Technically a felon is someone who has been convicted of a felony. While it is likely that the girl had committed the felony of car theft, she was not convicted, due to being shot dead rather than taken alive.

If someone is fleeing in a stolen car, they are committing a couple of felonies, right before the officers eyes. Thus technically, they can be seen by them as felons.

Fwiw - I think JH put the car in drive and had her foot on the gas before the car engaged from park to drive. I think JH was shot as soon as she was seen putting the car in drive. Since gas pedal had already been pressed, it shot forward. But JH had no control over the forward movement. Jmo.

Have you seen the crime scene photos? There was a very tiny area available for her to manuveur through. And she took off fast, IN HIS DIRECTION. If she continued in that same way she would have hit him. And IN FACT she did hit him.

If she took off FAST, then how did the LEO's WALK up to the window to shoot her?

But the witness, who you seem to believe, did not say that. She said she was trying to drive away. Not drive directly into the LEO.

I believe that Jessica did try to drive away. What caused her to get shot was that there was a cop standing in the direction that she was driving. JMO.

They are suspects when they are sitting in the stolen car. They become felons, by choice, when they ignore commands to step out of the stolen car, and they drive away. :wink:

In my opinion, :cow: , the cops walked up, said PLEASE STEP OUT---and she quickly gassed the car to flee as they opened fire. A cop standing alongside could get off three shots very quickly, imo.

Talk about splitting hairs. :wink: So does that mean she was not trying to flee?

Seems to me if she put her foot on the gas and shifted to DRIVE she was fleeing the scene.

That sounds like a reasonable scenario to me. At that distance it wouldn't be that hard to track a moving target and get some hits. Fits with the facts as we know them. JMO.

Pretty sure it standard operating procedure for a LEO to NOT stand in front of a car that is "pulled over"

Again, multiple side on shots landed on the driver of a moving car. I ain't buying it.

Of course. But the cops are the ones that testify to the crimes. if they tell the driver of a stolen car TO STOP and that driver flees in the stolen car, the cop is witnessing a FELONY. And thus, they can determine that the driver is a fleeing felon. Cops do not have to wait for the trial to put the 'fleeing felon' response into effect.

Three shots. that takes about 1/4 of a second to shoot. Have you ever been to the target range and seen how accurate working cops are?

I agree she was trying to flee - have all along. It's no reason for LE to shoot. Not yet anyway.

I think he was arriving as backup and came on the scence from the wrong direction. A mistake for sure but not one that makes him responsible for Jessica trying to run him over. JMO.
