Defending Misty on Jan 10, 2011 in Putnam County

I have not posted in a while, but I have been thinking of Haleigh and this case daily in hopes that there is some type of closure for Haleigh.

Not sure if it will be 9 More days until Misty's next court date, will it be postponed since all of the PC cases now say (ACKNOWLEDGMENT OF NEW CASE SC10-1989). Anyone know when her case will be heard in the Supreme Court? Sounds as if PC cases will be put on hold until her case is heard in the higher court. I could be wrong though.

There is a lot that we were not privy to when it came to the UC Videos and I wonder if Misty will get out of the charges in PC and if so why didn't her attorney file for an appeal in St.John's? Or did he and it just has not been posted on the docket yet?

In one of the videos it sounds as if the UC asked Misty of Ron gives her any of the drug money. She says yes, he knows better especially since nobody wants to hire her.
In the video with Donna, I see that Donna has the bottle of pills and hands them over, not Misty. Ron in most of the videos brags about how he can get more pills, counts the pills first, and claims he could eat them himself.

I am going to take a wild guess here and say that maybe the reason Misty's case went to the supreme court is because there is much more to see in the UC videos, for example. Who was the real ring leader? Who gave who the pills? Who collected the money in each transaction? Also, did they not start this operation when she was still 17 but made the arrest when she turned 18? Could that be something else that may help her get off these charges in PC? Each one says ACKNOWLEDGMENT OF NEW CASE SC10-1989.
:waitasec: Misty has a new case, I am going to take a guess that this is the case that went to the supreme court? Could it be that there is video of that incident proving other?
Wouldn't it be something if Misty was working with LE during all these drug deals and they turned on her?...I know, I am just praying for a miracle.

I have often wondered if LE had not been watching RC and MC for a lot longer than just one month prior to their drug arrests. It could very well be that they got Misty on tape dealing/trafficking/whatever the legal term would be, before she turned 18. However, the videos that were released show transactions after Misty's 18th birthday. The charges levied came from Misty's transactions as an adult so there is no way Misty could at any time have argued that she was a minor among adults in any of the transactions. Per Florida law, one is not required to actually touch the merchandise to be legally charged with trafficking, so who did or didn't touch the pills will likely carry no weight in a legal argument.

IMO, Misty does have a chance that a higher court may rule she should have been considered for Youthful Offender status since these are her first offenses as an adult. The YO provisions provide for multiple charges to be considered as "a stream of offenses" which, in certain circumstances, can make young first-offenders eligible for consideration for Youthful Offender status even in the face of multiple charges.

I do not believe the chances of Misty winning on appeal are very great, but have to consider that the possibility exists.

Wouldn't she have told by now if she could actually remember ? would her sentence have been reduced?

But will a judge be swayed? maybe, but maybe not, because of Haleigh. If she wants a break, & I think she's due one, she needs to come clean on Haleigh. If LE has evidence that she killed Haleigh, or was an accomplice, they really need to charge her, & stop dangling suspicion, in front of judges. That shouldn't be legal. the same with Tommy. Ron struck a deal, so LE needs to make him earn it. IMO, his attorney reiterating that Ron picked Haleigh up from the bus stop, points to Ron still withholding information. & that's unacceptable. If his stories don't match witness accounts, lie detect him. LE can get to the bottom of this mess, with lie detectors-past & future.

& when I say, 'targeted as a minor', I mean...when did the undercover guy, 1st make contact with her. When did he befriend her, when did he place his 1st order, etc...it might not be illegal, but it might go to show a calculated frame up. & considering her age & lack of priors, I wouldn't think a judge would play too freely with the minimum mandatory thing. If she's eligible for a lighter sentence, I think a judge should give it some serious consideration, & then tell LE to go solve the Haleigh case.

I am not aware if Misty, Ron, or even JR. were drug tested when Haleigh was first reported missing. Not sure if they were tested after the drug sting either. It's information that the public has not been privy to, not to my knowledge anyway. LE pretty much keeps everything close to the vest and IMO that is one reason why so many rumors started early on IMO.

dodie20 I agree Misty has been LE's target since day one. I noticed last night that there is an appeal pending for her charges in St.John's. All of her PC charges say ( 55 ACKNOWLEDGMENT OF NEW CASE SC10-1989 filed on 10/25/2010). So if all 7 or so charges from PC are new cases and the cases in St.John's are on appeal IMO there is something big going on. Maybe LE made many mistakes during the drug sting and also violated her civil rights with such high bonds and much more I will assume since their is a new case in a higher court.
I also recall when Misty wrote to the Governor/Mayor if I am not mistaken for mistreatment & or other. I am not saying that she should get special treatment, just equal treatment and IMO I feel that LE and the Jail did mistreat her. I have to keep reminding myself that people are innocent until proven guilty because it's hard to have any sympathy for someone like Misty. But fair is fair and I don't feel neither Misty or Tommy were treated fairly. Something fishy in PC IMO....

If there are no further continuances, Misty is due to be sentenced in Putnam County Court on her remaining drug charges.

She is appealing the SJC decision, so IMO, it would make sense to pull out all the stops to try to get as light a sentence as possible here in PC, which probably means there will be no effort made at all. :waitasec:

If Misty had pled not guilty and forced this to trial, would she have been likely to get any worse than the min. man. sentence? Even if she was sentenced to 30 years a pop to run consequetively, IMO attorneys would be lining up to head her appeal and get her sentence kicked, and IMO they would have won. I still just do not get how Misty, OR Hope, OR their respective attorneys did not work out a deal for reduced charges in return for pleading no contest.

IMO, if Misty can't do a better job of making herself look more sympathetic than she did at the last sentencing hearing, she's looking at another 25 years, and her SJC appeal is just a waste of everyone's time.
