Judge Gregory Warner excused multiple jurors Monday morning for various reasons, including one with a medical issue and another who’s scheduled to begin work as a prosecutor for the 4th Judicial District Attorney’s Office in El Paso County.

KRDO13 spoke with Gannon Stauch's mother on Thursday. She tells us she is very upset that this conviction has been reversed. She said right now all she can ask for is prayers and support as she and others continue to work to keep Gannon's memory alive.

The case came into question as a juror who had been identified as M.B., who had a son-in-law who worked as a deputy district attorney in the same office as District Attorney Michael Allen, who prosecuted the case.

You can read the official opinion here or in the view below.

The District Attorney's Office provided our newsroom with the following statement on the opinion:

Today we learned of the appellate court’s ruling in the Gannon Stauch murder case. The court’s opinion is a disappointing result for this office, Gannon’s family, and everyone who loves him. Still, we remain undeterred in our search for ultimate justice in this case. We will consult with the Attorney General’s office about seeking review of today’s decision in the Colorado Supreme Court, and if necessary, we will be prepared to present the case to a new jury here in El Paso County.

Until shareable information is available, we will have no further comment.

Oh brother. That is so hard. Small cities in the west, it is absolutely common to "know" everyone. It is like "Six Degrees of Kevin Bacon".

I hope that she still needs to stay in prison. I can't believe this. Crazy.

No offense but… idiots. :mad:

Wow. Just wow. I am just seeing this. This has my stomach in knots.

All I can think of is how this was missed? Did the prosecution not realize by allowing this juror on - the defendant could/would potentially use this for an appeal?! I mean I don't know. I've watched a lot of trials. It just seems like no one would want someone on a jury that has ties to the prosecutions office.

I will pray for Gannon's family. They are on my mind.

There is NO WAY they can unleash this vicious monster back into the free world. She would wreak havoc the first chance she got.

Can they keep her locked up now, even though the case was over turned? 😲

The recent development in this case is maddening. :mad: :mad::mad:

The beast has reared her ugly head. Again.
I think she will lose. Again.
I could say more but don’t want to get banned.

On a lighter note, a couple of my favorite hobbies is writing little ditty’s/poems, and journaling. It often helps ground me when I’m feeling sad, mad, emotional, and/or stressed about something. I promise, I’m going somewhere with this….

Last night I wiped the beast from my mind and thought alot about the most important person in the case- the poor little victim Gannon, who lost the most- his beautiful, innocent life. Suddenly I felt the urge to write and wrote a little ditty/tribute, incorporated a few things we learned about Gannon via following the case, and thought I’d share:

Beautiful, lovable, sweet, sweet
boy;
Shining bright star, and beacon of
joy;
Loved Sonic, Switch, and the color
blue;
A loving kind soul, so pure and
true;
“Here for Gannon”, a fitting
motto;
You’ll never be forgotten, brave
hero!

My heart goes out to Gannon’s Mom, Dad, Sister and all who loved him.
Losing a child and sibling in such a violent way by the hand of someone that was supposed to protect him, is unfathomable. So so sad the heartache and grief they’ve gone and are going through. I can’t imagine their pain.

Godspeed, I wish Gannon’s family and loved ones all the best as they endure through likely another trial and/or whatever possible antics, shenanigans the beast might try to pull. 👿

IMHO
