The latter scenario. There has never been any real proof that Heather was always in control of her phone. Just fits better IMO in that I don't believe she was killed at PTL. That is just where her car was dumped.

There also hasn't been proof she was in charge of her car. I wish we knew how thoroughly her car was searched, and if any evidence of a Moorer being in it was found, and if a cadaver dog was used on her car.

Are we absolutely certain the phone calls made from HE's phone to SM's phone at 3:16 and 3:17 were made from inside Heather's apartment? Was that in an official police report or straight from LE's mouth? If not, it opens up a pretty big window for whichever one of them might have been in her apartment and killed her (or picked her up and killed her) to have dumped her somewhere before the rendezvous at PTL.

We were down at MB in the spring, and my hubby was nice enough to allow me to sleuth all the areas, like the M's home, the boat landing, etc. and I have my own theory. It is as follows, and I accept any corrections if something doesn't go with the known facts.
We know that the M's were out and about that nite, having sex all over town, then SM calls HE from a pay phone almost as soon as she gets home. They were waiting in the apt parking lot for her to arrive. Then they go to the minimart to let SM make the call. HE asks, what phone are you calling from? SM tells her a pay, TM took my phone. HE relents, and tells SM he can come over, just to talk, and calls her roommate while waiting for him. TM drops him off and leaves, and SM subdues HE in some way, places her in her own car and proceeds to drive to the PTL landing, while calling his phone with HE's phone all the way, to tell TM 'I'm on the way there, meet me, so we can get out quick'. HE would not have been calling that phone, cause she knew TM had took it from him. They arrive at the landing, HE's body is rolled up in some thing, like a rug, and it is taken from her car and placed in the back of the truck, and they leave in record time. BUT the truck is filmed, and I hope to God, from above looking down and the rolled up item is shown, where it was not shown on the way in.
At this point, I don't know what they did with HE's body. Possibly TM's father helped, or someone else, or they burned it, or poured concrete over it. Or there are computer searches on how to use chemicals or something.
Another thing, since TM's father has died, I can't believe they aren't both saying he did it. It's not like he can refute anything they say.
Needless to say, I can't wait for the trial, and if its possible to get in, I may just take a little vacation time, and be in court.

I just reread, and forgot to add: why would HE go the PTL to meet SM, when he is already in town, and she is at her apt alone. That has never worked for me, that she would drive there on her own.

How do we know the M's were out and about having sex all over town? Because Sidney said this happened? He also told a story of being chained to the bed against his will. I sure as heck don't buy that one. If he was that controlled, he would have never had an affair to begin with.

The timeline has Heather calling Sidney's phone after she arrived at PTL.

Heather discussed the pay phone conversation with BW. Nothing at all was said about Sidney coming to the apartment. I think HE would have mentioned that little tidbit.

Was PTL a place where Sidney and Heather had met before? I'm thinking that is very possible. If planned, why involve a place that possibly Heather told one of her friends about?

They have no problem sitting in the parking lot of the apartment complex where they could be easily seen. Yet, Sidney supposedly sneaks to use a payphone so he won't be seen.

Decent theory, but, a little too convoluted to me. As I have said, there is more to this story. I think Sidney may have had a situation going on that he couldn't deal with and lost it that night. Possibly a woman that didn't want to let go and a wife that was making his life miserable because of it. Also possible is Tammy and Heather got into a physical confrontation. I don't think it was planned.

True. The lab may have made a mistake about DNA coming from SM's truck but, that's not to say that there is DNA evidence of SM in Heather's car. That we have yet to hear. Then again, TM said that HE and SM had "relations" in the back seat of her car 3x. So then, it is quite possible.

As for the phone calls, that would come down to where the phone pinged during that specific time – not just from the call logs! IIRC, there were pings from HE's apartment. In the beginning, that was a huge discussion and it was initially thought that her phone pinged at her apartment around 3am.

I don't know if they would've even bothered looking for SM's DNA in Heather's car - it was only 6 weeks after their relationship ended, one would expect the DNA to be there anyway.

I had just assumed they probably had met up there previously so it was the go-to spot for the rendezvous that night (it's close to the Moorer's home, easy for Sidney to slip away and get back quickly and probably very secluded/private at night).

Also, since I'm still assuming Heather drove herself to PTL, I was wondering if she didn't want SM to come to her apartment (even though the roommate was out of town). Perhaps she wasn't even interested in getting back together with him, but only went there to talk to him because he was so insistent earlier. And maybe she didn't want to have him in her "new space" since he was part of her previous life.

I think she said she didn't want to meet with him when he called from the payphone and later got sentimental (posting those poems/etc on tumblr) and decided she did. Which is why she would've called the payphone even though it was an hour later, and finally (out of desperation) his cell.

I've thought we may be overthinking, too. TM is probably reading here thinking, "you idiots.....that's not at all how we killed her!"

BBM- I think that is a good possibility. So, of all the secluded places around Myrtle Beach, the M's chose a place HE may have told her friends about.
 
I hope the police check to see if there was a GPS tracker on SMs car and/or spyware on his phone.
 
Here are several things that I observed while looking through older news postings.

" Evidence located on the property led to the charge of Murder" (On the property but not in the house)?

"That day, Nov. 5th, Elder said, was the last time Elvis saw Sidney Moorer" "It is unclear what happened that day, or how prosecutors know Nov. 5 was the last time that she saw Sidney Moorer."

"Terry says Heather`s roommate told him it ended more than a month ago. Yet, according to witness statements to police and those same phone records, there were several calls back and forth between Heather and the married man the morning of Heather`s disappearance. That same roommate told police HEATHER WAS TALKING to that man AGAIN, and that night, he called to tell her he was leaving his wife and wanted to be with her."

It sounds to me like they were communicating all along. Unless I am reading it wrong. If that is the case, maybe H told S about her date that night. He was sitting somewhere waiting for her to come home from the date.

She'd be charged with accessory after the fact instead of first degree murder, unless she was so intent on keeping SM's secret that she'd be willing to take a chance at a 1st degree murder conviction.

Also were cadaver dogs taken to HE's apt?

And, how would SM have known Heather was on a date? They supposedly hadn't had any contact in weeks.

Was SM only pretending to leave his wife or why did he go to HE's place?

How did he get there? If TM drove him there, then it was to harm He, right? So why would this be a jealous unplanned crime?

These scenarios just aren't making sense to me.
 
With the 'new' time line scenario posted ^^up there -- the lag in him arriving at he apartment COULD have been they had a brief moment of cold feet to go through with their plan? They were arguing about it?

Also - Heather may have given SM the address during that payphone call - could be that simple as to know where she was living.

I also believe there may have been 'something else' (I think it's a very slim possibility) that could've spurred this into TM wanting Heather completely out of the picture - but that 'something else' has never been verified and not allowed to be discussed here..... so I'm not saying anything more than that!!

My mind is just blown right now by how much my theories have changed over the past little bit. So many new things seem plausible.

1:35AM - 1:39AM - Sidney calls Heather from pay phone (call is 4:53 minutes)

1:44AM - 1:46AM - Heather calls roommate, Brianna Warrelmann who is in Florida at the time. And says Sidney just called and is leaving Tammy. Heather appears upset because she had been trying to get her life back on track after the affair and the harassment by Tammy. Heather is still at her home when she makes this call. (call is 2:20 minutes)

1:53AM - 2:09AM - Heather posts 10 times on Tumblr.

2:29AM - Heather attempts to call the number Sidney called from (which is a pay phone) several times but, there is no answer.

3:16AM - Heather attempts to call Sidney's mobile phone with no response.

3:17AM - Heather calls Sidney's phone and has a 4:15 minutes conversation with Sidney. Heather is at her home at this point. Sidney is at his home which is approx. 3 miles from the boat landing. After this conversation, Heather gets into her car and drives directly to Peachtree Boat Landing. Sidney also denies this conversation until police confront him with Heather's phone record and then he says he did talk to her but it was just to tell her to quit calling and leave them alone.

3:36AM - A private residence video surveillance captures a vehicle coming from the direction of Sidney's headed towards the boat landing. This camera is 1.7 miles from the Moorer's residence.

3:38AM - Heather attempts to call Sidney's phone 4 times (3:39, 3:39:46 and 3:41)

3:39AM - A business video surveillance a mile from the first camera closer to the landing captures this vehicle still proceeding in the direction of the boat landing.

3:41AM - Heather's phone data ends at that point (at PTL).

VS.

In the second theorized scenario of the timeline, what would be the reason TM drove so slowly to pick SM up from PTL? It doesn't add up to me.
 
It sure did knock TM's attorney right off his train of thought and it seemed to me like he never got back on track. I think she was terrified SM was going to make bond while she was left remaining behind bars. Can you imagine the thoughts that went through her head when SM's attorney suggested he could go live at his family's property with unsaid others. Talk about her feeling out of control! I would have liked to known how that scenario would have played out. Either way with all of their past history/drama I can't see making it to trial without more of the same but I suppose we shall see.

Anyhow OT I haven't posted in forever. I've been so very sick and we had a big move. Glad to see familiar folks and new ones as well. :seeya:
