As a step-parent, you don't automatically have legal parental responsibility for your stepchild. You can get parental responsibility for your stepchild through a parenting order or adoption. The custody rights of your stepchild depend on what's in your stepchild's best interests.


For HH to stay with Al and the children, I would think that would be very awkward. Big sister relationship cannot overcome your mom killed my brother. HH may sympathize with Letecia and feel Al is somewhat at fault, along with LH. As far as we know Al didn't adopt HH. HH might see herself, overtime, as Letecia's replacement as little LS's caregiver, not her big sister, and resent her situation. Bad from all angles....HH is better off at her age, with extended family in SC. IMO.

Thanks. That makes sense. I just can't help but feel the little LS must have developed a sister bond with HH over the five years they lived together as a family.

And, Al might also have developed feelings for his stepdaughter.

Of course, they could be keeping in contact and we just don't know.

I'm not an attorney but I doubt he'd have had a legal responsibility towards a minor stepchild he never adopted. (HH's bio dad died the year before AS and LS married. They had divorced before he died.)

I don't know that H had much choice about going to FL. If her mother, her legal guardian, said we're going.... But if I had been HH, I don't know that I would have felt welcome in the Stauch home with Stauch relatives present anyway. HH and her mom lived in SC for years and apparently have lots of NC relatives. So I expect she has family she can call on.

I know when AS first filed for divorce he wanted the 3-4 month old family puppy returned to him.


That demand was apparently later dropped and HH has the dog. Supposedly it had been a Christmas gift to Letecia but I can't find a link for that right now. Being a Christmas gift would work age-wise for the puppy but it's curious AS didn't know the exact age. It's a French Bulldog so I expect it had papers. My guess is he didn't have much to do with the dog (he was gone a lot) but may have wanted it back for his daughter's sake.

So true--it's not like HH probably had a choice about going to Florida. At her age, she probably would have preferred to stay with her friends in Colorado.

Like Al, I would be hesitant to have a teenager care for a dog, but perhaps HH does a good job of it.

I agree that it might have something to do with his youngest daughter wanting the dog right after Gannon passed.

The whole thing still boggles my mind. So many lives destroyed.

Recaps of the upcoming Trial by both Law & Crime and Court TV below.

L&C says they CAN broadcast but the caveat is they must use the Court's WebX to do so. Whether or not they choose to broadcast might be another story. Have not seen L & C motion for EMC on file with the court yet.

I don't blame him either. That had to be so hard--especially if he felt HH had knowledge of the killing.

HH doesn't list AS as her "dad" but she said she lost both her "parents" when she was 17.

But, I also feel bad for HH. She may have known (or suspected) what happened, but LS is such a controller--HH's life in that house had to be hell, too, even if she wasn't subjected to the abuse poor Gannon suffered. Just knowing he was the target of her warped mother had to be a huge burden on her.

I don't know about genetics, but I do worry about learned behaviors.

I'm very interested to hear what HH has to say about her mother now--three years hence from the killing. Perhaps she will feel free enough to spill the beans.

yes I feel just like you do. But just with people I’ve known with narcissistic behaviors, its very possible HH was controlled, abused, then rewarded then the cycle started over again. She may love and hate her mother at the same time.

And i feel horrible for Laina. I’m guessing she is past Gannons age now and sometimes wonders if she was going to be ”next”. There are very evil people in this world. LS is one of them.

Thinking LS's abusive tactics probably touched on each of the kids at one time or another, GS from the way things ended took the brunt of it, yup I'm ready to run LS through the legal ringer again and again.

The trial of a Colorado woman accused of killing her 11-year-old stepson in 2020 is scheduled to begin on March 20. Letecia Stauch has pleaded not guilty by reason of insanity in the death of Gannon Stauch.

Prosecutors have presented evidence they claim links Stauch to the January 2020 murder. They said that investigators found Gannon's blood on Stauch's shoe, found her DNA on a gun linked to his death and learned that she traveled to the Florida Panhandle shortly after he disappeared. The child's remains were found there in March 2020.

Defense attorneys had sought to create doubt that Stauch committed the murder by suggesting someone else could have entered their Colorado Springs home around the time Gannon died.

A Colorado woman accused of killing her 11-year-old stepson may lose a key witness as part of her defense because a doctor for their side has yet to supply a mental health report less than two weeks before trial.

Judge Gregory Werner set what he called a “hard deadline” for Letecia Stauch’s defense of 5 p.m. on March 16 to submit the report.
Jury selection is scheduled to begin on March 20. Opening statements are set for April 3.

It seems like a really big deal if the doctor for the defense hasn't supplied the mental health report yet. How can either side - defense or prosecution - prepare for court without knowing what it says? If it's supplied by March 16th (3 days from now), it only gives them a few weeks. I don't envy that doctor's job, having their name attached to the report forever. Yet it's their job to get it done in a timely manner, and I'm sure they're well compensated.

In a letter just obtained by KRDO, Stauch wrote to Judge Gregory Werner back in February of 2021 asking to represent herself because she believed her legal team at the time was "in cahoots" with the prosecution.

Stauch said in the letter that she believes the doctor who performed one of her competency evaluations was "clearly an actress and friends with the D.A." She said she was diagnosed with a condition, which is redacted from the letter, back in 2016 and received treatment for it. She also claims a South Carolina school district let her medically resign from her position with the district due to "ongoing reality breaks".

Stauch claims she tried to get her previous legal team to consider her medical records from South Carolina, and that she had to pay a "firm" to get access to those records.

The letter goes on to mention that she didn't believe her former attorneys were taking enough steps to obtain evidence in her case.

"Since March 2020, I asked my attorneys to preserve the Gamestop footage, to locate the Texas Police Officer whom I spoke with, and to get the Cruise passenger list. Instead, they spent months contacting my family for mitigation," Stauch writes, adding that she believes her attorneys shared information with her family that they weren't supposed to, leading to disputes.

Then, Stauch mentions that she has a biological son and believes that others involved with the crime are walking free.

"I will not put myself or others in danger running the defense against my biological son when the system is letting two men run free who are involved. One is a prominent member of an 'independent business.

' They used the NGRI (to get a hearing) knowing I’m Not Guilty to cover up their lack of representation. Although, I had “bouts of insanity” and still do, I did not murder or abuse anyone nor would that be a defense because it’s my understanding that you actually did do it.

However, I will protect my bio son and I will protect the drugs and violence documented from my stepson," Stauch wrote.
Bumping MSM from 3/2021 where LS wrote a letter to Judge Werner in Feb-- stating she did not agree with the NGRI defense, and this was being used by her attorneys to get a hearing to cover up their incompetence and why she now wanted to represent herself -- "I am innocent."

I hope she's worn out by now and sits quietly at her trial like a bump on a log.

Judge Werner was very prepared for the last hearing -- citing a timeline from his handwritten notes questioning why the MRI he approved more than a year ago was then canceled by the defense, and is now being requested again. Seems to me he also re-read the Defense motion.

From the Motion, we know doctors from CMHIP believe LS is feigning symptoms of DID so they will be prepared regardless of how late Dr. Lewis produces her report. JMO

ETA: I'm recalling Judge Werner advising LS that once she uses NGRI defense, her medical records are no longer private.
