Depositions Cancelled In Casey Case

  • #41
hmmm... all i gotta say is IF it was the defense's decision to cancel these depos at the last minute (and considering both Grunds, YM's and SH were all cancelled, I am assuming it WAS their decision) -- well, they better have one helluva good excuse...no, not an excuse, A REASON...a real reason to offer up to HHJP. Otherwise, there is going to be more than a "Bear in mind, Mr. Baez.." coming his way. More like a, "Too bad you couldn't fit them all in. They weren't available any Saturdays either? Maybe that won't handicap ya too badly. Next on the agenda?"

Isn't this supposed to be done by Friday???? Who else do they have to do/not do?????

Amy isn't done and she's only available on Saturdays when her boat docks. MC had a hissy at the last status hearing over it because the judge wouldn't force AH to take vacation days to come to Orlando and was forcing them to meet her in Miami on her schedule. BP said if they couldn't schedule her on time, he would.

JB isn't required to take these depositions. The "punishment" would just be that he doesn't get to take them.

If your client insisted you not depose someoe, are you obligated as her councel to follow that direction AZ? I sense this was cancelled on KC's insistance. She's afraid of what they might say IMHO.

Any chance the depos were canceled because Jose knows he is in such trouble that he may be asked by the judge to leave the defense on Friday? Can a judge do this, or does there have to be a hearing with evidence presented as to why it would be best if he did not stay on? You'd think that with all the complaints to the bar, his questionable handling of funds, and now the JAC, Laura Buchanon, and Jeremy Lyons, there would certainly be enough cause.

From the news thread:

Casey's Attorneys Want $12K More For Investigators
Jose Baez Files Motion To Double Investigative Hours

http://www.wesh.com/r/25516966/detail.html

So I guess there goes the plea deal theory....they cancel depos but want more money.

12k isn't much compared to the 350k they had and blew through...if only they were responsible. Then again, I think they knew these phony baloney PI's and other experts were a waste of time and money, so why not hold out and bill the taxpayers for it?

ALL this nonsense and complication over a very simple case.

From what we have seen before, the JAC monitors funds very closely and I can't see them making any exception for someone who has already spent a huge amount of funds unnecessarily and unwisely, and is barely able/willing to account for where that money went.. They are NOT going to pay expenses for out of State experts etc when they are available in Florida.

This is just a bit hard for me to watch. It kinda' like; your girlfriends dog sniffing aroud the corner of your favorite couch, all the while her saying, "Don't worry, he's house trained!@" :) :banghead:

Strange that they waited until the last minute to cancel? and for both of them???

wow. this is huge, don't you think? I remember my ex husband telling me that he was on a jury and they began by hearing a beautiful long convoluted opening statement...then the jury was excused..when they came back in they were thanked for their service and told that a deal had been struck. (ex was super-disappointed! His jury duty was over before it started). In a way THIS has that type of feeling. How on earth can all these depositions be cancelled??? and with the deadline in place...it smacks of something major...doesn't it? Certainly Jose can't possibly intend to come in and request more time from Judge Perry??? No..there is something else afoot here.

Won't it be a huge disappointment if there is no trial? Everyone is so looking forward to the trial! If they don't have one, let's have a mock one--I'll play Casey. I can make my eyes dart back and forth really fast, not to mention that I am super good at fidgeting.

Gotta wonder if Dominic sees the ironoy of him not gettng paid with jb was in charge of finances and this new pi's gettng reimbursed from an indigent defense?????

I believe DC will be happy to get out of this without OOJ charges, perjury charges in the civil case, or charges of tampering with evidence/corrupting a crime scene-and with his license intact.

I agree - does not sound like it was the Grunds decision to cancel at the last minute.
I'm thinking maybe there has been a medical emergency with a Defense attorney? Maybe ????

If it was an "emergency" on the part of the defense, then it came at a mighty convenient time....... so I guess they will be asking for that extension HHJP said wasn't going to happen without a REALLY good reason... :banghead:

Perhaps the State will go along with this...they've asked for an extension as well.

Judge Perry told both sides to give him a list of witnesses who were added after May 24, 2010 - who they agree that the DEADLINE for taking their depositions should be extended to December 31, 2010. The Judge calls these "late filed witnesses".

In this Motion, I assume that the State is just doing what the Judge told both sides to do.
The State's List will NOT include an extension of the DEADLINE for the Grunds, or Silvia Hernandez, or Yuri Melich.

That's the way I feel too ... they need a humdinger of an excuse as to why neither he nor Mason were available ... Perry will be less than impressed ... I want to hear "You're out in the cold, Mr. Baez ... no extension ... NEXT!!

I guess we'll find out Friday if Jose and the State were able to agree upon a list ... but was wondering if the State's Motion to extend had something to do with not being in agreement aobut these witnesses ...??

Can you imagine the look on JB face if the JP tells him No Way Jose to an extension and him realizing that the Lead Detective has not finished the deposiotion now that would be Priceless.

Denjet - see ThinkTank's post above - The State is simply complying with HHJP's request for witnesses listed after May 2010. IMO

I find it incredible that they have yet to depose Y.Melich after all this time.
From the curiosity standpoint alone I would just HAVE to know what his depo would be...

Sometimes I think Baez just wants to milk the cow for as long as possible.

Knowing that he will have to disappear back into relative obscurity must be frightening.

Or.. I could be wrong, and maybe he has a plan.

Strategery!!
