One thing to keep in mind...every witness in the PH (5?) is LE...there are a number of key players who are not LE, and are going to testify at trial. That one dimensional aspect of the PH may be why some are feeling angst and seeing nothingburgers.

I almost feel like the prosecution was just going through the detective handbook's "means, motive, opportunity" playbook. They definitely covered all three but as the prosecutor, you have to prove that the defendant actually did it. Not just that he could have.
@Alethea. What do you think Judge Patrick Murphy's decision will be?

I’m very confused. I hope the prosecution isn’t done. Is this all it takes to bind someone over for murder one and lock them up without bail are lies and assumptions? I believe he is guilty but I don’t see the prosecution having a good case.

sorry I had to miss a few minutes - why didn't the state continue to call witnesses it didn't have time to fit in on the first two days of preliminary?? Giving the defense time to call witnesses? I mean I understand they have a right to a defense, but this is the state's hearing for probable cause. Seems strange to me.

So what are these attempting to influence a public servant charges? Wouldn't evidence of that crime go to show evidence of a cover-up in the murder? Or was it about the voting?

My only guess - it was a blanket BM lied to all the named investigators who questioned him about SM. IMO

Was that the prosecution’s final witness of the prelim or was that just worded wrong? I was hoping they would end with another slam dunk bombshell. Do you think the state is so confident that they have presented enough to hold Barry over for trial and they are saving the rest for the actual trial?! Is this a strategy to prevent defense from having time to plan on how to respond? But the prosecution has turned over all evidence to defense already so they wouldn’t be able to catch them off guard on anything major right? But the defense doesn’t know what each witness is going to say so maybe they are saving some bombshell witness testimony for trial? Does anyone think Barry will not be going to trial? This is the first preliminary hearing I have ever followed so I might be wrong but it sure seems like more than enough to me.

Deputy Himschoot also was talking in the garage about the dart gun and how it didn't function and didn't seem to have been fired in a very long time... so finding the tranquilizer needle sheath cap in the dryer was odd.

Prosecution asks if the gun was ever examined by a firearm expert. Deputy says no it was not. Defense fires back saying that he may not be a firearm expert but he was familiar with guns and he made determinations with familiarity with firearms that it did not appear to work

Prosecutions takes over. They flat out ask Deputy Himshoot if he placed the cap of the needle inside the dryer. He says no. Pros says "are you 100%?" He says yes. @KKTV11News #BarryMorphew #SuzanneMorphew

No. They have massive cell phone data, GPS records, and surveillance video. And much more. 129 pages worth.

Agree! But Prosecution is finished presenting evidence in the Prelim it appears! I know BM should be bound over for MURDER 1, held without Bail, but I’ve been following this case as close as one can for 15 months, like white on rice. Average juror won’t have followed this at all! This prelim was disappointing imho, as far as evidence! Moo

I think it was about the voting. Earlier today it was said that BM wanted Trump to win and that he knew the Dems were cheating via voter fraud. It was not to cover up the (alleged) murder.

I got knocked off the site for a minute. Whew, what an ending for the Prosecution.

I wonder if that is why they were meeting before court this morning?

I believe the State has proven cause to move forward and they just don't want to tip their hand (and evidence) too much with this Defense.

Remember how the judge complained about the length of the AA and said a lot of it was not evidentiary. Justice for Suzanne is in jeopardy here. This judge just ain't buying it.

The deputy testifies during cross-examination that he found the cap on May 19 when he opened the dryer door to swab the inside for DNA. It looked similar to what he saw with tranquilizer darts in a safe in the garage, he says.

The deputy testifies that when he examined the tranquilizer gun in the Morphew house, it did not appear to have been fired in a long time. He has now stepped down from the stand and the court is on a short break.

Tuesday’s filing lists eight public servants he is accused of trying to influence. The individuals include three agents with the Colorado Bureau of Investigation – Robin Burgess, Joseph Cahill, and Derek Graham – an FBI agent, Jonathan Grusing; a Chaffee County Sheriff’s Deputy Lamine Mullenax; and the chief investigator with the 11th Judicial District Attorney’s Office, Alexander Walker. Two individuals whose positions are not known – Damon Brown and Kenneth Harris – were also listed in the court filing.

I wonder if anybody counted how many witnesses we heard from the prosecution? Originally the prosecutors said there will be 8. I have a feeling they were less.

We have to remember this isn’t the trial of BM just yet. This was a hearing to establish if there is enough probable cause to bond BM over to trial. That’s it, nothing more.
IMO they established probable cause on the 3rd day already. Now hopefully BM can have his trial and and make his defense team try to explain those zillion strange things he said, has done and hasn’t done.
At the trial we will hear more evidence and way more testimony. This wasn’t a trial to establish guilt.
