You are correct mam, per usual. Because her name is on the title she is entitled to half the proceeds from the sale of the house. As a guardian, BM would be required to put those funds in some kind of trust or bank account for SM that's separate from their marital funds. Guardians have to report to the court financial decisions or changes to their guardian's assets every 30-90 days, so hes being checked in on
I respect the law but some don't. I might be doubtful that he's being checked in on due to furloughs and illness.
One might take advantage of that.

I don’t think he’s a flight risk at all, and I don’t think there’s a rush here.

Without a body, I don’t think he’s nervous enough to run. That would end all doubt as to his guilt.

He’s close to his mother, and has his daughters at his side. I’m sure he still has quite a bit of support from those close to him as well.

It’s not easy to just take off, and harder yet to stay on the run for any length of time. With today’s technology, the world is smaller than ever.

True, but look at LS and what she did to GS.

She did get caught, but she still managed to make to Florida.

JMVHO.

She wasn’t anchored in Colorado though, and her home base was South Carolina. She merely went home, and law enforcement was powerless to stop her from doing that.

It didn’t matter though, as they knew exactly where she was. They just never imagined she packed up both her belongings, and a body.

Stigmatized Property, Disclosure?
... C.R.S. § 38-35.5-101 creates an exception to the general rule of disclosure identified for both seller’s agents and transaction-brokers, in that it provides for nondisclosure of information that is psychologically impacting or stigmatizing. This statutory exception reads as follows:
(1) Facts or suspicions regarding circumstances occurring on a parcel of property which could psychologically impact or stigmatize such property are not material facts subject to a disclosure requirement in a real estate transaction. Such facts or suspicions include...
(a) That an occupant ... HIV... AIDS... or
(b) That the property was the site of a homicide or other felony or of a suicide....

@NoSI sbm Glad you found this and posted quote w link. Extreeemely helpful.
Per this statutory exception, imo, r/e agent or broker listing PP prop is not required to disclose info about SM's disappearance to prospective buyers.

As of now do facts show that PP property was the site or a homicide or other felony, or of a suicide? A criminal conviction? No. Guilty plea, plea agreement, or even an arrest? No.
Suspicions? Yes, plenty, and maybe even the listing agent suspects that a homicide occurred there, other felony, or suicide occurred there.

I understand the practical and legal need underlying this exception to gen requirements r/e agent disclosures. jm2cts.

What did he say?

He took the opportunity afforded by the Denver CBS affiliate, to plead for his wife’s safe return. He also thanked Andy for all his hard work in regards to that massive search effort.

Almost had you, didn’t I?

No, in reality, he once again demonstrated how he is completely devoid of any class. He shared a lovely Valentine’s Day note left by Suzanne, which painted himself in a wonderful light.

Because Barry is the center of his own universe, per usual.

Barry said his brother-in-law hasn’t cared to reach out to his sister in the past and questioned his motives.

“I’ve spent many nights… Suzanne crying on my shoulder, asking why her siblings refuse to show her love,” said Barry.

When her cancer came back, he said he and his daughters were the only family by her side.

-BM saying he doesn’t think she’s in the area probably means she’s in the area

-BM says he does not have an attorney
Personally I think he's too cheap/broke for an attorney and if he has an attorney he has to reveal lots of personal stuff that makes him appear to be something he's not. He can't admit he's a failure even if it's in confidence. So he keeps plugging away trying to keep his narative going. Is he so oblivious to LE all ready digging into his history and finances? They know BM, they know. As far as that letter goes in my opinion that type of letter only would be written as a walk down memory lane. I wonder what made her feel the need to bring all those emotional times up. moo

Oh boy. Kind of shows where I’m at when it comes to my feelings about this guy because you didn’t almost get me! I knew by half the first sentence you were pulling my chain.

Very sad that many of us believe it unlikely that he’d actually plead for the wife he loves so much.

She’s far from here, huh? Great way to give an excuse as to why you’re not searching anymore.

I tell you what, that’s my spouse? I’m going to beg, plead to the abductor and keep asking for people to search. Especially if the police aren’t.

He might get a little leeeway due to covid, but he sill has to submit regular financial reports to the court and has to be able to show hes using the funds appropriately. There was another WS who is a guardian, I cant remember who, that said the court makes her submit every single receipt and financial transaction. If the court thought he wasn't performing his duty they have full discretion to remove him at any time for any reason and if he misused funds, he can be found civilly liable for them. Im not saying people dont abuse the system, they absolutely do but in the case of guardianship I dont think it would be able to continue for a long period of time given the frequent check ins

kind of weird how he never asks anyone to return her or how he never asks police to look for the guilty parties.... almost like hes not actually concerned with the return of SM, just looking good in front of the media. The interview isnt enough, just looking at the cold callous nature of his words is telling

I agree but he might possibly use this window of time to pull it off. JMO but I wouldn't trust his freaking tax returns (or anything else) either.

You're so cute.. "almost" is adorable. :D
Before mods jump on this, I love @ivegotthemic and she knows it. All tongue in cheek. :p

honestly this is something that freaks me out, there is an opportunity to grab the money and run without it being noticed the money is gone for a few weeks, my only solace is that seems like a last hail mary pass that only a very desperate man would take due to the legal repercussions

I’ve said before I think he laundered SM’s inheritance through the house, now it’s possible he laundered the house through Suzanne’s foundation - tax free and an asset protected from civil suits should someone try to sue BM. I’m wondering if the foundation, which has a board of directors stacked with BM’s people, not SM’s, was really a front for some of BM’s shady, shady financial antics.

Bleach, Hotel & House?
... While the hotel bleach was collaborated by the three people who were in the hotel room, we have not one account by the people who were involved in house search...LE.
IMO, bleached house isn’t evidence, yet. Hotel bleach may or may not be evidence, since LE hasn’t listed it as evidence. but three actual accounts are good enough for me.
... trying to review and stick with the real facts, weed out speculation. At this point, we can’t lump the bleach to both the house and hotel....
@Feistyomi bbm sbm Thank you so much for pointing out the difference -- three sources (who were at least purportedly at hotel) claiming bleach smell there compared to claim of bleach at house.
Not saying that just any three rando's alleging a point would give more credibility to that point. Depends on the individuals imo.

Just saying you are observant & analytical on this & other issues. Glad that you continue to comment even when many others reached a conclusion about BM's guilt. That is a great catch.

I'm on the money laundering boat big time. I've read quite a few things that make me see those great big sign turners with the arrows all pointing in that direction.
