After reading all the court documents and the article by Mr. Dolan, I personally have a better understanding of the legal arguments being presented. If Jahi's blood pressure and heart rate are dropping precipitously, it does not sound as though her cardiac condition is stable.

If I understand the judge's ruling correctly, CHO is to maintain the "status quo" so to speak. So if Jahi's condition deteriorates, CHO is not required to perform "life saving measures". So the DNR status is moot? Did I understand this correctly? TIA.

Since CHO is considering her legally dead, and the judge did agree she was brain dead, then how could they possibly be required to perform "life saving" measures?

Many Posters here don't believe she has the right to go to court, that her supporters don't have the right to peacefully assemble, that her religious beliefs should be ignored.

That's huge IMO

What about the other families and children at CHO currently? (They exist still, btw.) Do they have rights to adequate care, care that isn't tied up in a circus??

I am all for the mother achieving what she wants to, but similar to how these threads here are playing out, it's NOT being done CORRECTLY.

I don't understand why people are saying the hospital is so awful for declaring her brain dead and wanting to remove the ventilator. This procedure is across the board for all hospitals. Most people come to terms with it and grieve, there are very few cases that are found where family has fought this. Many other hospitals may have not given them the initial extra time that this hospital did. Plus, they have done quite a bit to accommodate the family.

Blame the legislation, not the hospital.

I'm glad that they are conducting an investigation and I do believe that it was CHO that initiated it, due to the fact that there are statements being made against the hospital that are not true.

RSBM: Just as one cannot yell "fire' in a crowded room, giving birth does not give one free reign to do as they wish to their child/children.

You would rather a law or a stranger/doctor make a determination of your choices over a loved one?

The right to choice is being denied and just curious as to how keeping Jahi on a vent is causing harm to anyone.

At some point everything will fail...no doubt about it. But again she is already gone or so we are told,so why the push from the hospital to take away her vent?

There are many laws that do exactly that; child abuse laws, custody, mandatory shots, school attendance, etc etc. When you are a parent, it is your job to make darn sure you understand the laws as they pertain to you & your offspring.

Knowing the odds of a bleed when kids had their tonsils and adenoids removed. Make darn sure one has full understanding of the risks, the process, and the release forms. Following post op intructions.

Just like criminal laws, ignorance is not an excuse.

Because the hospital considers her dead and doesn't feel it's ethical to keep a dead person attached to a vent.

I hate to keep repeating this, but I still don't understand why it hasn't been approached that they take her home, like these few other cases that have been shown in the media.

Her heart will eventually stop and I would think that the family would want her right there with them daily.

They have received a lot of donations and will continue to receive more. Plus these other organizations should be able to help get her set up at home.

It seems like a simpler answer than going this other route, but there must be reasons why they aren't considering it.

At some point the law steps in and tells you what must happen.

Usually, there has been a tactful dialogue between physicians and the family about the medical facts. It doesn't usually take 6 physicians to make a family understand that there is no hope for recovery.

But at some point the body deteriorates and cannot be maintained. Normally, a family recognizes the decline and can see for themselves the absolute lack of function.

California voters and elected politicians created and enacted the laws. Laws over-rule choice.If one is that concerned over their rights and their choices, one best be up on what the laws are if their loved one succumbs to the risks of surgery. It was a choice to have the surgery...

And those are all very good laws,but do you really want a law or a stranger making end of life choices for you over your loved ones?
It just seems unfair to me and I don't even agree with keeping Jahi going in her current state.

MONEY

Right now Dolan is throwing pasta at the wall trying to make it stick. Trying any sort of public shaming, threats of investigations, allegations of discrimination, allegations of abuse, arguing the family has the legal right to declare her dead-not the hospital, to get CHO to do something that will promote a wrongful death case in court, or reverse the legal death call so that he can pursue a wrongful death claim, not a malpractice claim. It's $250K vs millions.

Having the family take her home takes all the pressure off of CHO.

Taking her home is the last thing Dolan wants.

She is in an ICU room at the hospital. Hospitals are not for deceased patients, nor are hospitals for "treating" the deceased.

Other live children need that bed.

It's standard procedure for all hospitals not just this one. They need the beds and the staff to treat the living.

If these organizations are so strong about these issues, then why don't they open up facilities to care for brain dead individuals. They can collect donations to pay for it.
