Kelsey Berreth's fiance due back in court
Patrick Frazee, 32, is expected for a hearing on pre-trial motions at 8:30 a.m. before Teller County District Judge Scott Sells.

Prosecutors are expected to ask the judge to grant them permission to conduct “consumptive testing” on an undisclosed item of evidence, meaning that the material is so small or fragile that it will be destroyed in the process.

The judge may also hear arguments over requests by media outlets to unseal investigative documents in the case, including search warrants.

Former detective explains possible search warrant tactics in Berreth case
On Dec. 6, with Kelsey Berreth’s family in Colorado looking for their missing loved one, Berreth’s brother found a spot of blood around the toilet inside her townhome.

“Investigators have recovered a number of items that make us suspicious that the crime did occur at Kelsey’s residence, and that’s why we have been coming back to her residence,” said Woodland Park Police Chief Miles De Young at a Dec. 21 press conference, announcing the arrest of Berreth’s fiancé Patrick Frazee.

It was missed by Woodland Park Police and the Colorado Bureau of Investigation in the days before. That had several people questioning how law enforcement could have missed a pivotal piece of evidence and what they look for in similar situations.

At the benefit of hindsight, News 5 sat down with John San Agustin, a former detective with the El Paso County Sheriff’s Office, to discuss how searches begin in missing person investigations.

Search warrants in the Kelsey Berreth murder investigation will be made public, a judge announced Monday.

More documents in Frazee case to be released later this week
While Sells allowed the release of 22 of the 28 warrants, he did not allow the exhibits displayed at the preliminary hearing to be made public. Both the prosecution and defense agreed that they did not want those released ahead of the trial.

In addition to those decisions, the state and defense agreed to move a decision about consumptive evidence testing until after Frazee’s arraignment.

Consumptive testing involves evidence that can only be tested one time, likely due to the size of the evidence or the material in question.

That piece of evidence remains unknown following Monday’s hearing.

Frazee’s arraignment is now scheduled for Friday, April 5 at 8:30 a.m., when he could enter a plea.

Kelsey Berreth murder case: Patrick Frazee wants wrongful death suit dismissed

Patrick Frazee, 32, filed a motion in Teller County District Court on Friday asking a judge to deny a claim by Berreth’s parents, Cheryl-Lee Ellen Berrethand Darrell Lynn Berreth, seeking custody of 1-year-old K.

The motion contests a second amended complaint by the Berreths seeking custody of their granddaughter. The first was made by Marcie McMinimee, a special conservator for K, the lawsuit filed by Colorado Springs attorney Jennifer Stock says.

Colorado’s wrongful death statute clearly states that the Berreths have no standing to make a legal claim based on the alleged wrongful death of Kelsey Berreth, the motion says.

“Only her living and surviving child, KF , has standing to bring a wrongful death claim,” it says. “In the original complaint, plaintiffs pled that the outrageous conduct of Mr. Frazee was the alleged killing and death of their daughter at his hands … But plaintiff’s attempt to save the claim fail and it must be dismissed.”

“Patrick Frazee is entitled to dismissal because Kelsey Berreth has a daughter, which, in fact, precludes Kelsey Berreth’s parents from bringing a wrongful death claim against him. And Colorado law does not permit more than one civil suit for the death of one person,” the motion says.

A Teller County judge has repeatedly determined that the Berreths should retain temporary custody of K.

Judge orders search warrants released in killing of Woodland Park mom
A judge ordered Monday the release of nearly two dozen search warrants issued in the case of a Florissant rancher accused of bludgeoning Woodland Park mother Kelsey Berreth and later burning her body.

Some of the 22 warrants to be made public this week detail records from Verizon, Google and Facebook — an electronic trail used by investigators to bolster first-degree murder charges against Berreth’s one-time fiance, Patrick Frazee.

In ruling that the warrants be released, 4th Judicial District Judge Scott Sells granted a motion filed by media outlets, arguing they were public records under the law.

The judge saw little potential to harm the investigation, saying much of their contents had been described in court at Frazee’s evidentiary hearing. The search documents detail why investigators believe they will find evidence of a crime and include reports on what was found.

The judge denied a similar motion, also filed by a media outlet, asking that exhibits from the preliminary hearing be made public.

That material included an audio file of Frazee’s interview with Woodland Park police after Berreth’s Nov. 22 disappearance, photos of a Fremont County barn where investigators say her body was temporarily stored, and a map of Frazee’s property, among other exhibits.

Sells raised concerns that the audio file could be edited and distributed, potentially affecting Frazee’s right to a fair trial. The judge noted that the photographs were not shown in open court but strictly shared with the judge.

Court releases search warrants in Kelsey Berreth investigation
The warrants include details of a law enforcement interview with Cheryl Berreth, Kelsey's mother. Cheryl told the interviewer Kelsey's daughter was born three weeks early and required extra medical care, which prevented Kelsey from having the girl in her hospital room.

Upon learning this, Frazee became so upset and verbally abusive with nursing staff that Social Services was notified, according to Cheryl. The girl was removed from her parents' care until investigators could determine if Frazee was physically abusing Kelsey.

Cheryl told the investigator that Frazee later said he should have "killed" the nurse that reported them. He joked about the incident again at the girl's first birthday, according to Cheryl.

Here’s the picture of the toilet in which the Berreths found traces of blood. A DNA profile matching #KelseyBerreth was obtained after testing the blood. This happened on December 6. Kelsey has now been missing since Nov 22. #Frazee is last known person to see her.

These search warrants are a lot but I’ll be tweeting out the most explosive details. Here’s an incident in which Social Services was notified of #PatrickFrazee. He was mad that the 1 year old daughter he shares with #KelseyBerreth wasn’t able to spend time with them after birth.

Search warrants in Patrick Frazee case released to the public
Among the new information found in the documents included a screenshot of a Facebook post that appears to be from an account belonging to Patrick Frazee’s mother that reads “YAY the witch is dead” along with a photo of a television playing the “Wizard of Oz.”

The post was dated Nov. 22 at 4:36 p.m., several hours after Kelsey Berreth was last seen at a Safeway store and on the afternoon that investigators said Berreth was killed in her townhome.

Woodland Park Police said they received the screenshot via Facebook message on Dec. 12, 2018. That was two days before a search of the Frazee property.

In addition to the screenshot of the Facebook post, there was also a photo of the blood on the toilet in Berreth’s townhome sent from Kelsey’s mother to investigators.

The documents detail searches of phone data, digital data, bank records and properties, We knew investigators searched two properties owned by the Frazee family in Florissant, Kelsey Berreth’s townhome in Woodland Park, and the cars of those involved in the case.

The request for electronic data asks for everything about and contained within Berreth, Kenney and Frazee’s phones, email accounts, and Facebook accounts, including GPS and tagged photo data.

There’s also warrants to check out the financial histories of Frazee and Berreth, likely to determine if anyone would benefit from criminal activity, or for any irregularities that would cause further scrutiny.

According to the notarized time stamps on the documents, the search warrants were granted between Dec.3 and Jan. 18.

Five teeth, potentially bloody sheet found in search of Patrick Frazee’s home, court records show – The Denver Post
On Dec. 15, authorities filed a search warrant executed on Frazee’s home, which listed 67 seized items. Police took possession of Frazee’s financial records, five pairs of his wrangler blue jeans, a Verizon tablet, his boots, a tan baseball cap and 50 9 mm bullets and two casings. They also wanted items that could provide DNA samples of the suspect and victim.

They also found “four teeth in a small envelope” and a fifth tooth held separately.

One of Berreth’s teeth became a gruesome point of discussion during a recent hearing involving Frazee’s alleged accomplice, Krystal Jean Kenney Lee, an Idaho nurse.

Lee told investigators that Frazee had her clean up “a mess” at Berreth’s townhome after he killed her, the affidavit says. Frazee specifically asked her to look for a tooth that may have fallen down an air vent. Lee found a tooth inside the apartment that included the full root.

But no mention was made about teeth Frazee may have found on the floor after allegedly cracking Berreth in the head repeatedly with a bat. Berreth’s blood was later discovered on walls, in the cracks of floorboards, on a toilet, a mantle and the kitchen refrigerator.

The same warrant also included a request to swab the interior of a washing machine. Authorities wanted to know if they could find Berreth’s blood in the washing machine, the search warrant says.

Chilling post shared by killer fiance Patrick Frazee's mother after Kelsey Berreth murder | Daily Mail Online
The mother of Patrick Frazee posted a chilling message on Facebook just few hours after her son is believed to have murdered his fiancee Kelsey Berreth.

DailyMail.com has obtained the search warrants from the case, which reveal that a tip came in on December 12 in regard to a post shared by Sheila Frazee.

That post, which went up at 4:36pm on November 22, featured a photo of Glinda the Good Witch from the Wizard of Oz, and read: 'YAY the witch is dead.'

It would have been posted at the same time that Frazee arrived home at his mother's house after he allegedly murdered Kelsey by covering her eyes and bashing her head with a baseball bat.

This post could explain why police took Sheila into custody when they arrested her son back on December 21.

She was released soon after and no charges have been filed against her at this time.

There is also no mention that Sheila was involved or knew about a plot to murder Kelsey in the deposition and testimony provided by Krystal Jean Kenney, her son's mistress.
