Defense asks for sidebar

I know what you mean. I end up assuming ALL professional witnesses are "hired guns" unless they are still in their normal practice and somehow got dragged into a trial by accidental association.

I agree- but was wondering since this doc wasn't hired by def or pros., but was hired by the court-does that make a difference?

IMO - which of course means nothing - YES it makes a huge difference to me!

ETA - and the fact that this Doc said he had been hired by Defense as well matters to me.

WOW..It appears this is the first time he has been called by prosecution to testify..ALL other times was for defence..Did I hear that correct???

He was also court appointed..NOT cherry picked by council ( ala expert for hire scenario)...It sort of gives him much credibility. While JH has mental illness..He, by Colorado law doesn't qualify as Legally Insane.

NUTS..Coo Coo like Co co Puffs, BUT NOT legally Insane..Knew his actions were wrong..... Course Defence will try to prove otherwise...Don't know if they can pull that off..unless they can pull of some sort of "Jury Nullification" job

I think defence is trying to drag things out until lunch time...what say you all?

  • #171
aye, yi, yi ... for a profession expert witness, he should know what he's doing on the stand. Wonder why he had to blurt it out so early?

I'm glad the prosecution pointed that out... about this witness usually being hired by defence lawyers. Hopefully it will mean the jury won't listen when the defence try to discount what he says.

The defense has no objections to Dr as an expert. #Theatershooting. Now Dr is qualified and jumps again to say def know right from wrong

Expect the case to become much more contentious now that we are getting to the part of the case the defense disagrees with. #theatershooting

You may believe all of an expert's testimony, some of it or none of it, the judge tells #theatershooting jurors. Reid admitted as expert.

Dr. Reid now expert psychiatry/forensic psychiatry witness. Testimony on #theatershooting mental eval upcoming -> http://link.kdvr.com/1J4JTcT

This is important because even though all the doctors who testify will help the jury decide things, the jury will also consider other things like JH own's actions like his planning and preparations.

The doctors are going to be important for the jury but I dont think it will be all they use to help them make the determination they need to make.

I think my biggest fear for this trial is a hung jury. It may be hard for all jurors to agree on things.

Does anyone know if there are any special rules if the jury hangs in this case?

Like will the prosecution have to try it all over again OR is there some default with this case?

I can really see the potential for a hung jury in this case.

the only thing I can think of that would be a problem is penalty phase.....

I don't think so Miss Haley..as it's not something that isn't part of his testimony..but maybe it wasn't needed just yet..but given the leading up question talking about
In accordance with Colorado Law blah blah blah..kinda led to that answer IMO.
