Would it have been better to blame the judge’s ruling on expert testimony, rather than being close to finding Suzanne, in the request? I am worried about a future trial if they don’t find Suzanne.

That was also listed in the motion to dismiss --

"Second, when this case was filed it was mainly premised on the Defendant’s motive to
harm the victim, his sole access to the victim at the exact time she was last communicating with
anyone by phone, and his consistent dishonesty with law enforcement, which came to light given
the truck telematics, phone, and location data recovered. The Court functionally excluded the
People’s best evidence to move forward in this case by severely limiting our expert’s testimony.
Even if the Court were to partially reconsider its position on the need for such severe sanctions at
this late hour, the People would still be left without several key expert witnesses initially
endorsed."

to dismiss, prosecutors write “law-enforcement believe we are close to discovering the victim’s body”. Searches are focusing on a “remote and mountainous region near the Morphew residence”. They say area where they “believe Ms. Morphew is located” is under 5ft of snow

Anyone have an idea where this could be? 5 feet of snow seems like a lot even for a place that gets a lot of snow. Where is there a location closer to the house that would still have that much snow on the ground? I wonder if that is a location that would have been searched when Andy did the search? Must be really high in elevation and if it's a more dangerous terrain, then maybe not a place a regular search team would have went?

Incredible. Just gutted by this. He's getting away with murder. Even if they charge him again it's gonna be how many years before it can go to trial??? The prosecution are clowns and they blew this.
This is an all or nothing proposition. If Suzanne's remains are in fact located and identified, Barry will be held without bond until trial....imo. The case to be presented is quantum leaps better than the current one. So....there is no down-side if SM is found. Barry will be sweating bullets if they are dialed in to the located...he will be forced to react, one way or another...fight or flight. He won't win either option. OTOH....if Suzanne is not located and identified at the earliest possible opportunity....retrial becomes less and less viable.

Morphew's daughters, who have supported him, both addressed the court today. "We fully support this dismissal," Mallory Morphew said. "We know our dad didn't have anything to do with it."

They had plenty of evidence without the body, but they failed at presenting the case. Grusing failed with 30 hours of one on one time with Barry Morphew. allowing him to create the narrative. Suzanne Morphew, missing after not returning from bike ride! MOO

Barry knows where her body is. His body language reaction to this will mean a lot.
If he is grinning and happy, he knows LE is bluffing or just wrong. I know his daughters and lawyers were smiling and laughing. What about Barry?

That narrative was created on day 1 by Barry for media.

Grusing didn't become involved until months later.

Scott Reisch is livestreaming now and saying in his experience dismissals like this are not very lengthy and usually involve the State saying they dont think they can meet their burden to prove this case beyond a reasonable doubt - he then explains how her Motion was 10 pages and very lengthy. He also points out Suzanne's sister agreed with this Motion, as DA Stanley stated in the filing.

he also says that "dismissal without prejudice" is more a "civil" thing and not really "a thing" in criminal side of things. (Though, I will add, he also just stated that he doesn't know the outcome of this and if the Defense was fighting this Motion and demanding to proceed to trial)

Nevertheless he says DA Stanley screwed all of this up "big time"
