You may well be right! I'd actually love it if BM tried to appropriate his victim's wealth to buy top-notch legal talent. That would be a major mistake!
However, since I speculate BM is practically broke and the PD is unable to handle the workload my guess is either the PD hired them or the Judge appointed them at public expense. Judge Murphy is a former PD. I have no doubt he knows of the E-N lawyers, and (like all of us) he wants BM to be well represented so any conviction will withstand appeal.
As I say, we'll see!
State Public Defenders are provided for pursuant to Colorado Revised Statute (C.R.S.) 2016, Chapter 21.
While the Statute does provide for the appointment of alternate defense counsel (NOT appointment of other attorney or investigator in place of the public defender - contracts for services) when the public defender is deemed to have a conflict of interest to represent a defendant, please take note that ..."case overload, lack of resources, and other similar circumstances shall not constitute a "conflict of interest."
In other words, the CPD office hiring private attorneys to assist the PD and/or represent BM as OP suggests is prohibited by C.R.S.
