Even if LE doesn’t recover Suzanne’s remains during these warm weather months, do you think the DA will re-file the charges against Barry any way?

I do not like this defense attorney at all.
The prosecution has definitely not presented a stellar case, but she is making a lot of false accusations here.
She’s back to harping on the CODDIS hit.
She is making it sound as if LE never followed up on whether SM might have left the country, which is a lie.
She is stating that LE never followed up on any leads, which is a lie.
She is basically blaming LS for the reason people think BM is guilty.
If the family is grieving so badly, why are they skipping and laughing into court each day?
Truthfully, I couldn’t watch the whole thing.
The reason IE is out there screaming like a banshee is because she’s ticked she’s losing out on all those billable hours during the trial. In actuality she should be happy that she gets to do this whole dance again when they rearrest BM for First Degree Murder.

Methinks Iris is simply planning (plotting) ahead.

He can dig a hole for himself, as deep as the one he buried his wife in, by running his mouth full of lies and contradictions during a series of friendly conversations with an exceedingly talented investigator. Sometimes, when someone is pressed, they just clam up and that’s the end of it.

Yes, the defense filed both of those motions. And they were successful in both. The venue was changed to a different county in the same district and the original judge recused himself due to a conflict of interest relating to the law firm retained by Barry's new girlfriend.

According to an article in the Denver Gazette today, BM committed the fraud of casting SM's vote and the illegal act of mailing it.

Barry Morphew is a free man; upcoming trial dismissed by prosecution
Still pending is a voter fraud case against him in Chaffee County that carries a felony count of forgery.

Morphew is accused of illegally mailing a ballot cast for Donald Trump in Suzanne’s name the November 2020 election. Barry Morphew had not signed the ballot in his wife’s name, but there was a signature on the witness line, according to the Chaffee County clerk. Morphew told investigators “I just thought, give him another vote. She would have voted for him anyway.”

She (IE) did herself no favors. She has seen more of the evidence than we have and she knows he is guilty. I believe she was speaking to potential future jurors when he gets re-arrested. She’s wanting someone to believe what she’s spouting.

I agree. I think she came off very poorly.

But there's still that illegal weapons charge (and the voter fraud case). I am optimistic that he's not heading out hunting with guns this morning.

Dismissal - of course. The DA’s case was weak and they repeatedly blew deadlines and withheld information. They shot themselves in the foot.

Unless they come up with brand new evidence that can prove beyond a reasonable doubt Barry did it, they can’t refile. Considering this office’s poor performance, I’m not holding my breath on new admissible evidence coming to light.

That’s it.
Not so, IMO. I agree that the DA's failed leadership and many mis-steps led to the judge's decision to exclude key evidence, but with that evidence admitted a jury could easily have convicted BM.

This voluntary dismissal is only the beginning of a renewed investigation, from which BM will never be free. And the problems with the case were never the result of flaws in the investigation, which was very well done. The problems are all on the DA.

Apologies if this line of thinking has already been posted. LE thinks they are close to finding the body but it’s buried under 5ft of snow.

So a potential body is under 5ft of snow on April 19, 2022.

SM was murdered May 12th (or 11th) 2020.

So wouldn’t it stand to reason that in May 2020 this same location would be under a substantial amount of snow?

Maybe. Maybe not. It was a warm week, comparatively speaking, before Suzanne disappeared. I checked the water flow in the South Arkansas River a day after the case broke in the news - it was pretty high, melt-off had started.

It all depends on the winter and I don't have time today to go research the historical records from those periods of time (which are stored, for one place on wunderground.com

There are plenty of ravines they didn't search at first, as well.

What good is a sawed off shotgun without fierce enemy chipmunks to fight?

If he is pursuing his next kill, he's in more danger than the potential trophy heads!

THAT seems a losing proposition. I guess they didn't like that she didn't accept and run with reporting on their documents pre-filing as other more defense-cooperative reporters did, but instead waited until any motions or responses were formalized with actual, well... filing.

LS was professional throughout and has done nothing wrong.

Can I just say that, should I learn that BM reverts to form and skunks his attorneys on any currently outstanding bills, I probably would not be able to resist enjoying it. And he is likely foolish enough to do it.

Criminal defendants pay in advance. I've never seen an exception. I've seen people deed their homes over to criminal attorneys, but I've never see a criminal attorney who didn't work off funds deposited in the retainer account (and it's usually ironclad language in the retainer agreement, for obvious reasons).
