In addition to the murder charge, it appears that the defendant is still facing child abuse charges filed under a different case number:
Excellent.

Three years ago, the El Paso County Coroner had concluded that 11-year-old Zachary Sabin died after being forced to drink 96 ounces of water in a four-hour span, with no food intake. However, Jeff Barker, the defense attorney, now contends that there is insufficient evidence to support this cause of death, thereby invalidating what was previously thought to be established facts in the case.

That evening, in March 2020, Zachary was placed at the kitchen sink, in their Black Forest home, to drink water.

Ryan Sabin and Zachary’s stepmother had instituted a water-drinking rule due to the child’s urological issue. They said he had a bed-wetting problem, and in recent weeks his urine had acquired a rancid smell, and a concerning dark color. That day they said he did not drink the amount of water he was supposed to at school that day, so he was to stand at the sink until he finished the amount of water they required him to drink.

During opening statements, Prosecutor Jennifer Viehman presented a timeline that painted a picture of Zachary’s final hours. From 5 p.m.- 9:30 p.m. he stood at the sink, as the family ate dinner without him, the prosecution highlighted various signs that Sabin allegedly dismissed as dramatic behavior. This included Zachary gagging and vomiting, complaining of leg pain, and his inability to stand.

The couple was under the impression that Zachary was not drinking the water, and made him stay at the sink.

As the night progressed, Viehman says Sabin’s frustration seemingly grew, leading to verbal and physical harm inflicted on his son. Records show that at one point Sabin picked up his son, and let him go, causing the child to drop to the ground and hit his head.

Sabin took Zachary away from the sink and to his bed at 11:00 p.m. It was the last time he saw his son until 6:15 a.m. the next morning when he found him dead in his bed with foam coming out of his mouth and blood on the sheets.

Ugh, how dare they. He's having some symptoms but instead of taking him to a doctor they make up a water-drinking plan and abuse him. They can identify water intoxication during autopsy, not to mention to other alleged abuse. I think they sound guilty as sin. IMO.

Court records show that Sabin was sentenced to six months in jail for being found guilty of misdemeanor child abuse. Jail records show that Sabin has yet to be entered into the El Paso County jail at the time of writing.

Ryan Sabin's ex-wife, Tara Sabin, was originally charged with numerous counts of child abuse stemming from Zachary's death, but previous reporting from The Gazette details that she pleaded guilty to one count of criminally negligent homicide as part of a plea deal and received four years' probation.

I have to admit the sentences for this vile pair seem insufficient.

And the 11 year old 'hit his head' ?
Just sounds more like Zachery could've been thrown violently to the ground.
Almost as bad as water boarding and then being beat to death.

He also had bruises on his head, arms, shin and buttocks, and a red contusion to his left eye..
"Mr. Sabin said [Zachary] was lying on the floor throwing a fit," the affidavit states. "He said at one point he told [Zachary] to get up and kicked his leg. He said [Zachary] didn't get up and he told him to get up or he would kick him harder. He said he then did kick him a second time."



Ryan Sabin allegedly told deputies he brought his son outside, believing that the cool temperature would “snap [ Zachary] out of his tantrum,” the affidavit states.


He allegedly then brought the boy back inside and placed him back on the floor, where he began to snore. He told deputies the boy got up, walked around the kitchen grunting and

Sounds like Mr. Sabin and the stepmom were out of control.

The last hours of this boys' life sound like a horror movie.
Tortured to death.

I agree. It's absurd. They basically are getting away with it, IMO.
