Right. But, "I'm on WA" is the end of that conversation.

Big chunk of text:

Q Lindsey: The question was the string of LinkedIn messages at 2:05, 2:04 into 2:05.

A Harris: Yes. Yeah, there’s a couple more, “Fine with me,” at 14:05:01, “Thank you, babe,” at 14:05:13. “I’m just in love with you,” at 14:05:20.

THE COURT: Can you — I don’t know who these texts are coming from and going to.

THE WITNESS: These are all from Suzanne to Jeff.

THE COURT: Okay, you said there was one that said, “Thank you, babe,” and then the next one —

THE WITNESS: Yes, sorry. “I’m just in love with you.” That one is at 14:05:20. Then one last one that’s in the 14:05:46 is “Whatcha up to?”

BY MR. LINDSEY:

Q Lindsey: I’m sorry, you talked a little bit down into the —

A Harris: Sorry.

Q Lindsey: I didn’t hear what you said that last one was.

A Harris: “Whatcha up to?” is at 14:05:46. Whatcha is spelled w-h-a-t-c-h-a.

Q Lindsey: Okay. Is there more messages in between Suzanne and Mr. Libler in that afternoon?

A Harris: Yes, Jeff responds at 14:06:03.

Q Lindsey: Okay, what’s his response?

A Harris: That he was — I don’t know if this is a quote — that he was cleaning up outside and that his wife just went to Costco and his daughter went running. He — that’s supposed to be a summary. He then asked, “Want to strip down and get naked? LOL??”

Q Lindsey: And that’s a message from Mr. Libler —

A Harris: From Jeff to Suzanne —

Q Lindsey: — to Suzanne —

A Harris: — at 14:06:03.

Q Lindsey: Communication continue on?

A Harris: It does Suzanne responds, “Oh man!!”, with two exclamation points at 14:07:30. And then Suzanne responds again “Can you talk??”, with two question marks at 14:07:38. Then Suzanne has two more responses “Or video?”, at 14:07:44. Then she says “I can load up WA!”, at 14:08:02.

Q Lindsey: And what do you understand WA to mean from your investigation in this case?

A Harris: The application WhatsApp.

Q Lindsey: What time was that message on LinkedIn?

A Harris: 14:08:02.

Q Lindsey: Okay. Are there any more messages from Suzanne —

A Harris: Yes.

Q Lindsey: — to Mr. Libler, or vice versa?

A Harris: Yes. Jeff responds — I don’t have the specific time for this but he’s got to check on his kids and see whether he’s able to. Then Suzanne responds with just the word written out, “Okay!”, o-k-a-y at 14:11:21. Then Suzanne also responds, “I’m on WA,” at 14:11:25.

So, you see where I came to the conclusion that they did have video sex before Barry got home.

Please remind me the source of this diaglogue, the PH transcript?

A question that has seen nagging me is, what would have happened if Barry had caught Suzanne with JL?
RSBM (I remembered!:D) - I genuinely hate to think what would have happened.

  • #523
But here's MY question -- assuming Barry knew she had a lover, how did he think that person wasn't going to come forward?
RSBM - Because he wouldn't have?

@marylamby

Respectfully, I never said that you did.

I was pointing out that Suzanne and Barry's cousin come from different faith perspectives.

What Suzanne might feel at ease doing others would not.

Suzanne's testimony and her sharing it has been discussed by many who knew her. So much so it became a part of her identity both personally and as a mother.
Equally respectfully, I don't recall her 'testimony' being discussed anywhere but in Barry's cousin's interview and certainly not how she did so at Barry's command and if you ask me, that's a whole other ballgame.
One of the things I mentioned is how a person is allowed to change how they feel and do what they want to at any point in their lives. It's called autonomy. I'm not arguing Suzanne's beliefs but I feel Barry was overbearing in asking her to give her 'testimony'. I also believe he was very controlling.
Even though he cut her life short, I'm so glad she finally found the self-esteem she hadn't known before.

BMs phone tracing did not show a pause or slowing down behind the house so I don't think she was outside when he returned home.
He then goes from the garage straight to master bedroom and tracing shows him there for two minutes.
RSBM Does it take two minutes to load a tranq dart?

  • #526
I'm curious about his message that went unanswered. About the weather. Was it coded (to see if she was alone and could talk)
RSBM "All clear" would be a good one.

After the proof of life photo, Suzanne texted JL that she was switching to wa. When interviewed, he said he didn't think they met up on wa (p. 17/19 AA)

Do we believe him?

Is the situation on the patio what enraged Barry (could he "see" her?) Or is it something he "saw" once Suzanne went inside?

When did Barry form his fatal intention?

2018/2019?
5/6? 7, 8, 9?

Friday? Friday afternoon? Evening?

Saturday? 8am? 11am? 2:11pm? 2:40pm?

There seem to be elements of pre-planning and bad or no planning.

Right, in my experience, peple whobdont think things are covering up and with a hedging lie, and just hoping there isn't proof, "...he (JL) didn't think they met up on WA" (p. 17/19 AA)

I hope they polygraphed him.

^^rsbm

I dunno....

We're looking at about a 3-4 min exchange where JL sends the 'get naked' suggestion in a playful, Lol context.

SM responds suggesting she's loading up WA, and JL replies he has to check on his kids, does not commit.

It appears that their communication ends around 2:11 pm-- which coincidentally coincides with the same time that SM sends JL her bikini photo.

I believe both the state and the defense agree that SM's final, proof of life message occurred at 2:11 pm.

I don't see the above as definitive that JL participated in video sex but I do see that SM's already loaded up WA (or was committed to), she was already nearly naked, and alone, so I think it's more likely that SM made a self-video for JL.

IMO, this best explains JL's hesitancy in responding to the FBI whether or not he got on WA because he did not want to tell investigators that SM sent him a sex video.

IMO, JL has not wanted to be the source of anything that might be perceived as negative about SM, period.

So I agree there was most likely a sex video, I just don't agree that JL necessarily participated by getting naked himself.

How accurate is the phone data showing location?

Although it's been said the data shows BM at the bedroom door for 2 long minutes, is it possible that he pushed through the door and then took Suzanne's life just on the other side of the door during those 2 minutes?

Or, if he went through the door and attacked her in her closet, would the phone data show him in a different location than the door?

I ask because I wonder how accurately the phone can make distinctions in a small location. Would the door to the master bedroom show a different location than say the shower - or the bedroom closet?

I don't believe him when he says he "didn't think" they met up on wa. How can he not remember his last moments with his lover? He absolutely knows whether they met up or not.

My guess is they DID have a session on WA. He just didn't want to admit it at the time. While under oath, the trial may bring out a different recollection.

Agree.
Good possibility they were on WA till just before BM came home, but a tiny camera might have shown BM that for sure his wife was having an affair and leaving him.

Oh okay, gotcha.
I was just looking at the timing of the messages in the AA.
SM says “ I’m on WA” at 2:11
Then it says that JL sent “ 3 response messages “ at 2:39, 2:47 and 2:48 which went unanswered by SM.
So that sounded like he never heard from her after 2:11.

I don’t know much about WhatsApp except your messages and videos automatically delete unless you set them to not delete.
I’m sure SM and JL made sure theirs deleted, otherwise LE would have been able to retrieve them.

So from the 2:11 “ I’m on wa” message until the first of JL’s responses at 2:39 is 28 minutes.

And BM got home by 2:43.

Do you think BM walked in on something?

To me, it seems unlikely that he discovered Suzanne in flagrante delicto.

He sent several texts and we have been given no reason to think she changed devices (her laptop was in the kitchen). I think she would have gotten the SMS notifications as a priority over the WA app because she had been managing to not get busted for 18 months, a little thing like a text notification was not going to trip her up. I've probably worded that very confusingly. Some apps by default take priority over others and can silence notifications until you close/minimize the app. Usually voice and video chat programs. You can change it via the app settings in varying ways depending on your phone. After all this time seeing how she hid JL from Barry, Suzanne's GoogleFu was strong. She may not have been a techie, but she wasn't afraid to change the default settings on her devices.

I think she was probably in the shower when Barry broke open the door.

Yes, he was extremely controlling.

Imagine thinking there are hidden cameras throughout your home watching your every move.

In addition to the cameras were the harassing calls and texts, one after the other. Throw his erratic behavior and volatile personality into the mix and she must have felt anxious and fearful.

I really hope her body is found soon and her dear family and friends can lay her to rest properly...

Also, I'm glad we were able to clarify our posts:):):)

Thank you for all these texts!!!!

I don't like to spell them all out on the timeline because after awhile, I really started to feel like I was prying into other people's private business. I went ahead and plugged that whole block of PH text into the "I'm on WA" timeline entry details.

No, I don't think BM saw things on SM's side.

He didn't access/hack her apps.

I think SM engaged in flagrante delicto inside the privacy of her closet where BM captured her on his spy camera.

The box and manual were located inside BM's bathroom drawer, but the camera missing.

I believe he planted the camera around the date he received SM's "I'm done text."

It had not been there long. MOO

Had they communicated after 2.11pm by WA video there might still be artefacts of this e.g. increased data use from streaming on the Morphew router.

I suspect SM just waited for him to call, which he subsequently did, but she didn't pick up, so he switched back to LI

Testimony on this will be extremely interesting.

"Suzanne's GoogleFu was strong."

I think that goes for BM as well. Both of their GoogleFu was strong. Great word sk716!

I didn't realize her laptop was in the kitchen. But having never recorded anything sexy on WA (or a phone), wouldn't it be easier to use a one handed phone rather than a bulky laptop? Picturing it, I just can't imagine using anything other than a handheld phone. Maybe I'm just naïve. To use a laptop for video fun, would she set it up on the floor (if in the closet) or bedside table (if on the bed) and just let it record?

Sorry but I'm just trying to put myself in her shoes and wondering how I'd record some sexy video in my closet or bed. Nothing wrong with doing that but just wondering how would I be most comfortable accomplishing that.

Maybe, maybe not and there's a good possibility (in my mind) since we know he had one, that there were more than one of those little cameras.
If there's one thing I've learned in my life it's that a liar won't ever think another won't lie, a thief can't fathom another wouldn't steal and a cheat will never believe another wouldn't cheat. Ever. And, there's nothing that can ever change that.
It's the nature of the beast.
