I was going to play devil's advocate about MT not going to see her daughter in Chicago, there's usually more than one night of shows, and there was another show in this case.

The night before, when MT was cohosting a dinner party I believe?

JS is asking about the timeline. Did MT put the drive to Albany on the timeline? No.

Did she put the Starbucks on the timeline? No. Her last entry was 5pm [5:10pm? 5:20?]

JS shows new photos, witness identifies MT and FD in Starbucks.

And she told you she purchased a sandwich? Yes. And it tasted terrible and she threw it away? Yes

Did it mention PG and his dirtbike?
Did it mention the rug? Closing st 5:30?
Did it mention her daughter's program?
And mention of the police coming to the house to notify them?
Did it mention FD going jogging?

So it wasn't a complete timeline? Apparently it was not --

Many times in her interviews, MT specified activities and events in relation to what SHE was doing, that is separating herself from FD as though the interview's sole purpose was to determine ONLY her activities. One such example, is when she shows the map of the area behind 4JC. They ask about how often they (FD and MT) used the area with motorbikes and MT attempts to narrow her answer to what SHE did.

So, lack of entries mentioning PG and his dirt bike, FD going jogging, her daughter's program, and police coming to the house to notify them fits with what she seemed to see as the general purpose of the timelines - what was SHE doing (as though they were.... "alibi scripts"). And she seemed to see these interviews as the same - she considered only what she was doing relevant discussion.

McGuiness asks Kimball if there were times they said or implied that FD killed JFd. Yes.

Defendant asked if they looked in the house.

McGuiness asks if the witness thought the defendant's response was odd.

Objection. Overruled. Yes. Because she it was a skip.

State asks about Det Clavy saying FD killed JFd, a fact.

Defense objects. Says State is testifying. Overruled.

Showing another clip.

State says, after MT was told FD killed JFd, did the defendant say she saw FD that morning?

Objection, leading. Court rules leading but not unfairly prejudicial. Allowed.

Portico is an interior entrance typically to front of house (usually some kind of porch covered by roof) while so far as I know a porte cochere is designed for vehicles to pull up to house and unload and is covered by a roof/overhang to protect from weather.
Where I grew up (not in CT but further south), we often had a ’carport’ which is a covered area attached to a residence, usually not entirely enclosed, under which a vehicle (or two) could be parked. Out of the elements and as a way to prevent direct sunlight or weather on the vehicle. It was a wonderful feature IMO. (I am not entirely familiar with the terms in the antecedent thread message.)

Excellent line of questioning under redirect.

Defendant was NOT lacking in sleep, tired, dizzy, or under arrest at the time she prepared the handwritten timelines (which perfectly matched her initial interview claims).

State asks witness if MT answered with what she usually does when they were trying to elicit what she actually did that day.

Big objection. Judge schools leading ... not leading if it's reviewing what was just shown in a video.

Now asking about the condition of the defendant. Was she dizzy? Did she say she was overtired when she wrote the timeline? No.

Objection, says he never said that about the timeline.

State asks about Albany and Starbucks not being in the timeline and whether he found that strange.

Objection, overruled

Yes found it strange because of the om

ission of something that could be incriminating.

State asks about the timeline and phone log handwritten by the defendant. What language are they written in. English.

Did the defendant say she was malnourished when she wrote those? No.

State asks the witness if he recalls being asked about interrupting the defendant? Yes. And sometimes without? Yes. And was that to direct her? Yes.

Did the defendant say -- or counsel -- that she relied on her phone to recall times? Yes.

State asks if the defendant was brought in willy nilly or was there a search warrant?

Objection. Judge can't recall the defense saying willy nilly.

McGuinness asks Kimball about weather maps. If they can be challenging to read.

State asks if MT was a little annoyed to learn FD had been at JFd's house? No. She was angry. Threw her phone. Felt disrespected.

State asks the witness about the defendant offering to dig holes. Witness says the defendant said she thought JFd was hiding. State asks if she said she thought JFd was hiding bit she offered to dig homes?

Objection.

State moves on.

At EW school.

Did the defendant tell you she panicked because she'd seen too many terror movies? Did you find that strange?

Objection. Sustained.

State asks if the defendant ever tell you the Tacoma was at 80 MS? No.

What vehicles did she tell you about? The Suburban, the Raptor, the Cherokee, the Porsche.

State asks about the number of stops recorded. State asks what's visible in the bed other truck?

Objection. Double objection. ( JS says that the witness' opinion of what he thinks he saw is irrelevant. ) Overrruled.

After he turned off Albany, what did you see?

Objection, overruled.

Det. Kimball was the Affiant for the Arrest Warrants for FD, MT, and KM. Those documents were works of art - clear, succinct, relevant summary of all material facts (known at that time) supporting probable cause for charges and arrest.

Praying the next such probable cause document in the Suzanne Morphew case will be more like Kimball's.
