Sorry to reply to my own post @TravelingBug but I see you've already shared a good bit. I could have been more patient and continued to read down further. :)

In my defense, I just cannot abide BM and am not-so-patiently waiting to see him rearrested and locked up with no bail. I know the new DA needs to have their chipmunks in a row so to speak, so I wait. ;)

i am fine that public office holders used public funds for this. It doesn’t make sense that DAs and prosecutors would have to pay their own fees every time they get sued.

This is really getting old. Maybe it's time for the commissioners to take a look at Judge Turner's action here!

Added some documents to the MEDIA ONLY thread after updating the appellate docket-- quoted above-- which reveals the farce BM and his defense team are trying to pull by even filing an appeal in UNITED STATES COURT OF APPEALS FOR THE TENTH CIRCUIT!

In Morphew's Docs #40 and #42, we learn that BM wants a do-over!

He acknowledges that he voluntarily dismissed defendants to his lawsuit, and the Court dismissed all the remaining defendants, but now BM is wants to file an amended Civil Rights Complaint in the District Court-- suing fewer defendants for fewer claims than he did initially -- taking notes from the Courts Final Judgement that BM thinks were favorable to his case!

If the District Court grants his Motion to file an Amended Complaint, then BM will voluntarily withdraw his appeal but until then, he is seeking a stay on the Appeal. The Court imposed a deadline of December 17 for Appellee's to respond to BM's Motion.

And for some true irony, -- Iris isn't a member of the 10th Circuit Bar and therefore isn't authorized to practice before the Appellate Court! She's been put on notice (Doc # 34) to make timely application or she will be stricken from BM's appellate case.

Of course, had this been Stanley, MSM would be reporting this from every corner of the state!

The Amended Complaint is 175 pages plus -- but not today. JMO

it would seem odd that the Court would let you refile if you agree not to appeal - isn't that the whole reason he needs to win on appeal?

Another Motion for Indicative Ruling pursuant to Rule 62.1 by BM filed in US District Court 12/9.

Team BM first filed this Motion on 12/5 without conferring with the defendants and opposing counsel they intend to sue -- 'let's ambush them'-- but withdrew their Motion citing both the Motion for Indicative Ruling and Motion to file Amended Civil Rights Complaint were filed in error.

Judge Domenico immediately ruled the Motions moot -- I sure hope Domenico is on to how they are trying to use him and restate their case (Amended Complaint) from his own Judgement (Dismissal) in favor of the defendants. IMO, they've had much practice in this regard.

Whereas team Morphew earlier dismissed FBI's Harris & Grusing from the lawsuit WITH PREJUDICE, I must say I'm deriving too much pleasure that defendants counsel has ignored everything from BM and the 10th Circuit.

I'm sure they are thinking other choice words but let's just say a diplomatic "go pound salt" message.

DENVER – A Chaffee County sheriff's detective and two Federal Bureau of Investigation agents whom Barry Morphew sued last year have been dismissed from the court case.


They were among numerous law enforcement authorities Morphew is suing for their roles in investigating and prosecuting him for the alleged murder of his wife, Suzanne. She went missing near their home in Maysville in 2020.

Morphew's lawsuit is ongoing against more than 20 other law enforcement authorities. The case is in Denver at the U.S. District Court for Colorado.

Court records and the FBI are silent on why Morphew agreed to have agents Jonathan Grusing and Kenneth Harris dropped from the case on March 27. An attorney for Morphew did not respond to The Mail about the development.

Morphew's lawsuit against law enforcement authorities alleges that they fabricated evidence against him and withheld evidence favorable to him, among other things.

On March 29, Morphew dismissed Chaffee County Sheriff’s Detective Sgt. Claudette Hysjulien from being a defendant. The court filing for the dismissal does not state a reason for it.
