That's the other thing - how can the state argue it's not clear whether this was a deliberating juror? The state has no clue as to the identities of the deliberating jurors?? Excuse me. That seems like such a disingenous argument to me. The court of appeals said they looked at the record and it's very clear this WAS a deliberating juror.

agree, there was no mystery about whether or not this juror deliberated.

This is so sad and tragic for Gannon's family. I hope this gets overturned but am thinking that if the appeals court is correct the state needs to come back and retry with a vengeance. I hope she never has a free moment ever. It might be best just to start again.

Stauch was convicted in 2023 of brutally killing her stepson, Gannon Stauch, in an 8-week homicide trial in Colorado Springs. The state will have the opportunity to appeal the panel’s ruling up to the state Supreme Court.

In my opinion, this wasn't the first error in this case by DA Michael Allen, but in fairness, it's important to note that the Colorado 4th Judicial District covers El Paso and Teller counties, serving a population of approximately 723,000. It is a major judicial district based in Colorado Springs that handles cases including civil, criminal, domestic, and juvenile-- and employs hundreds of lawyers, along with thousands of support staff, investigators, and volunteers to manage cases.

A juror with a (disclosed) son-in-law employed by the 4th Judicial District does not guarantee a biased juror!

For example, in the case of the KY murder of Judge Mullins, the Judge assigned to the murder case did not disclose that he attended a seminar and shared a table with Mullins one week before he was murdered, and this was not sufficient for the defense to remove the Judge from presiding over the case.

For all we know, the relationship between the juror and his son-in-law may be limited to nodding at each other once a year at Christmas! JMO

Devastating news to have to face this all over again. But it’s nothing compared to what Gannon endured, so again into that dark night we go.

As AS said, the end result will always be the same.

She will never let Gannon or his loved ones rest.

This is beyond shocking! The trial was so dam painful for all involved

(except for that murderer AS, who breezed through it with toilet paper stuffed in her ears.)

I'm researching voir dire for LS jury selection now but not seeing anything yet by Judge Gregory Werner or the parties.

ETA: The first day of jury selection was March 20, 2023.

On March 26, 2023, Defense filed a Motion to Automatically Exclude Jurors who have a Preconceived View of Guilt [D-51], citing confirmation bias during the previous four days of jury selection, and the defense's belief that removing any juror who expresses a preconceived belief of Ms. Stauch's guilt will still leave more than enough jurors by April 3, 2023.

IMO, filing this Motion while remaining silent on the "biased juror" is further evidence that team LS intentionally banked juror MB for appellate purposes.
