Gwinnett Man Gets Time Served after Sexually Abusing Captive Teen

After keeping a teenage girl in sexual captivity for more than a year, Michael Wysolovski will not go to prison.

The 33-year-old Duluth man was sentenced to 10 years with eight months to serve in jail after pleading guilty to first-degree cruelty to children and interstate interference with custody Thursday afternoon. He received credit for the eight months he was held in the Gwinnett County Detention Center before receiving bond in February 2018. That means his prison time has already been accounted for and he will serve the remaining nine years and four months on probation and must register as a sex offender.



Wysolovski was arrested in June 2017 after FBI agents and Gwinnett County police found a 17-year-old North Carolina girl who had been missing for more than a year in his Duluth home. She was malnourished, had ringworm and suffered from back problems because she had been repeatedly been held in a dog cage, her father said in a victim impact statement Thursday.

Time served? He gets to go home after 8 months in jail, after raping and torturing a 17 yr old girl that he met online, in a forum for anorexia patients?

He met the girl online when she was 15 through a forum for people with anorexia. She said she was unhappy at home and Wysolovski convinced her to come live with him. Once she was 16, the girl walked three miles from her Charlotte area home and met him on the side of an interstate. The victim spent much of her time with Wysolovski in a home in Decatur before they moved to Duluth.

Police found the victim after she tried to leave but Wysolovski would not let her, so she reached out to another person on an anorexia forum who contacted the FBI.

Because the victim was 16 at the time of the alleged sexual abuse, Wysolovski could not be charged with child molestation or similar charges. Georgia’s age of consent is 16. Child cruelty charges can be applied for crimes committed against people 17 and younger...

Also, not mentioned above is that the girl is autistic (high functioning). Her parents had done everything they could to try to prevent her from communicating with strangers online (they had some warning signs when she started wearing her hair in pigtails and using a pacifier), but she talked to this man through computers at school and her friend's phones.

There should have been a stronger punishment for taking advantage of an autistic teen especially IMO. I hope her parents sue him for every dime he has. With so little jail time, he will probably do it again. :mad: MOO.

And we question why these horrible acts continue?

Judges do not give punishments out that are harsh enough for the crime committed!

Oh, how I hate this...especially how the prosecutor brought up a"gray area" of consent/non-consent. The law needs to change. First of all, he groomed her when she was only 15. There should be no way for it to be okay to have a BDSM relationship with a 16-year old. No 16-year old should be in this "relationship", especially not one with emotional and neurological issues. This is going to stay with her forever, even as she heals.

I know that adults can have fulfilling BDSM relationships and that there are clear norms for the lifestyle, but it just seems so ripe for abuse and exploitation when one partner is young/mentally ill/emotionally vulnerable. It's almost like free reign for the worst among us to prey on others. And then there are the men who strangle women, then claim "she wanted it rough and it went too far". Of course he's going to do this again. Maybe even with worse results now that he's learned a thing or two.

What part of keeping her in a cage shows any kind of consent? I’m well past the age of consent, but that doesn’t mean I automatically consent.

I agree :( The article indicates written consent to aspects of this (food being withheld). And the girl and her family clearly didn't want a trial with the defense trying to humiliate and guilt her. Some of the BDSM norms that I'm aware of (I am no expert), like the safe word that he agreed to and then ignored, did seem to be considered by the court.

To my mind, the law needs to get much clearer with issues of consent, age, and mental and physical disability, and what "normal" BDSM is vs preying on someone, and whether BDSM could ever be a defense in a case where the victim is in their teens (definitely not, IMO).

sometimes judges do everything they can under the law
they can only impose what the law allows them to
