I don't think we know....in the preliminary the implication was it was not important....could be anyone...etc. etc so everyone ran with the theory that it wasn't enough to match or it was some 3rd cousin twice removed from someone that perhaps worked at Jiffy Lube. But I'm kinda over the speculation about DNA matches. They had a name that's all I care about so did they investigate the information is all I care about :-) and was the result of that investigate that it could be excluded from consideration by a jury as a potential culpable person. It's a legal problem that they didn't disclose the information in a timely manner.

Defense questions Walker about the information of the unknown male DNA profile. He says that information would be favourable to the defense.
He says he didn't understand that he was supposed to produce this information for prosecutors to give to the defense

Walker says he didn't understand from the order that he was supposed to provide the prosecution with this information. They are discussing emails he sent to 6-7 investigators that were favorable to the defense.

Defense argues that Walker was the one who sent out this order about saving information and emails from investigators that could be material to prosecutor or favourable to defense,.

Defense asks if he preserved any emails - he says he didn't do anything to save emails from them

Walker says he did nothing to preserve the emails from the DA account. Eytan asks if he has been asked to locate the emails from the DA's Office... "No." This is the order he sent out to multiple LE agencies on June 4th.

I got to say, I don't like the sound of any of this. It sounds like there were too many chefs in the kitchen and one group has no clue what the other is doing on the investigation side. That's why the AA was so long and rambling. I hate it but this is not looking good right now.

Eytan says had it not been for the communication log or the email about the meeting discussing CODIS the defense counsel might not have known about it.Walker doesn't know if anyone took notes. The unknown CODIS match is favorable to the defense & Walker agrees to this statement.

Defense says she didn't have any communication from the meeting about the DNA match so the only reason the meeting was real was because there was an email about it-- other than that no one took notes during that meeting . #BarryMorphew

Walker says he doesn't have any notes on the unknown profile. He says he was in a lot of meetings. Eytan asks if he selected a particular email to not share with the defense. Aug. 2nd email was about a meeting to talk about CODIS just a few days before prelim.

Judge Lama explains he's standing b/c he has a bad hip. He's asking Walker to clarify when the People brought up the CODIS match of the unknown male in the prelim. It wasn't until after the defense had Agent Cahill testify but there's a letter about it before the prelim.

Commander Walker says he only knew about the Tempe one in May. In his 15 years in LE, this is the first case involving a CODIS match. Eytan says there are different foreign male DNA on multiple pieces of evidence in this case. To this day, still trying to figure out who it is.
