Quick question. If this were to become a Federal case, at what time would that motion come forward and is it something that is done frequently or infrequently?
It depends on what offenses a defendant has actually committed and usually which offense is the greater crime or at times the case with the best evidence or ease of proof or even which state or agency has jurisdiction. It can be a combination of decisions but it depends on which district the crime was committed and which body has jurisdiction state or federal to which type of crime was committed usually federal offenses may be given precedence.
