Jahi McMath: Family calls state report 'B.S.'

Calling it a "B.S. report," Jahi's uncle Omari Sealey in tweets questioned why the family was not interviewed as part of the investigation. "The State never interviewed the family who was THERE to witness Jahi bleeding to 'CA brain death' & there is no answer why she bled?" Sealey wrote in a series of tweets. "What's done in the dark, will come to light."

BBM and they would all be interviewed because of their deep knowledge of medical practice, right? Puhleaze. They need to just GO AWAY. :facepalm:

It's helpful to understand what a CMS Compliance inspection is, and is not. This type of inspection was not ever intended to be a comprehensive morbidity and mortality inquiry of Jahi's case, or any other child's case. Atty Dolan surely knows this. Family interviews would NEVER be a part of this kind of CMS compliance audit.

So, making criticizing comments about the family not being interviewed is either revealing ignorance about what this inspection was about, or it is grandstanding and taking an opportunity to make a derogatory statement in the spotlight that demeans both CHO, and Centers for Medicare and Medicaid. CMS did their inspection in accordance with their own very strict standards, which were, and are available to Dolan, the family, and the media. They do these inspections pretty much the same way, every time, in every facility.

This was an audit of conditions of participation compliance. I would have expected CHO to have minimal deficiencies.

These comments by the family and atty, IMO, demonstrate ignorance about what the CMS inspection process is.

They think their "target audience" will just believe it is another slap in the face by the system to Jahi's family, and hopefully bring in some dona!ions.

An enormous misunderstanding perpetuated by the media, AND Attorney Dolan, is that this process was an investigation into Jahi's death, which it was NOT. CMS does not have direct authority over individual cases of morbidity and mortality. Absolutely Attorney Dolan knows this.

I believe it is Atty Dolan's responsibility to explain and interpret this kind of sophisticated information to the family he represents. His public comments, IMO, are irresponsible, belittling, and do nothing to educate the family (and the media). I would not expect Jahi's family, with their background, to understand what a CMS compliance inspection is, and is not. However, I believe they deserve an attorney who can explain these things to them so they can understand what is going on.

This was a compliance inspection. If there were "enough" egregious departures from compliance indicators, theoretically CMS could cease payment or reimbursement to the facility. (I say theoretically, because that would be a HUGE hairy, painful, enormous big deal, affecting every single department within the hospital, and would be front page news.)

A facility as big as CHO has oversight from a number of organizations, both at the state level, and "national" level.

Considerably higher than brain stem. Eye opening (voluntary) as well as eyeball movements are controlled by cranial nerve 3- the oculomotor nerve. I am highly doubtful Jahi voluntarily opened her eyes. The key here is VOLUNTARY.

There are a lot of situations where eyelids will appear to be open involuntarily, and if her eyelids and eyeball is very dehydrated, the eyes could appear to be open.

I'm very short on time, but will add more later. I really doubt that there will be any pictures or video of posted about this by the family. But it makes for a good piece of information to cast out to the masses.

It's bizarre. If it actually happened, I feel like this family would be shouting it from the rooftops. I would be shouting it from the rooftops. It would be the miracle Jahi's mother has been praying for.

The fact that it allegedly occurred two weeks ago and the family has said nothing - either it didn't happen, or they know it wasn't voluntary.

I agree.
And truly, this could have been a rumor not even started by the family.
They might have taken it down because it wasn't true in the first place.
