The motion from State’s Attorney Richard Colangelo Jr. filed Wednesday seeks an “order preventing the parties from making statements to the media or in public settings that post a substantial likelihood of material prejudice to the case.”
The one-sentence motion asks a court to enter an order in the case preventing attorneys involved “that the lawyer knows or should know will be disseminated by means of public communication and will have a substantial likelihood of materially prejudicing an adjudicative proceeding in the matter.”
Fotis Dulos’ lawyer, Norm Pattis, said Wednesday he was preparing a response to Colangelo’s motion. He said the prosecutor should focus his time on preventing leaks from law enforcement related to the case.

I thought the same. Perhaps the "garage repair man" did not know she was home. Speaking of burning down, I thought of the Folly Farm stable fire. Coincidentally, JD's children rode there. That may have been a message too. Hmm...MOO.

@gitana1, thanks for trying to piece this together, I have missed you and your family court commentary.

The criminal documents are available online but like the Dulos divorce the family court documents are only available in person (if they are unsealed). The reporting on the sexual assault case is really I think just from 2 articles that posted recently and its very hard to figure out everything that had happened in the past with this couples very contentious divorce.

Do you see any possibility of FD being charged for his role in circumventing the protective order?

I wish I had time! Is the victim in the criminal case against Mawhinney the same wife who was just denied a restraining order?

No I don't think FD would be charged.

I’m betting “nobody” knows who this guy is; if you asked KM, I bet he’d say that he never sent any “garage door repair guy” over. Maybe the guy wasn’t even there for Mrs. KM...maybe he showed up hoping to find KM there, and he was really there to take care of KM. It wouldn’t surprise me to know that KM is on at least a few people’s hit list.
I would love to hear the repairman's version of the events surrounding the repairs. It could possibly be innocuous. KM could have a handyman who lives and works off the grid for cash and just surfaces when he gets around to it. Someone who could seem intimidating just by their appearance and communication style, particularly if you were already on edge and with a jerk like KM in your life who wouldn't be? JMO

Also wonder if this is being done in advance of more charges dropping on FD and MT?

No I don't think FD would be charged.
@gitana1 Yes victim=KM spouse, KM is accused of sexual assault and a few other things against a spouse. FD was acting as intermediary to circumvent the no contact order that seems to be in place.

OT: State just filed for gag order in criminal case! So glad to see this finally happen. Better late than never IMO! Be well!

Well, horse farms do pretty well on their own, as far as fires go. There are lots of innocent ways for horse farms to catch on fire. For instance, hay is not only highly combustible, but it frequently starts the fire spontaneously. If you are ever near a bunch of hay bales, stick your hand between them-you would be surprised at how much heat is generated. Additionally, there is frequent use of space heaters and fans, which cannot, but frequently are, left unattended-plugged into questionable outlets that overheat. This happens even in stables where you are paying thousands of dollars per month to board. But I am not saying that FD or an associate COULDN’T be connected with a fire that kills a bunch of horses
Very true. But I found it quite curious that an electrical receptacle in the water heater closet was found to be the cause of this one. JMO!

I totally agree! I ride and the last barn at which I took lessons had floor fans (during the summer) all over the place - some had extension chords. I was surprised and recall thinking at the time that it was a fire hazard!

I totally agree! I ride and the last barn at which I took lessons had floor fans (during the summer) all over the place - some had extension chords. I was surprised and recall thinking at the time that it was a fire hazard!

That is exactly what I’m talking about! It’s scary! I work for someone who has horses in the barn on their property-at least these people turn off the fans at night because of the hazard, there’s no electrical near any water, and space heaters are never used unless someone is actually in the barn. There was a terrible barn fire here in town years ago where all of the horses in the barn were killed-it was determined to be an accidental electrical fire, and it was heartbreaking.

Looks like FD is feeling victimized yet again. Yawn. When the only tool in your legal arsenal is to delay then these actions just seem oddly predictable IMO.

I wonder at what point the Judge in the Civil case says enough? The last order before all this back and forth on the bond request was clear. FD and MT both have to be deposed using the short schedule. How many times is FD going to test the Judge by not showing up for deposition? Will he make it 3 times as a no show?

Seems like the Judge's patience is running out and even though he denied GF last motion for Judgment I wonder if Judge will rule in her favor if we have another no-show from FD and/or MT? Also wonder if GF would/could pursue MT in a solo action given that MT was an employee of FORE and listed as Manager of FORE? GF has the means to do this and I'm not sure MT has the family means to support yet another potentially costly litigation.

Its disappointing that it is so difficult for basic fact finding on the part of the Plaintiff in what at its heart was a well established pattern of borrowing and repaying money to build houses. With delay in court IMO FD is hurting himself as it is his actions IMO that have damaged his business. Litigation represents risk to any business and most viable going concerns seek to minimize litigation risk. Not FD. If FD were concerned about FORE he IMO would have settled this case nearly 2 years ago and focused on keeping his business afloat. Something else IMO is causing FD to behave as he has in this civil case and the Family Court case. IDK what that might be but the pattern seen in this case IMO from FD is not one from someone that has a going concern and is concerned about their business reputation. At a certain level its hard to watch someone self destructing in the public eye, but that seems to be what we are watching so far as I can tell. Its inexplicable.

He knows all to well what an audit of his finances will disclose and there is no way out and no more money, he and his rented Kia are running on fumes. He is not Bernie Madoff, he does not have a staff to create years of false financials, let alone the supporting documentation.

If forced to liquidate his remaining holdings at a realistic price (as determined by a professional appraisal), in order to satisfy any and all taxes, liens, loans, judgements (GF), etc. of record, there won't anything left. If the IRS starts slapping him with liens for unpaid payroll taxes and income taxes, everybody else can just get in line. The IRS trumps 'em all, no matter what you recorded or when you recorded it, they have priority.

FD has been living the life of a rock star, without the income of a rock star. His travel costs alone have got to be astronomical, nothing less than first class all the way. This is a man who demands 5 star accommodations, eats nothing less than delicacies and drinks only top shelf alcohol.

Ridiculously expensive homes, the cost of maintaining those homes, heating and cooling them, property taxes, utilities.

Child support - scratch that one!

Payroll, payroll taxes, office expenses, costs of doing business.

Cars, the cost of maintaining and insuring them.

Water skiing equipment, coaching and competitions for him and the kids

Entertainment, fine wines, dining and gifts for MT

Designer clothes, shoes, the latest and greatest of everything! Fotis wins again!

A hollow victory for a hollow man. Shows over for Fotis the one hit wonder!
