Patrick Frazee reported Kelsey Berreth to child services because she was harming their toddler daughter, new documents could show.

The alleged killer, 32, is said to have confided in his mistress Krystal Jean Lee Kenney, telling her that his fiancee abused one-year-old Kaylee.

Kenney testified that murder suspect Frazee had told her Kelsey, 29, hurt their daughter, leaving her with a burn on her hand and a bump on her head.

According to recently filed court documents, records from the Department of Human Services include statements made by Frazee to social workers.

Frazee, who is being charged with five counts of murder, made the accusations against Berreth, to child welfare workers, which corroborate the testimony that has been given by his alleged mistress Krystal Lee Kenney, The Denver Post reported.

Kenney pleaded guilty to the felony and recalled that Frazee had wanted to “get rid” of Berreth so she couldn’t injure or kill Kaylee. Agent testimony revealed that Frazee told them that Kaylee had a burn on her hand and a bump on her head, according to the news outlet.

It is not known if Frazee made the report to the Department of Human Services before or after Berreth’s disappearance.

Accused murderer of local mom in court for custody hearing
Thurday's hearing will be about what should happen to the couple's young daughter. A judge previously granted temporary custody to Berreth's parents, but a family member of Frazee is fighting for custody of the girl.

  • In her motion, filed last month but only released to the public this week, DDA Elizabeth Reed claims the records contain 'exculpatory information'

Child to remain in custody of Berreth’s parents until next hearing
Patrick Frazee and Kelsey Berreth’s daughter will remain in the custody of Berreth’s parents for now, a judge decided Thursday.

Court spokesperson Rob McCallum tweeted the next custody hearing is set for June 13, meaning the judge’s decision to keep the child in the custody of Cheryl and Darrell Berreth was not permanent.

Patrick Frazee appeared in court for the hearing at the Teller County courthouse in Cripple Creek. Berreth’s parents, Frazee, Frazee’s mother and Frazee’s sister also attended the hearing.

Members of the media were kicked out of the hearing at the beginning to protect the privacy of the child.

Frazee to enter plea Friday; landfill search ongoing
The future of the state’s murder case against Patrick Frazee will take a pivotal step forward Friday.

Frazee, 32, is set to appear in a Teller County courtroom for an arraignment hearing at 8:30 a.m., where he will enter a plea.

Judge Scott Sells will also likely rule on a pair of motions related to the release of information in the case. First, a motion brought by ABC News to release all exhibits entered during the Feb. 19 preliminary hearing.

The exhibits, which were submitted as evidence, include screenshots of surveillance video used to piece together Frazee’s whereabouts the day of the alleged crime. They also involved site visits, where Krystal Kenney led investigators to corroborate her story about Frazee’s actions in the crime.

Next, prosecutors filed a motion on March 20 to seal records they obtained from the Teller County Department of Human Services as part of their investigation into Frazee.

The 29-year-old’s body has not been found. Law enforcement has spent weeks searching the Midway Landfill in Fountain for evidence related to Berreth’s disappearance, but it’s unclear if this has yielded any results.

Investigators are about 35-40% through the search, according to the Woodland Park Police Department.

"There are only three things that could happen during the arraignment [Friday]," said 9NEWS Legal Analyst Scott Robinson.

"No. 1, you plead not guilty and set it for trial," he said. "No. 2, you plead guilty and you either have immediate sentencing, which would be life without parole, or you set off for a different sentencing date. Or [third], the case could be continued. Either side can always ask to continue an arraignment."
