The poor woman out in California whose 8yo is missing---I've not seen her composed on camera yet, the poor thing. I've not seen tears of fear from any Anthony yet. Wonder if the jurors will think of that.
 
My theory is that the story will be as follows:

Casey was being stalked by a "friend" in the months leading up to June 15. She thought she could handle it because the "friend" was just showing up at places she went and Casey was kind of flattered by it plus the friend would babysit Caylee for free. So she didn't go to police about it because she thought it was no big deal. However the "friend" was secretly angry and jealous of Casey and the "friend" asked Casey to do something which she refused to do. At this point the stalker, feeling rejected by Casey put a plan into action to destroy Casey. When Casey and her mom had the big blowout on June 15, Casey was suddenly vunerable and in the perfect position to enact the plan, so the stalker was there to listen to Casey and be a shoulder to cry on. The stalker offered to take care of Caylee while Casey moved in with Tony since Caylee wasn't welcome at Tony's place overnight. Casey agreed to this arrangement and moved in with Tony having no idea that the stalker planned to kill Caylee and frame her to get even with her for the rejection. Or possibly the stalker killed Caylee because Casey refused to move in with the stalker. Stalkers often kill whatever their victim loves most and the stalker killed Caylee to punish Casey for rejection. The stalker had a key to the Anthony house and possibly a key to Casey's car, it is possible that the killer killed Caylee in the house and went through the house choosing items and planting evidence. Casey may have been trying to get Caylee back and it is possible that the mysterious small depression in the Anthony yard by the pool was a place where Casey had buried either money or contraband that was worth money - because if she hid it in the house, Cindy would surely have found it during one of her cleaning sprees. Casey borrowed the shovel from the neighbor to dig it up in hopes of trading it with the "stalker" for Caylee. By happenstance the stalker saw Casey's car parked at the Amscot and initially put Caylee's body in the trunk of her car, but thought better of it and took the body back out leaving behind leakage from the body which Casey mistook for squirrels. It is possible that the day the neighbor thought he saw Casey back into her parents garage, the killer had actually "borrowed" Casey's car for the task of disposing of the body. Casey had no idea this happened because the car was out of gas. Casey's parents got the car and got Casey. The police were questioning Casey, but she had no idea Caylee was dead and she figured her "friend" (the stalker) had Caylee and didn't want to get this person in trouble so she lied to police and led them on a wild goose chase. I think that initially Casey didn't understand the seriousness of her situation. But she wound up making herself the number one suspect and being arrested, whereupon she got an attorney who terminated any further communication with LE. Still thinking everything was OK with Caylee, but concerned about the odor and Casey hoped her friend would return Caylee, so Casey kept silent. Then she was arrested for murder, but Casey still hoped to get Caylee back. Then the body was found and her attorney had previously told her not to discuss anything that happens with anyone and the truth will come out at trial.

This is why her attorneys are stating that Casey is innocent and never should have been arrested in the first place.

I also want to point out that since the case is purely circumstantial, with no direct evidence tying Casey to the crime, that it is very easy for the prosecution to build a case by simply selecting that circumstantial evidence that points to her being guilty, yet we have not seen or heard the evidence that might point to Casey's innnocence. In every case, there is always both kinds of evidence. So although the evidence we have seen looks really bad, nothing can be presumed until evidence of innocence is presented in at the trial.

In this theory, the stalker is someone Casey knows, either male or female, who probably had or hoped to have a sexual relationship with Casey. This person was jealous of her relationship with Tony. This person wanted to hurt Casey as badly as they felt she had hurt them.

I'm not saying I believe any of the above, but this is what I theorize that the defense will put forward.

You know, Jon, your post made me think. This is JMO, of course, but I don't think there's any chance that JB will use the "Nanny Did It" defense, because I don't see how he could without putting KC on the stand since she is the ONLY one who can attest to the supposed existance of her. And I think we can agree that it would be in their best interest NOT to put KC on the stand. (although I'd LOVE to see it) So, many people are speculating that JB will have to attack the forensics in order to sway a jury, having really nothing else but KC and all of her lies to use as a defense. This is clearly a chief reason that he has brought in LKB and HL and some of the others to help in knocking down any forensics that the SA may use at trial. Now, wouldn't it be great if they had enough "other" evidence that they could really limit the forensics to a minimum? Of course, any fingerprint or DNA evidence would be great, because I don't think there is any way they can blow holes in that enough to sway a juror. But, if they could keep the "science" down to a bare minimum and stick to hard, cold facts that anyone can understand, they would practically block JB from having any defense at all and he would have to deal with the facts and not be able to put up too much of a smoke screen. I'd love to see that!

I think that's exactly how the prosecution should handle the case. Just like you said...keep the forensics to a minimum and concentrate on the 31 days, partying, stealing, tattoo, not a care in the world lifestyle, linkages from the crime scene to the home, the awful smell that at least three people and two cadaver dogs detected, and on and on. No mother of a kidnapped child would act that way, period. She is obviously guilty as sin so why give the defense a chance to drag the trial out and distract them from the 'common sense' stuff? Even the video tape of her reaction to the news...they don't need it. It could go both ways. Defense could say that's how a grieving mother would act. The prosecution could say she knew she was caught red-handed. It really is a simple open and shut case if they keep it that way. JMHO
 
PrincessRose-I think your theory would be a good way to explain why KC didn't show any sadness those days. However, if they are completely certain and have solid proof that this "stalker" killed Caylee, wouldn't they have them arrested or show this proof to LE instead of letting this person be out and about, able to do this to other people while innocent KC sits behind bars until this goes to trial (which could be 1-2 years)? And if this person was jealous of KC's relationship with TL why would they be willing to take Caylee from her for a month so KC could live with TL? Add to that the chloroform searches on the family's computer and traces in the trunk, KC smiling and laughing in court 2 months after her daughter's body was found, the fact that she wasn't buying anything for Caylee at Target, not trying to make any contact with this person to check on Caylee, her total lack of concern that first phone call to her house from prison, and the fact that KC has a known history of lying to impress people (therefore why wouldn't she lie and say she has an obsessed stalker as an excuse to cover her butt) and I don't really think that defense would fly. Also, if she switched her story to this wouldn't that require her to take the stand? If I were the defense I would't attempt even trying this strategy just to keep her as far away from that stand as possible!
 
Do you know what continues to puzzle me though? All of her friends and most of the family say that KC loved Caylee and was a great mother. She did some of the things but didn't do all of the things (i.e. have a job, your own place, etc.) to really provide for Caylee. Even once this case is done I STILL wonder WHY. And on top of why did KC REALLY think she was just going to be able to live life as if nothing happened. This is why I'm puzzled. I don't think its possible that to even assume you could just continue to live your life when your child just disappears. Something with this story STILL isn't right but I guess we won't know all the details until trial.

I get that there could be a possible motive (jealousy or just wanted to party) but its the fact that the body was IN KCs car and that the body was then disposed of has me going KC did all of this AND was partying? Why? It still all goes back to why. Yeah she will probably be found guilty and sent to prison but will anyone ever know the REAL reason why and who if anyone helped her. KC isn't THAT smart and while a lot of mistakes have helped the police solve this case I still think she couldn't have gotten THIS far without some help.

LE didn't have a body, witness, confession or weapon and Casey managed to get past being a POI and put in jail in less than 24 hours.

She also got George and Cindy to believe lies for 31 days.

There wouldn't have been a heart that could be tracked to Casey left with the body. Caylee wouldn't have been put in the hamper from the Anthony's house. The Pooh blanket wouldn't have been left behind.

If Casey had had help her car wouldn't have been left in a public parking lot for days with its registration in the glove compartment and fluid from Caylee's body all over the trunk.

Along with Cayle's hair and remains in Casey's trunk, Casey's ID was in the front seat. So was Amy's resume with Amy's phone number. The tablet with Mrs. Tony L. written all over it was in the car too. It is almost like Casey drew a map to her "hide-out".

Casey kept her phone with her and used it almost 60 times a day so that her every location could be pinpointed almost down to the minute (effectively eliminating almost every possible alternative suspect).

Casey described her car as smelling like death...in writing. She also glowingly complimented the nanny she was trying to set up (in writing).

Casey even posed for pictures out partying a couple of days after Caylee died.

I could go on, but my hand hurts from writing...Who else but the woman who signed her own name to forged checks in stores with video would so poorly execute a murder?

I agree, this is not a well thought out or executed plan at all. That is why I do not go along with conspiracies and theories about a premeditated plan.

Wow, you're right, it's like she subconsciencely wanted to be caught. She did tell Lee "maybe this should have happened a long time ago" when she first came home on the 31 day...
 
There is no explainable reason for her actions and JB doesn't even have anyone slated to explain her actions. Thats just BS. As I state above, all he is going to do for his defense is tear down the prosecution case and hope he can get reasonable doubt. I would think the jury will fiind it odd that there isn't 1 friend or anyone testifying FOR her. At least not that I can see. Maybe he will put some shrink on to explain her actions after Caylee went missing but I doubt it. That opens KC up to a big can of worms if he puts a shrink on the stand.

Especially a.n.n.i.e judging by her myspace message "keep talking s@#t b@#$h, you're making me famous" ofcourse she may not be talking about KC but....
 
IMO the defense is going to have a really hard time explaining one of these two things, depending how they play it out: 1) If she knew who had her child or killed her child, why isn't the defense out looking for this person?? Why are they letting KC sit behind bars while this person is roaming free, able to kill again and 2) If she didn't know who had her child and maybe Caylee was randomly abducted, WHY did she not call for 31 days?? They can't play it out like they did in SP or OJ's case where anyone could have done it..if her child was abducted randomly, any mother would NOT have waited until she was forced by her own mother 31 days later to report it. KC's excuse for waiting 31 days was to buy time, that ZFG was giving her until Caylee's bday. This wouldn't be the case if it was someone random that KC didn't know. I honestly don't know where they could possibly be going with this defense

Ok..I have always been sure that Baez, et.al, are going for the SODDI defense... and very recently, I am wondering if they are going to try to pin it on KioMarie.... (NOT that it would work) but.. I can almost see defense claiming it because
1. She had wanted to adopt Caylee from before birth.
2. She told LE about the area near where little Caylee was found.
3. She (and Casey) hung out in that wooded area as teens
I had thought of a few more little things I could see the defense trying to twist about Kio... (altho Im not totally sure they are 100% true or just rumor) but supposedly
*the house at 4709 Hopespring, the Zenida Hernandez there is related to Kio...
*also Kio has relatives at the complex that KC claimed Zanni's relatives lived..
*IIRC, Kio lives near the airport.. so I wonder if defense is going to say thats why KCs phone pinged so much around there..

Still they will have to explain why there was decomp in Casey's car... the Chloroform searches..not reporting Caylee missing..
I just have a weird feeling that KC's current "fall guy" of the day is Kio..
 
I'm going to answer your questions from the standpoint I think the defense may use, if this is indeed the defense they offer. I want to say up front, I'm not convinced in any way that this is what really happened. I just theorize the defense may try this explanation:

There are several ways this could be explained - I've actually come up with about 10 different possibilities that would work and be very believable, but I don't want to post them on an open board. In general, it would have to be some complicating factor that would either make the stalker incredibly difficult to find or make LE incredulous to the point that they would be unwilling to arrest the person without absolute proof. As we have seen LE has really been focused on Casey and only Casey from the begining. They are utterly convinced of Casey's guilt. But the case remains entirely circumstantial at this point.

In this theory the stalker told Casey they would take Caylee for a month, but really planned to kill Caylee from the very begining. Casey had no idea this person was jealous and plotting revenge. The person always acted like her friend. The stalker was merely taking advantage of the situation of Casey's fight with her mom and Casey and Caylee being out of the Anthony house in order to get Caylee away from Casey. The stalker may have even lied to Casey about taking Caylee on a trip. Basically, Casey thought she was entrusting her child to a friend. But the friend was anything but a friend.

Add to that the chloroform searches on the family's computer and traces in the trunk,

Could be Casey saw the "Win her with chloroform" pic on Ricardo's MySpace and looked chloroform up because she didn't know what it was. Maybe they were experimenting with the chloroform for other reasons or he asked her to make some for him and offered to pay for it - it's really not hard to make, especially if you have pool chemicals and household cleaners and such and Casey did need money. What I'm saying is there could be a more innocent explanation for this. Also if the stalker had access to the Anthony house (Casey said she gave Zanny a key), this person may have done the suspicious searches logged on as Casey. It is possible that this person really was watching Caylee for Casey from time to time and doing so at the Anthony house while everyone was out. Casey may have given this person her password so they could use the computer while there. This person may have been planning this for a long, long time. Maybe the stalker was planning on using chloroform on Casey as well.

KC smiling and laughing in court 2 months after her daughter's body was found,

I have known numerous people who lost young children (in several cases to cancer, in another to pneumonia, in another case, 2 infants (part of a group of triplets) who died of Strep A within a week of their birth) and most of these parents were not crying day after day for months on end. They dealt with the grief the first week or month, came to terms with it and moved on because there was nothing else they could do. They miss their children who are deceased, but have moved forward with their lives in the belief that they will be reunited someday. The one couple who didn't move on started over eating and now, many years later, weigh over 300 pounds each. Grief is different for different people. I think it is unrealistic to expect any bereaved mother to be crying and somber for months on end. Also, remember Casey is mostly sitting alone in a jail cell day after day. It must have been a relief for her to be out in a situation where she could talk to someone albeit briefly and even at court. Casey had already had 2 months to come to terms with the fact that Caylee was dead. And I do think that Baez is leading Casey to believe that she will be exonerated. Casey probably looks forward to seeing him because he gives her hope.

I think they will say this is because she believed Caylee was being taken care of so there was no reason to contact them. Or they may say the person who had Caylee WAS calling Casey, possibly using one of her friend's phone numbers. As to buying stuff for Caylee - I think they will say the "friend" promised to provide everything because he/she knew Casey had little money.

Because Casey didn't understand how much trouble she was in and really thought Caylee was fine and this was all an overreaction on Cindy's part.

She was lying to police to protect her "friend." At the time she didn't know this person had killed Caylee or how serious the situation was. She also had no understanding of the fact that she was in a situation where her parents couldn't bail her out.

No. Not if the defense is able to out this story in another way.

If I were the defense I would't attempt even trying this strategy just to keep her as far away from that stand as possible!

I completely agree with you. Casey didn't do anything to not get caught. In fact, she practically did everything she could to get caught.

I don't think she had help, this was all Casey.

They will just say there was no decomp it was junk science and the smell was from old trash. The chloroform search was in response to Ric. myspace posting of the "win her over". She didn't report Caylee missing because she thought if she did what she was told Caylee would be returned safetly.
 
I completely agree with you. Casey didn't do anything to not get caught. In fact, she practically did everything she could to get caught.

I don't think she had help, this was all Casey.

She even tried cashing fraudulent checks in clear sight of video camera's and signing her own name to the checks. Maybe she was even shocked at how long she got away with it....
 
I wouldn't be surprised if the JB doesn't go for some form of diminished capacity defense. MPD.. Casey has only just come to realize that she herself is "Zanny the Nanny," "Zanny's daughter" "a full time student" and she still has no recall of what she may have done to cause harm to Caylee...

Whatever the defense's argument may be, presenting it in a court room will be a real dog and pony show, if not a full blown circus.

I don't think its unbealivable. In fact many times fact is stranger than fiction. Orlando is full of strange crimes. I think this is exactly what the defense is going to say and I think they are going to pin it on Ric. He was the one who never said he loved KC until she started seeing Tony. He had access to her house, and car. I even think KC was telling her mom months before that Zanny was watching Caylee when it was actually Ric. That is why the photo's of Zanny's place were the photo's of Ric's place.
 
It appears there may be 3 threads of "defense."

First, JB is trying to set up a "shock and awe" and "trial by ambush" defense relying almost solely on a surprise rebuttal witnesses that he won't disclose prior to trial. This will then explain everything and show that KC is innocent. When he tried this in his last murder trial the Trial Judge did not let the video and expert into evidence because it had not been disclosed in the pretrial phase of the trial.

The second issue for his prior client, now a convict with appeals, is that JB was ineffective and he deserves a new trial.

The third issue for his prior client was to attack the trial judge and prosecutor accusing them of misconduct; that the trial judge and prosecutor had a "silent pact" to impose the most harsh sentence they could because a prosecution pretrial offer for a plea bargain deal was rejected by the defendant.

Since these three issues have already grown roots in this case;
1. Shock and Awe\Trial by Ambush: JB says at the time of trial everything will be explained and we will see that KC is innocent (surprise "rebuttal" expert).
2. Ineffective Assistance of Defense Counsel: Enough has been said on this in other threads but it would be a surprise if that was a defense attorney's tactic. Usually this is unintended.
3. Retaliation for Rejecting a Plea Deal: See KC's handwritten note on her declaration in support of a previous motion.

It appears we're going to see more of the same.
