My apologies it was the 4th judicial District Attorney's Office who is helping the 11th Judicial District (Chaffee County) redo the discovery. The 4th Judicial DA office covers Teller and El Paso Counties in Colorado.

Unless they have permission of the property owner.

Let me ask this better: does LE need a warrant to set up a trail cam on private property (with the property owner's permission) in order to surveille someone else?

The court is having technical difficulties getting former 11th Judicial Deputy DA Jeff Lindsey on WebEx. Eytan is still at the podium about to ask him questions. Lindsey sounds like he is underwater in the speakers.

Rocky MT RCFL = Rocky Mountain Regional Computer Forensics Lab?

DA Lindsey will call back at 3:30 p.m. Ms. Megan Duge will talk about the CODIS DNA issue. She takes the stand now. Eytan is asking her questions now. She is an agent with the CBI.

I can't imagine they'd need a warrant for that, and I can't imagine they could get a warrant for that at this stage.

So permission or nothing I'd assume.

Agent Duge is a technical reviewer for a coworker. She takes notes when she speaks with law enforcement to keep a record of information related to the case. It is a communication log. Duge says it is to keep track of the information/conversations we've had.

Rocky Mt RCFL is the FBI’s Regional Computer Forensics Laboratory for that area. They are scattered around the country. That is likely where a majority of cell data, gps, computer data, etc were analyzed in this case.

Iris Eytan is now showing a list of DISCOVERY STILL NOT PRODUCED: reports/statements between DA and LE, opinions of experts regarding DNA matches, emails/text messages, DA/LE interviews with lay witnesses that is exculpatory, HP laptop...

Whose fault is it that there's a shortage of exculpatory material? Is the Prosecution supposed to invent it?

Even this CODIS stuff -- is there any evidence that the person who left DNA on Suzanne's glove box commit any part of the events of MDW? Hard no.

That person would probably be shocked, however, to learn that he's related in some small way to a person who commit some awful crimes in another state. No worries, they've likely never met and don't exchange Christmas cards.

This all just feels like a whole lotta noise. Almost like staging. Not even for the benefit of the court or the interest of justice, but more for the theater of his inner circle.

The exhibit entered into the court is the communication log. Eytan is asking about the first log Agent Duge made on August 11, 2021. She was subpoenaed on Aug. 9 to testify in the preliminary hearing, however, she did not.

Was the camera(s) set up on BM's property or on the road leading up to it in the subdivision? I'm not sure.

On Aug. 11 the conversation was with DDA Mark Hurlbert about the CODIS keyboard search from the DNA swabbed from #SuzanneMorphew glovebox. "We discussed the difference between the keyboard search and the CODIS search." Duge is being asked about details discussed.

You can set up surveillance on private property with permission. It depends on whether you intend to surveil pubic or private property and the various laws of each state as to what needs a warrant.

On Sept. 2: Katelyn Rodgers wrote this comm. log about their work together. Meeting will follow about what DNA has been tested and what hasn't. CODIS Keyboard search included 3 sex-offenders, invest. will see if they were in Colorado at the time of #SuzanneMorphew disappearance.
