WOW...thats a tough one and I bet lots of jurors cannot really do this. I dont think there is much harm in that if a little of that goes on in your mind. Its almost impossible not to think about case in your mind. Its human nature.

Here's a question. Does anyone think the DT actually believes JH was insane on the night of the shooting? I know they have a job to do but I wonder what they actually think .....

IMO, If the DT does believe that JH was insane, they were not very passionate or adequate about getting that belief across.

I dont think any of the DT attorneys really think he was LEGALLY insane. If they studied the definition, then they cannot really believe it based on their evidence.

But for Gur, she probably does though. LOL

Great Point.

I totally agree. The DT showed no passion if they really believed he was innocent by reason of insanity.

I don't think they believe he was legally insane. They would have done so much better if they truly believed it.

Yep, me too.

Again, I'm already getting a bad case of Separation Anxiety... If I do say so myself, we have been a good little group of foks. Thanks to WS. We are from all over the place, different ages & situations & careers. We are all in search of justice for the victims, their families & loved ones, and the People of the State of Colorado. We agree the courtroom has been so fortunate to have the principals we have had -- even Mz. CutiePie, and Mz. I'm-about-to-cry; Mz I-forgot-to-brush-my-hair and then the Silent Ones. We'll be together for some little (?!) while yet, then Poof!! of we'll go. Like many of us have said, it would be nice to "find ourselves another one." Let's try...

And a BIG THANKS to our good, good Mods!! Coldpizza is a special one!

I believe they know full well he isn't Insane according to Colorado Law..so has spent the past few years "Creating" evidence, and persuading experts to agree with them. Unfortunately the experts that would go along with their agenda weren't that good. Both of them ( Woodcock and Gur mainly) actually did more harm than good given the dazzling cross examinations by Mr. Brauchler ..

So long and short of it is.YES THEY KNEW back then and KNOW now their created defence wasn't good enough.

The DT and the PT are beginning to be much more kind to each other as this winds down.

They are being very polite to each others requests.

It was 6 or 7 people just for mitigation witnesses during SENTENCING phase. They would only be needed during setencing phase mitigation.

Judge says now is not the time and we can deal with it later if needed.

DT tried to say they could videotape them in advance.

PT objected and said jury questions could come up.
PT also says there is a documented process for witnesses who become unavailable.

Judge says we will deal with that later if and when needed.

IMO, The defense relied too much on the 'episode' of Nov. 2012 to prove their case of Insanity. They built their whole case of Insanity of Dr. (just because I say it, it's true) Gur.

That's all evidence they had to work with, but even with the Nov. incident, it does not prove Legal Insanity.

And IMO, they did not do anything to connect the 'episode' to the July mass murder. That's what Dr. (just because I say it, it's true) Gur was supposed to do and failed miserably. A professional, more qualified expert might have been able to present their opinion much better to try to convince the jury-but, she really botched it up.

I'm listening to GB's opening- he talks about Dr. (if I say it, it's true) Gur & her diagnosis... Very interesting, now that we've heard from her!!
