Wow, I would think this would be manslaughter at the very least. She ignored her children to the point that they were in extreme danger and in a deadly situation and they died as a result. I seriously hope she never has another child in her life. There isn't much more i can say, because I do not want to get in trouble.

I looked up the sentencing guidelines for child abuse from criminal negligence in Colorado. If I am understanding this correctly: Minimum 4 years; Maximum 12 years per Count for Class 3 Felony.
For false reporting per count: minimum fine $50; maximum 6 month imprisonment and $750 fine

I thought she was found not guilty of criminal negligent homicide. I will go back and look at aggravating factors that could be considered. Would being under the influence be one?

She was found not guilty of the criminally negligent homicide so I am sure this is wrong. I will be interested as to what the jurors have to say. I have a feeling this will have to wait until the morning paper but I will post anything I find. I'm off to shovel snow...again.

In Colorado, under the Extraordinary Risk of Harm to Society, offender is first subject to 4-16 years, then must be sentenced to at least the midpoint and up to twice the maximum of the extraordinary risk presumptive range for an overall range of 10-32 years per count.

The prosecutor could argue cruelty as an aggravating factor I think due to the manner of death.

I read this on the Colorado.gov site for sentencing guidelines with extraordinary risk.

Colorado sure does have a lot of statutes regarding meth in all kinds of situations. Interesting. I may be totally off with this one. I couldn't figure out where the 64 years was coming from until I read the extraordinary risk sentence comes first. Not a legal person at all.

Haha That's a sad thing as I don't know beans about legal things and he is the #1 in charge of court reporting! ( and we only have one newspaper)
