A Colorado Bureau of Investigation agent who testified in the murder case against Chaffee County’s Barry Morphew resigned from the agency last month amid an internal affairs investigation, according to a letter obtained by The Denver Post.

Former Agent Joseph Cahill resigned Dec. 8, two days before an internal affairs report was issued about an “accidental discharge” of his personal gun in his home while he was off duty, according to the so-called “Brady letter,” named after a U.S. Supreme Court decision that requires officer credibility issues be disclosed during the court process.

“Pursuant to our responsibilities under Brady v. Maryland, I am writing to inform you that there may be information contained in (a) Colorado Bureau of Investigation internal affairs report… that may impact the credibility of Joseph Cahill,” CBI Director John Camper wrote in the Dec. 10 letter to the 11th Judicial District Attorney’s Office, which is prosecuting the case against Morphew.

It was not immediately clear how the Brady letter about Cahill’s credibility would impact the case against Morphew, but the letter was discussed in court Monday during a pre-scheduled motions hearing. The hearing is expected to continue Tuesday.

The CBI’s letter did not include additional detail about the internal affairs investigation into Cahill and did not say why he resigned. Susan Medina, a spokeswoman for the CBI, declined to comment Monday. Cahill could not be reached.

In the letter, Camper said CBI officials “regret this situation.”

“While I am disappointed that I need to pen this letter, it is important that you be made aware of this matter,” Camper wrote.

Barry's defense is spending time and $$$$ hammering away the minutia. It's what they do, and they're quite good at it.

But at the end of the day, I am still positive an average Juror would see the evidence proves BM did it, beyond a reasonable doubt.

Am I alone in thinking that Cahill is not an essential witness for the People?

There is one essential witness IMO, and that is agent Grusing. I truly believe he will be the difference in all of this.

I skimmed the AA, and Cahil's (lack of) credibility shouldn't be an issue. Those interviews were recorded, and it's the recordings themselves that will play a large role here.

Cahil also seems to have had company during these interviews, so it's not like it's going to be Cahil's word against Barry's.

It's a bad look of course, but I'd rather it be Cahil than someone else I think.

One thing I can think of that would halt the live-tweets and reporting would be if someone was secretly recording it. That is strictly prohibited as we all know. I’m suggesting perhaps a civilian member of the public. Not a media person. Just a thought.

OK, so thinking back, wasn’t there an issue in one of the early hearings where Judge Murphy warned about people not streaming or recording the hearing “or else…”, something to that effect. I can’t remember what the “or else” part was, but could something similar have happened today? But today’s hearing wasn’t even available on Web-ex I don’t think, or was it? Ugh don’t mind me while I ramble, my patience and nerves are about shot lol.

Judge orders prosecution to release documents in Barry Morphew murder case

The new judge presiding over Barry Morphew's murder case on Monday ordered the prosecution to turn over all police reports and videos from the 20-month-long investigation to the defense.

Morphew's attorneys argued during the first day of a two-day hearing that the prosecution has not handed over evidence in a timely manner.

11th Judicial District Judge Ramsey Lama also said prosecutors must turn over any internal affairs and resignation materials involving a Colorado Bureau of Investigation agent who stepped down after a dicey evidence hearing in August.


According to information divulged in court hearings, the glove box DNA was a mixed partial profile of three people, including Suzanne Morphew, one of the Morphew daughters and a third profile, which has markers similar to three profiles found in three sex assault cases in Arizona and Chicago through the Combined DNA Index System.

It's unclear to whom the profiles belong, whether there is enough of a profile to identify a close match or whether the profiles have been thoroughly investigated. The defense team said Barry Morphew's DNA has been excluded from the glove box sample; however, the touch profile was not found anywhere else but on the glove box.
1. With all the agencies and documents involved, it would not be surprising to me that some documents are difficult to retrieve - for the defense and for the prosecution. That's what "the nature of the beast" is intended to describe. At the end of the day, the prosecutors may be able to find it in a data dump given to the defense months ago.

2. I think it's incumbent on the prosecution to look into the "partial profile" red herring, explain to the judge both its lack of significance as evidence of an alternative killer, and ask the judge to prohibit the defense from misleading the jury by referring to it at the trial.

Unless you know something we don't, this is going to trial. Judge Murphy already ruled as such, and nothing has occurred to change that.

It's Barry who should be praying that this doesn't go to trial, then again, he could have just not murdered his wife in the first place.

Was thinking maybe it was something to do with former DDA Lindsay and his testimony but what you said makes much more sense
