Criminal Defense Attorney for Casey - Linda Kenney Baden

  • #241

Casey Anthony and her Revolving Door of Private Attorneys.

After the newest Florida based lawyers came on board I was waiting for either Baden or Mason or both to leave this case.

I think that Oksana is in the same camp since she has had 40 attorneys total ... coming and going. Does the number of attorney's map to controversial evidence and the amount of trouble you are in?

BBM - Yep. And not only that, but before she was declared indigent, what 'substantial' funds did LKB think Casey had? By saying she's leaving the case because she lives in NY and the trial's in FL and nobody will pay her way, is just a dumb lie. Because nobody was gonna pay her way to begin with. It's just so plain and clear, and please defense team, stop calling the public stupid right to our faces, ok? Thanks. And have a nice day.

ITA. I may be wrong, but I assumed LKB came on board before the blood money was exchanged for pictures of Caylee. Did she expect payment from KC? Get Real !
She's not leaving because the state won't pay for her,IMO. She has other reasons, but this gives her a chance to take a jab at the state.

Plus ... LKB was sorta/kinda replaced by the recent local new hires into the team. They are going to argue brass tacks and not major Baden team revelations.

She was definitely my fave of the team although we always knew it could never last with her brassy hair and brash mannerisms. She called em as she saw em and i respect her for that.

Next?

Honestly, who does she think she's fooling? We've all suspected she was leaving the case, she's been notedly absent for months, far longer than Casey was declared indigient.

Further - of course she can't afford to be on a team that's almost certain to go down as a conviction and possibly a death sentence. No defense lawyer can afford that kind of record!

Didn't she bring on Dr.'s Kobilinsky and Lee? Do you think HHJP will grant her motion to withdraw?

I think he has known she was leaving for months, and is probably quite pleased with this turn of affairs. he runs a tight ship. He wants known local Florida attorneys that know they will have to answer to him today, tomorrow and for the foreseeable future of their careers. he does not want an out of state grandstanding celebrity attorney who only performs for the cameras. I suspect that she has been planning to go for at least as long as AL. We really haven't seen her in months. Has she ever appeared before HHJP? Even doing her telephone call in thing?

And note. In the end KC will be left facing justice with the same as any other accused Florida resident. No big national celebrity dream team. Just a crew of local yokels with the most famous being a weird cross between Matlock and Foghorn Leghorn. All of whom at best will be accepting what the JAC pays for an indigent defendent and is guaranteed by law.

One of the most important things to remember in all of this and beyond the KC case is that the legal system is not perfect.

Loopholes do exit and while used at times to free guilty people...they are there there for innocent parties as well.

I think that trying to discuss the ethics of any group at large such as LE, Attorney, Judge, etc....is far too broad a task. At the end of a day, while politics do factor into a case....the professional ethics of individuals are what guide and /or lead a case.

Having Judges, Attorney's, and LE in my family...as well having social relationships with all the same groups...I can tell you that one simply CAN NOT categorize or assign ethics beyond an individual.

Whether folks like it or not...any person accused and charged with a crime is entitled to representation. There will be times where someone "gets off" on a technicality. But that technicality is available for use by innocent parties as well as guilty parties.

The legal system is available for everyone. While it may have flaws, it is not fatally flawed. We must recognize that it is ever changing and evolving. That is why it is so important for those in LE, and beyond to be up to date on changes and practices.

IMO we are seeing the KC case in a vacuum. There is passion and opinion that runs strong. While I am disgusted by some of the things I have read about this case...I have no choice but to remind myself that the system must be allowed to work.

.... a defense attorney said once...his job was to force the system to work precisely by the rules.

Are you saying - Don't generalize defense attorneys because of Baez and his defense team? That makes sense. I don't feel the need to generalize but I do feel a need to demand that their tactics and shenanigans be investigated.

Yep, the local yokals is what the murderer gets! That is a crucial statement but so many others do the same here. I Pray for Caylee since nobody in her family seems to care for her. They feel like rock stars HAAAAAAAAAAAAAAAA such a travisty We all pray for this darling being. Amen. Justice Prevails.

I guess the defense forensic experts agreed with the state ones and with Dr Lee unable to plant evidence, LKB has nothing to work with. :) Happy Halloween sweet Caylee!! Maybe we'll be able to get you a confession for Christmas!!

Has Linda Kenney Baden left the building? She's not mentioned in KC's motion for indigency.

Please let me know so I can bake cupcakes for the going away party.

I'm partial to chocolate. Woohoo!!!

I take no issue with anyone eligible to jump ship doing just that. What annoys me...the reasons given that just don't make sense.

It's kind of like a divorce citing "irreconcilable differences"...when it really means he was an a$$hole and I couldn't run fast enough.

I understand that it is important to protect KC's right to a fair trial. As a FL. resident.....I want her to have a fair trial!!!!! If LKB were to say anything prejudicial it would create an appellate issue. BUT....waiting this long AFTER the initial declaration of indigency and JAC rulings before formally withdrawing...just doesn't wash...and reeks of a deficit in professional ethics.

JMO

Wow...who didn't see this coming????? (sarcastic remark)---I DO agree with the you--the reasoning is suspect, especially when you go back to her performance at that hearing when they all proudly proclaimed they were working pro bono----I wonder if this is also a ruse for appeal??? (don't trust them)---All of a sudden it is money, money MONEY on the defense side........:furious:

I've got $50 that says Jose painted *quite* a different picture to get her on board originally.

Surprise, surprise, surprise........

Earth to Linda: Don't let Baez manage the money.

ITA--kinda makes you wonder if all the changes in lawyers are due in part to the Baez/Chayne front and all the dirt that is being swept up??????? the questions of the PI's???

I truly believe when jb signed on he thought it would be the gateway to fame/fortune as in the next Johnny Cochrane...he didn't realize that he might have to put in actual work or appear to KNOW the LAW.....and smoooze----I'm sure if he could he would run away....

She noted that the defense team must comply with Justice Administration Commission rules in this case.

"As out of state counsel I have been traveling to Florida and elsewhere to properly represent Ms. Anthony," she wrote in her motion. But, she added, it is her "understanding that the JAC prohibits payment of such costs to out of state attorneys even though they have rendered and are rendering their services free of charge."

Kenney Baden goes on to say she cannot continue representing Casey Anthony "in the absence of substantial funds to cover the costs of travel and reimbursement for expenses, which she anticipates will increase as trial approaches…"

She added that like Andrea Lyon, who also withdrew from the case as an out of state counsel earlier this year, she has worked hundreds of hours on the case.

"I believe in the client's innocence to the charges and do not wish personally or professionally to withdraw from this case," she wrote. "Nonetheless, because the state of Florida fails to reimburse out of state pro bono attorneys for expenses, I am forced to make this application…"

She says she cannot represent Casey Anthony "from afar without the necessary interactions and appearances in Florida."

If the attorneys are on this case pro bono, why are the traveling expenses their reasons for withdrawing?? I wonder if this is really something else disguised under this ruse...JMHO

ITA...there is more here than stated....Can't believe for one second money is all of a sudden the issue---No can't go there! They signed on "pro-bono" -- there were there testifing "pro-bono" was aokay with them----They claim to be very passionate---yet money stops them???? UHHHHHH NO.....don't belive it for one second! If you are that passionate about something you continue to pursue it----especially since I"m sure they have a few bucks themselves....plus with all the electronic stuff you really don't need to travel all that much as they are claiming....

Right before ALyon left what came out? What was the headline when she left? I wonder if they are leaving due to possible ramifications regarding the investigation into PI's????? I'm also think they can't find anythng to pursue regarding "reasonable doubt" without ruining their standing....just odd.....

*snipped

Perhaps she had a look over all the forensics including what they found out on the little field trip to the body farm and had an 'Uh Oh Moment' kind of the opposite to an Oprah 'Aha Moment' ... sends you running for the nearest exit.

And if defense experts have examined the evidence most of LKB's work could be done from where she sits today in her office. She was trying to prove "junk science". If the results from the defense experts is in than it may not be so easy for her to claim "junk science" and "saving face" may be her real determining factor in dropping out. jmo

LOL, Mrs Norris. And halfway round the world and we has the same thought at the same time.....

IIRC she went to Tennessee to the Body Farm recently..
BUT other than that...
When was the last time she came to Florida? To a hearing? To Depose expert witnesses? To visit her Client in jail?

Remembering when the story first broke here in the Orlando area and we saw Casey strutting thru the door in hand cuffs with her smile/smirk to the cameras...that was our First impression of Casey and the Second impression of her came via her jailhouse phone call home.
Somewhere between her arrest and the Bond Hearing she called and hired Baez.
When Baez signed on he had NOOOOO idea what this case was about to become..BUT that quickly changed and I mean Fast.
Baez found out Casey had no money, he found out a way to get money by selling pictures and who knows what else and stayed on even though IMO he was inexperienced to handle this case.

Sleuther, it struck me as very odd too ... I didn't know whether to think does she mean it would take substantial funds to pay her 1st class travel and 5 Star accommodations? Or did she mean, it would take a lot of money, or promise of a lot of money to hold my interest? ... or maybe she was saying the state of FL doesn't have enough money to keep me on this loser of a case?

Anyway, you look at it ... strange choice of words indeed ...

If, as Linda Baden states, she believes in Casey's innocence and did not, personally or professionally, want to withdraw from the case then why would she not volunteer to pay her own travel expenses etc..?
IF she feels so passionate about defending Casey then why Bail over travel expenses?

Casey was declared indigent months ago...

It was news to me too ... my first thought was the jailhouse letters probably freaked him out and sent him running ... before he became the subject of an investigation or KC made any accusations about him ...

It was smart of Garcia to no longer be "one of Casey's boys"..
I thought the same..Casey may accuse him of improper conduct somewhere down the road...
