I agree with you guys. there is no question JK intended to kill Dr. Petit. He didn't finish him off immediately because he was unsure as to whether or not they would need him to get the money from the b ank or as leverage against the women/girls. But clearly they intended to burn him up. In fact, it was JK that found he had escaped and he did that when he went downstairs. Why did he go downstairs? To say goodbye? To thank him for his hospitality? No, JK went down there to pour gasoline on him and/or hit him with the bat again. Once he saw Dr. Petit was gone, they had to just dump the gasoline, light it and get out. The rest of the plan was shot. I have no doubt JK hates Dr. Petit because he sees him as the reason he is on trial now. Dr. Petit ruined JK's life, not the other way around, according to JK's twisted reasoning.

Just typing out loud here, and absolutely no offense towards innocent parties intended, but I'm wondering if any part of the rage JK has directed at Dr. Petit, the father figure, comes from JK's anger at his own father for not "saving" him. JK seems to blame everyone but himself for the monster he became.

I agree. And she doesn't. Hasn't seen him for over 4 years. She's only barely 9 now.

A DP sentence doesn't mean JK will actually die by the state's hand. The years and years and years he spends in appeals will ensure he is alive, breathing for at least one and possibly 2 or more decades.

That makes the assertions in this guy's blog irrelevant since JK's daughter will have ample time to "seek him out and get to 'know' him." In 9 more years she'll be 18 and will have all the rights and privileges of 18 yr olds.

This trial and the penalty phase are not about the rights of the 9 year old though, which is what pattisblog tries to argue. :banghead:

You know...I don't condone the death penalty, but JK really makes that difficult for me.

I understand that different people handle trauma in different ways. I understand that a lot of the things JK has been through are enough to mess somebody up. However, I hate that he uses molestation as his defense for the unspeakable horrible crime he participated in committing. I was sexually abused for years as a child and through my mid-teenage years, and I turned out to be a well adjusted person, college graduate, engaged, no criminal record.

I'm not in any way saying that every abuse victim should be a certain way; I understand that everybody is different. But many people are abused and molested - while I am so sorry they had to be victim to such a crime (no one should ever have to experience that) that does not give them the right to molest and murder and steal, and it certainly should not be a defense by someone who brutally murdered three people.

JK is clearly not in his right frame of mind (you can't be in a right frame of mind to commit such an act as he did), but he's not insane. He knows right from wrong. He disgusts me, and if he gets the DP, I won't be too broken up about it.

Anyway, when is the defense estimated to wrap this up? I don't blame them for trying to save their client from the DP; I know they're just doing their jobs, but I can't help but wonder how much longer they plan to take during this phase of the trial?

I'm not anti DP but I agree with you cece; they need to wrap this up!

I find it hard to mitigate something this horrific - the fact that not everyone who is abused chooses to hurt others does make a difference to me. Why should we be merciful to JK when others rise above?

Oh, I completely agree ziggy

Even though i am not a big fan of the DP, if I was on the jury, I would be having trouble understanding why I should try to show JK mercy, especially since so many other people can rise above it or at least refrain from a life of crime like JK's.

I don't see JK as being remorseful and I find the way he called Dr Petit's daughter "KK" (as if they were close or something) absolutely disgusting.

Does the prosecution get a rebuttal after this? I'm not familiar with the sentencing portions of trials...

As a judge decides whether convicted triple murderer Joshua Komisarjevsky's nine-year-old daughter should testify in the death penalty phase of his trial, RadarOnline.com can exclusively reveal that he was considered a caring parent right up to the night before the killings.

Caroline Mesel was Komisarjevsky's girlfriend at the time of the July 23, 2007 home invasion in Cheshire, Connecticut and has now exclusively opened up to RadarOnline.com about her experiences dating the single father.

As RadarOnline.com previously reported, Komisarjevsky was found guilty of 17 counts on October 13 for the grisly murders of Jennifer Hawke-Petit and her daughters, Hayley, 17, and Michaela, 11, and the vicious beating of their father, Dr. William Petit, but the cold-hearted killer had a different side to him.

"His daughter was adorable, he loved her to death. He was a great dad," Mesel told RadarOnline.com in an exclusive interview, as she revealed how 31-year-old Komisarjevsky cared for his then five-year-old daughter.

Joshua was granted sole custody of the girl two months before the murders after being embroiled in a bitter custody battle with her mother, Jennifer Norton, who was being treated at a crisis intervention unit.

At that time, Komisarjevsky introduced his teenage girlfriend to both his daughter and the rest of his extremely religious family.

"I met his sister once or twice, I met his parents," said Mesel, who was even introduced to his criminal accomplice, Steven Hayes.

"I met Hayes, he was creepy. I don’t think even I looked him in the eye because he had a scary face," she told RadarOnline.com.

Despite meeting her boyfriend through her sister while he was in prison for a string of break-ins, Caroline said Josh "seemed normal."

"He seemed happy, he was always very calm," she revealed.

"I knew he’d committed burglaries, but I didn't want to pry into it - sometimes it’s better not to know about someone's past. The person could have changed."

The young couple began dating exclusively when serial burglar Komisarjevsky was released from a Connecticut halfway house but were limited on what they could do because of security restrictions.

"We went to the mall a lot, or we’d just drive around and go to my house or his as he had to wear an ankle bracelet," said Mesel.

Just weeks before the Petit murders, Caroline and her family moved from Connecticut to Arkansas when her pastor father got a position at a new church, but she kept talking with Josh every day.

"I spoke to him the night of July 22, he was weird on the phone and the last thing he said was he was going to put his daughter to bed," Caroline told RadarOnline.com.

"I had a weird feeling all night long, I couldn’t get a hold of him, which was odd because he would usually always have his phone on him. I had a bad feeling something had happened."

While Caroline stayed up all night fretting, Josh was hundreds of miles away breaking into the family home with Hayes and violently beating Dr. Petit, molesting Michaela and then setting the house on fire.

She didn't hear from him for the whole of the next day but when she heard the news of the triple murder, "I knew immediately it was him. I have a really good gut feeling, I have a sixth sense."

Caroline's suspicions turned out to be true, and apart from a brief phone call a week later, she has not spoken to her first love since and now doesn't care if he lives or dies.

"I go back and forth about whether he gets life or death. I just want it to be over with," she said.

What she is most upset about is the fate of his daughter and if she is made to appear in court.

"That is horrible if they make her testify, she’s only a kid. She was so little when it happened, what on earth could she say?" asked Caroline.

I havent been able to follow the trial too much lately. I wonder if anyone reporting it has mentioned anything about how the jurors seem to be reacting to all this testimony. I would think there is a possibility that at this late stage, day after day, the jury may be is beginning to just tune it out. I'm guessing most have already made up their minds what they will do.

Caroline Messels comments are very interesting. I also find it interesting that she was the daughter of a preacher. JK certainly was not driven away from religion by the things his parents did, was he? His comments and actions around his gf really show that JK was capable of putting on a lot of different faces and playing a lot of different roles when he wanted to. Notice how she claims he was such a great father and a wonderful guy, but when she heard about the crime the next day, she immediately knew it was him. Wow. Apparantly all along she knew he was dangerous but was willing to buy his stories and act anyway. That shows how dangerous a man JK really is. The prosecution needs to point that out in rebuttal. he has fooled a lot of people along the way and keeps fooling people even now. Any maybe someday, he'll fool a clemency or parol board.

Agreed. JK is a sociopath. Much like Casey Anthony. She too was able to fool people into believing she was a good mother. But since she murdered her daughter we all know that Casey was not the mother she portrayed to the world.

And JK will never be paroled. His choice is life in prison or death. However depending on the prison he goes to he could be assigned a prison job that could allow him a chance at escape which would put the public and the prison staff at risk.

JK is a dangerous person. And if he's not heavily monitored there is no limit to what he could and would do.

The reality of this is that JK will never be put to death, even if that's what the jury gives him. But if he's given death JK will have less of a chance at escape, conning more people, or kill prison staff. If given death JK sits in his cell almost the entire day instead of general population that is able to roam and perform prison jobs.

And according to twitter accounts Judge Blue has indicated that the penalty phase will last up to and through THANKSGIVING!!!!!!!!! They will get to deliberate the first week of December. That's Judge Blues best guess.
