#BREAKING: with that last witness the prosecution has presented their evidence and hands it off to the defense.

This is NOT good!!! I think BM is getting bail today if not dropped charges... If this is all the prosecution has, I do not think its enough for Murder 1. I feel BM is guilty of murder 1, but I don't think the prosecution proved it. They barely implied it. I'm not impressed. I think Suzanne's chance for justice was just blown by the prosecution. Jmo

Patrick W. Murphy, District Court Judge (Order dated June 4, 2021 to have the Arrest Affidavit continue to be sealed)

This is one of the concluding paragraphs:

"This Order shall expire 7 days after the conclusion of the Proof Evidence Presumption Great Hearing and Preliminary Hearing, which are currently scheduled to be completed August 24, 2021. Before the expiration of this Order the Court will consider further requests or argument as to why or why not this Order should continue and in what form"

I didn't mean the order, I meant the actual AA. I understood that the AA itself needed to be signed by a judge?

The dryer and washer were empty. Deputy Himschoot was assigned to swab the dryer. Now we are watching body cam video. Audio: "Did you see what was inside the dryer? You might want to look inside the dryer? There might be something of interest..."

IMO only, I believe the daughters will only benefit BM's defense.
Unless any daughter had seen him commit the crime, the chances are that they would side with the remaining parent .. possibly hoping against hope that the cops have got it wrong and in the knowledge that their support of their mother would put the father in jail not certain if he had done it .. we don't have SM body yet .. and no direct evidence like blood splatter in the house

I almost feel like the prosecution was just going through the detective handbook's "means, motive, opportunity" playbook. They definitely covered all three but as the prosecutor, you have to prove that the defendant actually did it. Not just that he could have.

Prosecution asks Agent Grusing about domestic situation. He says #BarryMorphew told investigators there was a time when he accidentally clipped #SuzanneMorphew nose with his hand. @KKTV11News
This. He is asked a question and fears there is someone out there who knows the right answer. So, he weasels a confession to having done something that might have looked like more.

Translation: He walloped her.

This is NOT what we expected, it is?
well, I think the judge made his feelings clear. I think the prosecution has passed the standard necessary for trial - so there is no need to continue. However, the prosecution needs to up their game come trial.

I agree completely and have continued to say so since the beginning. I am not getting the "bam" moments that everyone else is getting. It's all a big nothing-burger so far.

When taking all of the things into account, at what point is there so many suspicious things that he did in that day and the following that makes it over the line to go to trial. I get having a couple things just be an " I don't remember or I forget"... but ALL of that which has been presented seems to be something he don't have a legit excuse for and just a bunch of "but that doesn't mean I killed her" excuses. If she went missing and he was the last to see her, but he didn't delete messages, wasn't going on a last minute work trip on Mother's Day, if he didn't lie to police or make 5 different stops to dump trash, if they didn't find a tranqualizer dart in the dryer with no excuse for why, if he didn't try to erase his truck history, etc.. I mean what are the odds that he did all those things and it has nothing to do with Suzanne AND he just happened to do all those things the day of and the day after she is missing? I understand that none of it is a smoking gun, but innocent people don't do half of what he did and I just don't see how a judge could see all that and say yeah totally a coincidence that he lied to police on this day and did lots of suspicious things, but can't remember why.

It was the cap for the tranquilizer needle sheath inside the dryer. Another deputy then took photos. Nielsen asked Deputy Himschoot what was that clunking noise? Himschoot said I picked up the item and then put it back down. He didn't file that in his report.

As per the Order, it will be up to Judge Murphy as to whether the AA will be unsealed. We will see what happens over the next 7 days to see whether he allows it to be released or not.

There will be arguments from both sides as to whether the Order for the AA to remain sealed will expire - or not.

It's a waiting game.

DA Jeff Lindsey - When did law enforcement know when to first start looking for Suzanne Morphew's bicycle? JG - When Jeanne Ritter called. She was told by Barry to look for the bicycle. Grusing is excused.

W/a question about how police knew to search for #SuzanneMorphew' s bicycle, the people have rested in the preliminary hearing of BarryMorphew. Defense call sheriff's deputy Scott Himshoot to the stand. Discussion about the gun safe - empty tranquilizer darts & dart gun inside.

FBI Agent John Grusing has stepped down from the stand. The prosecution is done presenting their case, and the defense is now calling its witnesses.

The defense has called Chaffee County Deputy Scott Himshoot and is asking him about a search of the laundry room in the Morphew residence.

Defense is showing body cam footage from a search of the dryer in the Morphew residence. Someone is heard on the recording saying “cap from a tranquilizer gun … a cap for a needle, I could be wrong.”

So what are these attempting to influence a public servant charges? Wouldn't evidence of that crime go to show evidence of a cover-up in the murder? Or was it about the voting?

  • #379
Wow. So all they have is from him talking to the police. He keeps quiet, he skates. Astounding.

Aw Geez

Defense team is suggesting Sheriff's Deputy who swabbed the morphew dryer, planted the needle sheath to the dart gun. On cross examination, he tells prosecution he did not but he did pick it up and put it back which he didn't mention in his reports
