I don't like that time limit for the viewing and access to the DVR player. If they want to view 7 or ??? exhibits, they may want to play one and then discuss for a time... and THEN watch another. HEY Mr. Prosecutor... please please object to that time limit on the player!

ETA: For those coming in late... and not following real time.. :moo: the judge is saying that they can have the player for xxxx amount of time... So back to back viewing is the time that the judge has given for the player in the juror room...

For me... I would, as a juror, would want to see one... Discuss for a while... and when ready move to the next.. Vs. what I'm understanding (perhaps incorrectly) that the player given to the jury would ONLY be given for a time that ONLY allows back to back viewing of all they are asking for.

GAAAAAAAAAAAAAWD I could never be on this case as I would :pullhair: if I was the one who wanted such and then discuss, and then only given a bunch one after another......

I cannot hear a thing....hubby broke a glass and it shattered all over the kitchen....now he is cleaning it up....so glad you are all posting so I can at least read. Must find ear piece for computer for tomorrow!

I remember the shooter asking if any kids were hurt. That means he didn't plan on killing them. Surely that disproves that particular aggravating factor?

ETA that doesn't work actually. He saw them in the lobby. He also would have seen that little baby sitting near him in the theatre

I think you answered your own question Maisie..Of course he was well aware there was a whole bunch of kids there..as there was a baby in the same row as him prior to him using phone call as excuse to exit to put on his protective gear..including gas mask...which that alone indicates purpose of disorienting and causing physical fears to victims inside that theatre...

Lets face it..Jury has already deemed him NOT INSANE..(even tho obviously MI)..But planned and implemented his mission irregardless of actual population of the theatre..BUT he was able to visualize those kids there PRIOR to even exiting to dress up/arm himself ( also prepared to kill person who walked by dumpster next to his car)..His mission to annilialate human's to gather points ( souls) to add to his worth ....

Bailiff should NOT be in same room when viewing video's!!!!! Judge is on firm grounds there!!

Well, they only have an hour & half left. So until they decide on what & how the jury will get the exhibits & then view them-the day will be over.

No, I did not say a word, he was so mad at himself for breaking the glass. I just fed the puppers, took them outside and we are in the other room as he cleans.

Does it mean they accept he WAS qualified to receive the DP?

I think that is prolly part of it -- a minor is not subject to the DP, for instance -- JH is not a minor. I also think that the case itself qualified as a DP-level case. IANAL. JMO.

Yes, basically the defense seems to be conceding that the Prosecution proved the aggravators (mutliple deaths, child under 12 died, there was grave risk to the others who didn't die, his hack was heinous, cruel, torturous, etc, and he was lying in wait or ambush. I think it's obvious they are rolling their dice on the mitigation side, where they'll discuss the mental illness.

I expect no DP in this case. I expect the jury will find mitigation in his mental illness, and he'll get LWOP.

I'm thinking that is possible as well. The only good thing that would come along with LWOP is less chances for appeal, and maybe this fiend can just slide into the shadows of some prison somewhere, and we'll never hear his name again.

As it should be..gone are those days the the little women cleans up the mess/hazards the male makes....LOL..But know most women..especially with kids or fur babies around..you will make sure all hazardous material is GONE!! LOL

They may not need to watch everything. If their question is answered by one, they may stop there. That's what I/we did when I was on jury duty. I would like to review that one where he was talking about kids. He knew there were kids there, he shot that little girl 4 times.
