I found this. CO may be less than 72 hrs. I haven't found it specifically.

As a general rule, however, if you are placed in custody, your "speedy trial" rights require the prosecutor to decide within 72 hours which charges, if any, will be filed. Many states adhere to this 72 hour limit, but other states, such as California, go further and require that the decision be made within 48 hours after someone is taken into custody.

I looked through the statutes and court rules but could not find anything more definite either. Several attorneys referred to the 48 hours, but qualified it as "within a reasonable time." I'm just guessing, but I would think charges would be filed on Monday, most likely.

Yeah, I don't have much faith in the so-called sighting in CA. I doubt very much a man would not only have a kidnapped boy out in public, but would do anything to create a scene or attract attention. And Dylan would be fourteen, not likely to be easily thrown over a shoulder and carried off. It just sounds too out there for me.

I consider it to be a Facebook rumor. I'm sure that LE has received hundreds of similar reports over the past few months. MOO.

This La Plata County deputy being arrested for suspected possession of child is no minor thing. I think it's important to note that there are only approximately 50,000 people in the whole of La Plata county. This is not a heavily populated area. The arrest of LE officer in say Cook County, Illinois where the population is over 5,000,000 is easy to dismiss quickly. This one, not so much.

ITA I don't think anyone is saying with 100% certainty that this guy is responsible for Dylan's disappearance, but it would be irresponsible to dismiss it so quickly without looking into it.

Agree. Not to mention she said he was saying, "You're not my dad." That's something I've seen in those What Would You do? on ABC. I think it would be freakin' awesome if it was him and he was rescued and brought home, but I'm not holding my breath.

I am stuck on this guy being accused of possession of child and I have been searching for other arrests that would indicate his arrest was part of a sting operation and I can't find anything.

This leads me to wonder if his arrest isn't a part of the investigation in Dylan's disappearance and any forensic evidence or other evidence the DR Task Force has. They could be diverting attention by outright stating that Bayfield MO is investigating the child .

The timing of this is just very interesting to me especially combined with LE's seeming dismissal of dog alerts on the reservoir and LE's silence about the family driven searches that are pending on the lake. I'm anxiously awaiting more information....

I would think that the bond would have to be reasonable for what he is charged with but not necessarily match up with what he may be suspected of.

Maybe LE put pressure on JS with the arrest on child charges to see what he will do next? MOO.

Amen. I thought the exact same thing when I read it last night 12 minutes after she posted. Way too pat and not believable. IMO.

I'm taking a guess that the ice melts faster when the temperature goes higher. I don't know how much ice needs to be gone for them to search.

Water takes longer to warm up than than the air. And I see they expect another cold day or two next week.

I know I sat through a snowy, freezing baseball game in Denver in May one year.

I wish we knew who they plan to use, so we could do some research on conditions needed.

I think they still need divers, but I'm certainly no expert. Maybe it depends on the type of ROV used(?). This document says ROVs aren't a replacement for divers, and talks about what the diver does.

Agreed, the whole thing sounded made up, or at least enhanced somewhat, to garner attention. In the first place, it sounded like this was a recent incident, and I also doubt that if he's been held captive all this time, he would be allowed to roam around in public. And a 14 y.o. would be doing more than just yelling "You're not my dad!" They'd be kicking, fighting, scratching, pounding on the guy's head. I'm not buying it.

This is slightly off topic for Dylan, but an ' in general' to think about. A family member encountered a pedophile LE some years back. The LE community, as you all know, is like a brotherhood. While there was nothing at all funny about the situation, once he was released from prison, we did get a few grins at what went on next. He thought his LE brothers would welcome him back with open arms. He thought they would see how he'd been ' railroaded' even though he pled guilty and did 5 years flat time. ( in a previous story I told how our lawyer family friend advised us during this process and he assured no innocent man ever has pled guilty to any type of child sex charge PERIOD, it does NOT happen ) This guy even thought he would be going BACK into law enforcement. He called up his old departments and said I'm back, etc. So while not a laughing matter at all, it was a joke the way he thought the LE brotherhood trumped the protection of children. So regardless of this JS involvement in Dylan's case, he's TOAST... the idea that the protectors of children would turn on them sickens the REAL protectors of children , which is the rest of LE. I understand that there are dirty cops and they might be involved with drugs or money making schemes, etc. But a dirty cop is not a ' child molestor' . So take heart, JS's life as he knew it is over.

The rest of the story for those who care,, this man served his 5 yrs flat, got out , sent out resumes, contacted all his old buddies, attempted to file a lawsuit against my family member for 'wrongful imprisonment' ( talk about a guy who does not understand the system) and had 10 yrs parole with RSO standards , which are very strict. Within 6 weeks , he hung himself. End of Story. While I hate to rejoice in a death, his death freed a young lady. Still struggling of course, but the fear in those 6 weeks was crippling and took the entire family to keep her afloat ! God is merciful.........to the righteous !

Yes, they are going to use ROVs and other sonar equipment but if someone is found, I would think that divers would possible have to go down and do the retrieval. JMO

I agree with you Redhead72. There was a family that was almost completely destroyed here in AZ a few years ago, a photo processor reported them to police, they were arrested for child . The pictures were pictures of their kids (little ones) playing in the bathtub. There was NOTHING wrong or sexual about them. On the other hand, there have been some resource officers that have gotten into some sticky situations with high school girls and texting / sexting. Child sadly blankets a lot of things.

And, sadly, sexual predators of various types are all too common within our midst. Remember the amount of children that have experienced a sexual assault-type crime (it's a lot higher than reported). Most crimes like these occur within the family, but some occur with contact by a close friend, a neighbor, teacher, or coach -- even a police officer. Most sexual predators are never reported, and aren't registered, etc...

My point in saying this isn't to make everyone paranoid of sexual predators of children or others -- just that they are out there, and they are people you would never necessarily expect of doing crimes like this, either.

Still, I'd need to know the details and what ages were involved, etc... before passing judgement on someone as a "pedophile" or even just a "sex offender". I'd want to know what kind of evidence police have, etc... also.

I'm just glad they are investigating this thoroughly, and this man is now being watched, and is off-the-job. It's a small town. I'd expect he'll move now.

Unless there is something tying his crimes to kidnapping or murder, etc... I think this may be an unfortunate coincidence - not that it's not worth looking into a bit. I'm sure BMO is aware, and if they find anything at all relating to DR I'm sure they'll be in contact with the LPCSO.

I remember someone posting information and a URL stating that these ROVs are definitely capable of retrieval if need be. So if there is something in the deepest parts, and for some reason it's too dangerous for the divers, then it can still be recovered. There were pictures on the page showing pictures of how it was done, too. Can't remember who posted it though, originally.

On the left-hand side of this webpage there is a chart that will tell you the current conditions of the lake itself.

The Estimated Average Water Temperature today is around 48-degrees. So that's an average of 10-degrees warmer than 10 days ago.
(Please note that this is an algorithm-based estimate of water temperature. It is not the actual temperature of the lake, nor all parts of the lake, either.)

It is forecast to snow again on Wednesday up there and be back down in the low 30s.
