CO - Jessica Hernandez, 17, killed by police after LEO struck by stolen car

  • #221
If my teen girl had stolen a car, AGAIN, and was driving it around on her suspended license, and tried to run from the cops when they caught up to her---I would not be blaming the cops, I would be blaming myself. Why was she even out driving around after just being released for a previous stolen car and losing her driving privileges? Mine would have been IN OUR HOUSE, no excuses given.

The parents could not control her erratic behavior, but now they plan to sue the city government for millions, because the cops couldn't control her either.

Although that may be what eventually happens, I think you are jumping to conclusions a little bit here . If proper procedures were followed there will be nothing for the DPD to worry about. A young girl lost her life, there is nothing wrong with investigating why it happened.IMO

The attorney she hired is known for bringing huge lawsuits against Law Enforcement. I think we all know where this is heading.

City Reaches Settlement With 4 Women In Denver Diner Police Incident
The city of Denver on Monday approved a big payout to four women who were roughed up by police four years ago.

Imo, these are valid examples of lawsuit payouts against LE. Maybe it's just me though.

Maybe, maybe not. But I was using them as an example of what their new attorney does. Gets huge payouts.

That's not really true that there is nothing to worry about. You are looking at huge costs for the defense attorneys to fight the case. And probably huge costs for the upcoming protests which will be ongoing and expensive.

Bullets go in straight lines, if I'm not mistaken.

Fwiw, beginning to think this teen was given the opportunity to flee, took it and was shot - the chances that LE knew who was at the wheel are pretty good, since one of her friends lived in one of the houses accessible from the alley where the incident occurred and the drive was known to police. Another issue is, imo, there is no mention by LE or the witness in the car that a police vehicle was approaching from the front, blocking her path. Imo, the police vehicle in the pic shown parked in front of the car inside the police tape, arrived after the shooting - it's off to one side. Looks placed after the fact to me.

This is my opinion based on pics, what has been said and what has been retracted. Others of course can view the scene differently.

Yes, they do go in straight lines. If his leg is being run over and he shoots, the drivers window will be in a straight line.

Criminal responsibility and charges? Or civil negligence & tort issues?
AFAICT, hypo^ has no claim of LEO excessive use of force issue like Denver shooting, but we can start a thread on ^hypo elsewhere, if you'd like.

BTW, you posted some great pix, esp. wrecked car in alley, one w blue evidence marker. Anyone figure out what blue number was marking?

I wonder if it was a bullet casing?

What do you mean by "given the opportunity" to flee? Do you mean that the cops said " Go ahead, Go" and then they shot her?

If the officers leg was run over, he was on the ground. If he was pinned by the front of the vehicle against the fence, as has been reported, his leg would get hurt. When did he fire through the drivers window will be the question, imo.

I don't think the officers told the driver to go, or anything else. Would prefer to answer questions put to me myself - not have them answered for me. WS etiquette?

I was questioning the term " she was given the opportunity to flee." To me, that implies that someone purposely allowed her to drive off. I was not trying to answer it for you, just speculating about the meaning of the term.

I have never seen any reports that he was actually pinned by the front of the vehicle, against the fence. By the looks of the photo, he would likely be dead if that were the case. The car is smack fab against the fence.

I think it is more likely the cops leg was run over by a sideswipe, as it passed him by. And he shot at the same time, hitting the drivers window. JMO

Again, in this quote, she sounds like she doesn't want more investigation. Just charges. It's all done. Done deal. Just bring on the punishment.
Then she asks for a special investigation.
Can't have it both ways.

"How much do they need to investigate?” she asked during an interview with The Associated Press. “It’s all done. They did it. They killed her. All I want is justice.”

Coupled with the quotes from post 219 reprinted below, it's clear the mother blames the police and considers their actions to be criminal:

It's clear from this quote that the mother "blames" the cops for criminal wrong doing.

"Now we are going to start to mobilize because I don't want the death of my daughter to go without punishment," said Rosales in Spanish.

http://www.9news.com/story/news/local/2015/01/28/jessie-hernandez-shooting-criminal-record/22496651/

You don't want someone "punished" if you don't blame them for what happened.

This isn't exactly uncommon. It matters not how horrendous the crime, how plentiful the evidence, etc., MANY mothers of murderers, rapists, and other criminals have a blind spot where their kids are concerned. Laura Hernandez' daughter was more of a petty criminal type rather than a sociopathic murderer, so it's even easier for her discount the actions of her daughter and focus her anger on the police. Not really that surprising at all.

OMG! On July 7th!

Basically says most people would already be "shot up" if they did the things she does.
So basically, she knew that her behavior would get her killed. And her attitude with hating the police and not listening to them pretty much says it all.

She knew what she was doing.
Now we hear how sweet and wonderful she was and that she was just "executed" for no reason.

People! Read her OWN words that she tweeted!
Acid trips.
Drugs in the morning before school.
Getting her sister locked up for something that was her idea.
Guns
Girlfriend in prison
Court dates
Cheating on drug tests.

It's 10 times worse than I thought it was.

And she says in one tweet [ paraphrasing] " I will just %$^%$ things up until I die"

And with ALL of this going on, the parents are setting up a huge lawsuit to try and get millions from the city. They had ZERO control of their kid, but blame the cops when they had a confrontation.

IMO her toxicology report will be interesting to say the least.

Constantly tweeted about:
Acid
Molly
Weed
Alcohol

Morning midday and night.

And here we go with the character assassination of both the victim and the victims parents. Didn't take long at all.

Victim???
GMAB

I can promise you, I have followed hundreds of cases for many years. You will NEVER see me blame or bash a victim or their family.

This girl is only a victim of her own actions. She was a hardened criminal at 17 years of age. She was shot by a cop as she was trying to run him down with a stolen car.
She is not a victim.

There is no evidence that the teen that was shot intentionally aimed a moving vehicle at the officer that was hit.
