Am not saying it would be right, but if CHO would allow trach an g-tube she may quickly be out the door and CHO could proceed with business as usual.

But CHO would have set a legal precedent for performing surgical procedures on a legally dead person, and there are still no physicians who will perform it.

Didn't I see that the judge turned down the family request to allow a physician not on CHO staff to perform the surgeries?

My head is spinning.

They don't want to remove her w/o the other procedures and the Fed Ct. says that issue had to appealed from a final ruling at the State Court level. Not to the Fed Ct. They now have a final appealable rulling from the state court, so next stop is the State Court of appeals. jmo

Sorry folks, but I think Dolan will take this to state of California Supreme Court, and maybe even try for US Supreme Court if he doesn't get what he wants.

All the while CHO has the thankless task of taking care of her at their own request.

Leilei long term facilities may require these procedures. An endotracheal tube is not as secure/safe an airway as a tracheostomy an this is a major problem. The g-tube not so much since an nasogastric tube would be acceptable. The hospital has effectively blocked any relief they could get in this case. I see it as cutting off the nose to spare the face!

Sounds like Top Secret Care Facility requires a permanent tracheostomy and G-tube and CHO doesn't have to operate on the child.

If Top Secret Care Facility even really exists. :drumroll:

There is no where to send Jahi. It was a statement by the family's lawyer that they have a place and the judge knows where. I don't think that statement came out in court but before it reconvened. jmo

So, not the NBCC then?

I respectfully disagree

CHO does not want to perform a procedure that violates California law and medical ethics, and would have widespread negative implications for the medical judgement and practice of physicians and hospitals.

apparently an NG is not acceptable or they wouldn't be requiring a gtube. jmo

There is no other facility. This means she remains at CHO until her heart gives out or a judge rules that the vent can be removed.

The ball is now in the attorney/families court to produce said facility. The hospital is not legally responsible for what happens once she is removed from their facility. The attorney can no longer say that the hospital is blocking the family from removing Jahi.

Okay, so from the article I just posted, they still have the Federal hearing this afternoon, and I imagine that Dolan will be filing an appeal with the State again due to the no surgery ruling.

Meanwhile, Jahi's mother has agreed to accept all health responsibility for Jahi, and they can remove her from CHO.

Is that correct?

This is what blows my mind in this case. Why can't people comprehend that this isn't a case of CHO (or any hospital) not wanting to do the procedure it's a case of them LEGALLY and ETHICALLY unable to.

I have no doubt CHO wants Jahi and her family out of there as much, if not more, than the family wants out.
