Thank you all for the updates. I stupidly went and took a nap and scrolled through and about had a heart attack. At first I thought they requested Pawel’s testimony- but then realized Petu! The last person I would have considered! I wish I k ew whether to be encouraged or to jump off the building. Good catch guys on the 6/1 bs 5/24 issue of seeing FD. I never caught that and I watched it twice. Maybe one of them recalled that and the others didn’t. A question / if they want to listen to LE interviews can they do that alone or have to do in court? That’s what I’d be wanting b to view .

The State’s timeline is seamless.

Petu says she saw MT in the morning of the 24th (after the alibi call and before FD comes home). This is MT’s “down time” on the murder day. So it behooves MT to engage in business as usual activities because she has to fill in her script with innocent activity. FD not back with the blood, so it’s possibly easier for MT to act and appear “she has no idea” when she meets Petu and/or because MT is acting normal because she is in cover up mode.

Petu testifies to 4 texts or calls from the airport - can’t corroborate without MT’s phone. No idea about length. Seems fleeting - 4 text exchanges can be 1 minute in total. Why didn’t the D offer Petu’s phone records if they were helpful?

I just don’t see how Petu’s testimony about the 24th conflicts with anything on the known timeline. Petu wouldn’t be looking for suspicious behavior on the 24th, so her memory of that day would register as normal.

It could be one juror who wanted to see it - from which we can’t assume all the jurors wanted to see it.

Wild card issues:

Fires - Petu herself said fires were for relaxing which the State shot down as being not possible because they happened during brief turn around trips between JC and MS. Anything but relaxing. And I cannot imagine any juror given the context of that day thinks the fires were a coincidence.

Language - I can’t imagine this Jury needs Petu to make an assessment about MT’s fluency after listening to the interview tapes. Also the D did not show any examples of where a language problem may have been confusion versus straight up lying.

Moving to Colorado seems like noise.

Police bias - maybe but it’s not enough to erase the facts in evidence.

MT is “upset” about Jennifer being missing? Just doesn’t seem weighty enough considering everything else in evidence.

Ugh!
On the fires, I wish the state had asked if she leaves her house with multiple fires going?

Fires in Argentina are typically social in nature and people hang out and drink and eat.

The fires of MT were simply not this and I hope this is clear to the jury.

The MT is 'upset' about Jennifer is interesting as in the interviews MT never expressed any interest in this topic. My guess is MT was afraid of getting caught most likely.

I am bothered though to seek a rewind on Petu as she was probably the least credible witness and there was no way to tell whether any of her timeline data points were true as there were no phone records or no surveillance submitted either.

MOO.
I am concerned that the jury wants to replay Petu because MT was “talking to Petu” while the Albany trash dumping was happening and that’s MT excuse she “didn’t know what was in those bags” etc.
Petu goes on about being at the gate at the airport talking to MT on the phone…

I’m not as optimistic as some of you.
I have to say I agree. I listened to the entire playback and tried to pick apart what they could be looking for, that would require them to reflect back on their notes, or take additional notes. I think the information they were examining had to do with her visit to the store, and the texts that went back and forth that evening. I think I heard Petu indicate that the texts (they were texts and not phone calls, right?) took place around 7 pm.

Because she has the information that will prove she is innocent! Because she just is!!! Good grief, I hope this jury isn’t as dumb as I now fear…
It’s seems like everything in America is falling apart. Our Country is changing and so are people. The economy, politics, crime, gun violence, lower standards, rules, laws, racism, activism, genderism (if that’s even a word, yet), illegal immigration, the military….my God it just goes on and on! And We The People are the ones sitting on juries today, making the decisions. God Save America.

The jurors can look at the phone report to see that's a lie
Do they have MT's phone report? I didn't think that was part of the record for some reason.

Petu doesn’t help with the phone manipulation.

They don't have the phone of MT because Judge R ruled it out. They do I believe have the data from the phone of MT which they gained in a later filed Search Warrant. MOO

If even one juror catches that she lied, it will discredit ALL of her testimony and her testimony should not be considered. This case and other cases disturb me when it happens and a judge doesn’t just throw out the testimony.

Let's hope the easel juror catches it.

I saw on L&C that jury has returned to deliberations.

My guess: to replay any testimony, I think there's a rule that they have to replay/listen-to all of if. This assures that that.

JMO
And I *think* to replay testimony, it is always done in the courtroom and not in the jury room. But I may not be remembering that correctly from other trials.

In CT, does the jury have to be unanimous in their verdict?

  • #175
Yes, but what really bothers me about this and the Mini Horn delivery is that all of this is being done WITHOUT corroboration. This testimony is effectively pure hearsay and could have been cobbled together from whole cloth which imo is precisely what the Defence did here as we have seen them to have no scruples in their tactics.

Stunning if possible lies blow this up in the jury room.

Nobody knows who Petu is, nobody knows if or even why she should be believed either.

Does anybody on the jury see the clear pattern in the testimony delivered by each witness for the Defence?

Perhaps they do or maybe they don't.

MOO
I can’t believe the prosecution didn’t catch her in that lie, when she said after 5/24, she never saw fD again, and also said that she saw him on 6/1. If the jury doesn’t catch it themselves, they won’t be aware of her blatant lie.

I wonder exactly what it was that Petu could offer the jury a second time around? After all this discussion, I still wonder. She seems lame to me. Oh and she is a liar.

If Petu had information that exonerated MT or even corroborated any part of MT's defense, the Defense would have put that out in 48-point font. Petu's phone records, for example.

Petu accounted for about 37 seconds of MT's time, post lunch. It falls flat.

So since I missed this replay in court, did anyone note any “looks or pleasure” from the defense on the Petu testimony request?
