So, assuming he's telling the truth, he could have called for an ambulance for all of them, including Shanann and Nico, and possibly had to face manslaughter charges, and had a good chance of walking free. But instead he's virtually guaranteed a minimum of 12 years, a likely life sentence, and possible death penalty?

Instead of thinking about where to hide the bodies, maybe he should have just called 911, there would have been less to lose and the medics might have even got there in time to save his children's lives.

ETA hadn't he ever heard of people getting off on manslaughter charges if it was done to potentially save the life of another individual?

Did he actually sit or stand and weigh up the risks of calling 911 to try to save the children vs going on trial for manslaughter vs getting caught hiding the bodies? And all the time the seconds are ticking down for the chance of reviving his daughters?

And this is exactly the point that makes no sense to any of us. Just call 911 dude! That's why I believe he really really hated Shanann. He wanted her dead and the kids were ancillary to that.

Yes it is. How a person acts is evidence. What the weight that's given is up to the jury.

In the family annihilator case of Michael Blagg his demeanor took center stage.

It is absolutely evidence. Which is why testimony is allowed and argument may be made about a defendant's demeanor.

Exactly. That's why we use them in jury instructions! Side note and OT...Blagg's daughter's case (Abby) was one of my long term cases at NCMEC. His demeanor 100% helped convict him, thank God.

If this case goes to trial - can CW present the SW strangled Bella and Cece scenario *WITHOUT* taking the stand? If he takes the stand, is he then subject to a cross examination for every lie and contradiction he told after he confessed to murdering SW?

I suppose so, but honestly IMO it would be as subjective as playing the SM videos I find so alarming & some others don’t.

How? The SM videos have nothing to do with the crimes, whereas the media interviews are directly related.

Protected health records of the victim could be subpoenaed by the state and thus an exemption from HIPAA. It's that simple. If the court finds her records are relevant to the murder case they would be disclosed. His would be as well:

Does this mean the Defense has requested the reports to be sealed or the prosecution?

The state did. The defense stated they hadn't seen the report so could not respond with an agreement or an objection.

That isn't to suggest that they didn't have the same cell phone provider between them but that maybe it was separate un-linked accounts for tax/business purposes.

I don’t understand the relevance, as there is no indication that LE did anything improperly here.

MassGuy The original discussion was about whether LE had legal authority to search SW cell phone because CW give LE her cell phone before his arrest.
Then the discussion evolved from there to whether CW and SW had a joint cell phone plan that was linked as in a household family cell phone plan which would thereby hypothetically authorize CW to allow the LE access to SW cell phone without a search warrant.
I was simply offering a scenario whereby SW may have had an independent cell phone plan separate from CW, for business and or tax deduction purposes.
In no way did I intend to infer that LE did anything improper.
