I'm left confused by this interchange. Is the judge saying that, if the States decides to call Dominic as a witness at trial, that they then must release the transcript of the investigative interview? If so, what is the latest date that we can expect to see it released? I just can't imagine that he won't be questioned at trail.
The State has Dominic on their witness list - he was added March 23, 2009.
The Judge was saying that if the State plans to use the TRANSCRIPT of Dominic's depo (for cross examination or impeachment of other contradictory testimony), then the State must file the TRANSCRIPT.
If the State decides to use the TRANSCRIPT of Dominic's depo in trial, then the State would have to file (release to the public) the TRANSCRIPT some time prior to trial. I don't know what Judge Perry's time schedule would be for filing such documents?
I believe the State is holding off on letting Dominic's depo TRANSCRIPT out, because it will give the Defense an advantage to know what Dom said to the State and what Dom will testify to.
I wonder when the Judge in the civil Zenaida trial will allow Morgan and co to depose Dominic?
