Still Missing CO - Suzanne Morphew, 49, Chaffee Co, 10 May 2020 *arrest* #89

The black container below was a tree pot. Hence the interest in trees. Did Barry plant a tree on top of her in a auger hole? While I see the auger as a valid theory, it's too much work for Barry and we know his movements for the proceeding two days so he would have had to prepare a site before the 8th. I'm not 100% on the dates, but I'm reasonably certain that LE pulled data from Barry's phone as far back as November. Barry is the king of airplane mode, but I don't know when he would have had the opportunity to go dig a hole in some remote location between the 6th and the 9th.

At 12:38 PM, Barry placed bags, a black container and clothing from his truck beside the curb near the hotel lobby (see photos below). He then walked to his truck, appeared to pick up a small item from inside, picked up the trash bag, coat and container and walked towards the dumpsters at the end of the lot.

But what if he dug a hole way before that. I think this was a plan from a long time ago. Suzanne's daughters being out of town gave him the opportunity to carry it out, hence the hasty ill-planned alibi. Possibly.

From the AA:
On May 10, 2020, from 3:25AM to 3:48AM, the Ford F-350 registered 0 mph with GPS at Morphew residence as the doors opened and closed multiple times. SA Hoyland noted over eighty (80) events involving the F350 during this timeframe. (pg 35)

It seems they are saying the last cell phone ping is ~3 miles west of Puma Path, unless you found another cell phone tower 3 miles west of the one registered with the FCC (near 285 and 50 intersection). Puma Path residence is ~8.5 miles from cell phone tower as the crow flies.

Let me rephrase, the FBI believes the phone was on or very near the PP property when it last pinged. Mostly because Barry's phone doesn't go back into airplane mode for another 10 minutes.

Sergeant Mullenax asked dispatch to ping the number given for Suzanne’s cell phone. Dispatch informed Mullenax that the cell phone appeared to be off and last known activity was at 4:23AM on the present date, with a general location about 11.5 miles west of a cell tower in Poncha Springs, CO.

He was there an awful long time. Many truck events as I recall.

If he had another phone, perhaps he was on it.

Maybe he was listening to a favorite true crime podcast.

He had to know Suzanne's phone was a HUGE problem.

Auto Insurance Required Monitoring Device?
.... Wondering now if either MM1 or MM2 had similar devices in their vehicles and would the insurance required computer answer the questions of if another RR was used to dispose of anything that weekend. Good thoughts! Thanks!

Good point about possibility of fam.'s auto insurance policy/coverage requiring a monitoring device on the other fam. vehicles. Iirc, they had 2 Range Rovers, one that SM drove, and another RR that one of the dau's drove. Which dau? Was there a 4th vehicle for the other dau?Anyone?

Just one thing that makes zero sense and makes me question the accuracy of what is in these reports. If the report was the door opened and closed a couple times in the middle of the night it would be easier to nod and say “sure makes sense.” But a door opening or closing once a minute for over an hour straight makes me go hmmmm. The data will be the most interesting part of the trial and so much of the leap to probability relies on it.
It doesn't say door events, just events.
Dome lights, headlights, locking unlocking, seat adjustments, back door etc.
It all adds up.
Murderers are famously manic during their attempt to clean up evidence.

Exactly. The argument being made is basically: "there are too many events, therefore it's wrong and there are no events."

One event is one too many, and Barry's phone corroborates this.

When Agents tell Barry they don’t have her phone, he says, “Nobody found her phone?” and then, “I figured you guys had to have it.” He then says, “See, that’s, that’s, that’s really weird, because I thought from day one you guys had the phone.”

When Barry was asked where he would look for the phone knowing where the bike and the helmet were, he said, “In between.”

SA Grusing said the last item was Barry’s texting to Suzanne from July to October 2020, and he was asked why he was texting her.

Barry said, “Ah, it was just an outlet for me to try to deal with my pain.”

Barry was asked if he was actually texting her message content and he said, “I texted if she could see it, I was texting as she was, as if she could read it. And I knew deep down in my heart that she probably wasn’t reading them, but it just kinda gave me comfort that I was talking to her.”

SA Grusing said the FBI would search with law enforcement for the phone, and for Suzanne, asking Barry where he thinks we should concentrate.

Barry replied, “I would say the river. I mean, that makes more sense to me than anything. I don’t

understand why somebody hasn’t been out there, before now. When the river was low, I mean, heck, they spend a hundred and forty grand to dig up a job site that there’s no way she was at.”

SA Grusing said the issue investigators have with the river is Suzanne’s helmet being placed away from the bike, placed as possibly a diversion, indicative of foul play. Barry said, “Yeah, yeah.” (pg 111)

I go back and forth with her phone. Some days, I think Barry tossed her phone out of the window somewhere along US 50. Other days I wonder if he went all the way to Garfield to pitch her phone after he tampered with it. He seems kind of disappointed that they don't have the phone.

Barry was shown a picture of the locations around the Morphew house of Suzanne’s phone activity at 4:10 AM and 4:15 AM on May 10, 2020. He said, “Well, if she did that, I have no idea that it went anywhere but the house, but if you was to ask me, I’d say, ‘It was at the house the whole time.”‘ (AA page 72 of 129)

I don't think he took the Bobcat off the trailer until after 3 am. Cadaverine needed time to build up... and that could be as much as 12 hours.

His boots went into the hotel.

I think Barry probably stripped down in the driveway, boots and all, and those clothes later met a dumpster in Broomfield.

MM1's F-250 was either with the girls or parked in Gunnison. I don't think we know for sure, the AA does not list is as seized for forensics. Barry's truck was seized as soon as his first interview concluded.

(Range Rovers Seized)
On May 16, 2020, CCSO seized the two Range Rovers located in the garage at the Morphew’s residence. The vehicles were towed and taken to the CCSO secure impound facility to secure them for further evidence processing.

On May 20, 2020, your affiant spoke with FBI Special Agent Dave Donati regarding the 2007 Range Rover and the 2015 Range Rover Telematics. SA Donati explained the 2007 Range Rover would not contain Telematic information but the 2015 may contain this data. On April 29, 2021, SA Grusing advised that the results of the examination by the FBI’s technology division for the 2015 Range Rover have not been completed. (AA)

This is what I am getting into, and I think this evidence at trial will be vastly more detailed with expert witnesses.

Based on the thin info we have, it seems BM leaves PP at 3.58 but the SMs phone won't go dark for another 25 mins. So that would tend to imply he had it with him as we don't seem to have a suggestion that he went back. Or did he?

If I am the defence it seems one of my best arguments based on the AA is that according to the prosecution, BM had left and driven west, yet the phone switched off at or close to PP - so it must have been SM or "the real killer" who turned it off.

Mostly because Barry's phone doesn't go back into airplane mode for another 10 minutes.

what do you mean by this?

Personally I think he is lying about all this. I think he took the phone with him on the bike run, eventually turns it off, and its in a dumpster.

What I am not sure about it is how to explain the last phone ping when it shakes hands and leaves the network.

Where was BM when he did this? As presumably he already had left PP at 3.58

Since there is speculation in the absence of information….Someone could have come in and grabbed the phone, helmet and items missed and done cleanup after Barry left. All we have is what prosecution selectively picked to include in the arrest warrant and their less than stellar preliminary. Enough but chosen to put forth their argument. People are still trying to put it together in their own heads and make it all work. And it is very interesting but virtually as of now quite abit is unsubstantiated. Someone asked about MM1 vehicle she had at college. I think it was BM’s old truck she was using but she wasn’t home before the days in question so I doubt they processed her vehicle.

23 minutes. There were several events, not all pertaining to doors open and shut.
