him to say it was possible and end it there. They got him talking about way too much stuff that let the prosecution use in their favor.

I think that the wildlife expert was becoming a prosecution witness towards the end.

Dr Ha should have been called first since he has to leave town. I have no idea why that didn't happen. JMO
