I wouldn't put it past them to "try". But this is another reason it was wise to issue the death certificate. The request would be immediately turned down or dismissed, IMO.

I'm not sure legally, but it seems like the family would have to file suit against the government for some kind of discrimination against the dead, if they then wanted to pursue payments.

That could make a big media splash (which the family adores, and seems to need regularly), but ultimately, I think it wouldn't go anywhere. Other dead people don't get disability payments (so no discrimination). And, it would be a very hard thing to prove she was declared dead inappropriately, or with some kind of discrimination or malice that other dead people don't receive.

It is sort of an interesting thought experiment, though. :facepalm:

OOoooo-- unless she is in New Jersey! Then it could get interesting, lol! But since she's already been declared dead in CA, she would have to be declared "un-dead" in New Jersey! Yet another interesting thought experiment.

"Disability for the Un-Dead!" "Rights for the Un-Dead!"

Maybe the uncle and the attorney can start a "Center for Justice for the Un-Dead".

To steal a joke from Sir Terry Pratchett, it's not "undead" it's "differently alive".

(He writes a series of urban fantasy/satire novels, and they include a zombie who is advocating for equal rights.)

This is why this case affects me so much. It's a touchstone for why critical thinking skills are so important, and why we really, really need people to be invested in them, not magical thinking, for the good of the species and for our civilization.

The family is playing a game that is transparent to anyone who sits down and thinks about points like the above, but which is probably easily explained away ("it's for Jahi's privacy") by the people involved who value faith over medicine or science. But because this is playing out on the stage of public media (by the family's choice and manipulation), 'faith' is going to lose, sooner or later.

I just hope that fact wins at least some people over to the side of critical thinking.

Dont they realize they gave up Jahis' privacy when they blasted her name and circumstances all over the media? What part of be quiet dont they understand. We Know why they dont show pictures, they show pictures of everyone else!! People must learn to use their brains for Gods' sake!! IMO.:moo: :seeya:

well, what is next, high school graduation, prom, university?

personally i think someone is going to have to say no to this family, so far they have managed to get everything they wanted which they claim they are doing "for jahi", who remains, in spite of her enormous progress (as per family) invisible.

i understand doing everything for your child (i have 2) but it seems that this family is doing things not for jahi but for themselves. jahi has become means to an end

In my experience, the vast majority of people prefer magical thinking.

I do totally agree with you that critical thinking is vital for our species to survive and the betterment of civilization...
I just don't see it ever happening.

They may insist upon/demand that Jahi get an honorary disability status that results in a very real monthly honorary disability payment that is to be deposited directly into their bank account.

Okay, remember these guys...? they operated some kind of a fringe neurological facility that promised to cure Jahi and we discussed that there seemed to be something off about them and their past but I'm not sure if we ever found out what.

The young girl slipped into a coma on Dec. 9. Her family has battled the hospital now for weeks in a desperate attempt to keep her on life support.
Fellus' goal is to help determine if the young girl can achieve some kind of recovery.

A neurologist has been stripped of his license by the NJ State Board of Medical Examiners after allegedly sleeping with a patient.
Dr. Jonathan Fellus allegedly had a sexual relationship with an unidentified woman, 33, who had suffered from a mild brain injury.
She had been hurt in a car accident in February 2008 and subsequently suffered from episodes of weakness, collapse, seizure, emotional maladjustment and physical injury.

'The facts clearly show that Dr. Fellus engaged in a relationship with this patient, even though he knew or should have known she was suffering a diagnosed cognitive disorder and was physically debilitated by injuries she suffered in a car accident,' Acting Attorney General John J. Hoffman told NBC Philadelphia. 'This relationship violated long-standing ethical standards and a specific Board of Medical Examiners rule prohibiting sexual contact between physicians and their patients.'
He had been placed on administrative leave while the case was underway and resigned in 2011.
Besides operating Advanced NeuroCare, he operated a private practice and was chief medical officer for the International Brain Research Foundation.

In an earlier interview with The Star-Ledger and according to various online references, Fellus was described as being employed by the Kessler Institute for Rehabilitation in West Orange during that period.

Doctors are barred from having sexual relationships with their patients, even if “the patient solicited or consented to sexual contact,” according to the complaint.

According to testimony cited in the complaint, during Fellus’ first evaluation of the woman, the victim of a traffic accident, on Aug. 8, 1998, she asked if the office was open on weekends. Fellus “smiled and replied with a question, ‘Are you asking me on a date?’ She said no, and he appeared ‘annoyed,’ causing her to worry ‘that he might refuse to take care of her.’ She emailed him later saying she ‘wouldn’t mind if you asked me out.’ ”

During her next visit in September 2008, the complaint said he massaged and kissed her neck. The affair began — with trysts at his home while his wife was away, and at the Kessler facility, according to the complaint.

The patient “continued to have seizure episodes” and on November 28, 2008, informed (Fellus) of a severe episode she had had days earlier. They met at the facility that day and in an examining room “engaged in sexual contact by hugging and kissing.”

The last time they met, in March 2009, she came to him for treatment for recurring seizures and “collapses,” the complaint said. “But instead … he requested she perform a sex act with him and she did so.”

The patient later sued Fellus, who resigned in February 2011 after Kessler officials saw his written responses to a lawsuit, according to the complaint.

We all thought he was an opportunistic quack back in December, IIRC, but now we know he's a predatory slimeball, too.

And we all noticed that the place he was fired from would only say he no longer worked there, which usually means the reason the professional left is very bad. Which further explains why he founded his own personal brain institute-- the only place he could get a job, with this case winding its way thru the courts and the medical board. And I would bet that this case isn't the first time he did this-- just the first time he was caught. Slimeball.

But what is most worrisome is this (BBM):

He must now transfer his patients to new doctors within 30 days, as well as pay a fine of $10,000 along with $34,450 in costs to the State.

Three years from now, he may have a chance to be reinstated.

I kind of doubt he has any real patients at this point. He probably just proselytizes from his brain institute about how he has cured all these brain dead patients. And losing his license won't prevent him from continuing to do that.

He kind of reminds me of those infomercial advertisers, but that would be an insult to the ShamWow guy. :facepalm:

I'm not a medical professional but even I know this is utter nonsense. First of all brain dead and coma are apples and oranges, and second, you can't wake someone up who is brain dead. But he managed to do that with 'hundreds". Yea right. :banghead:

I hope they revoke his medical license, forever.

It's so unethical to mislead families into hoping that there's a chance their loved ones might recover from brain death. How can he look in the mirror in the morning and not puke?

Quite honestly, I think Jonathan Fellus (former MD) should be charged with a sexual assault crime. Patients, especially brain injured vulnerable patients, are not able to consent to a sexual relationship with their doctor. Especially when the sexual encounters take place in a clinic, during an appointment.

This 🤬🤬🤬🤬🤬🤬🤬 should be charged with sex assault crimes-- one count for every encounter, convicted, and made to register as a sex offender for life. I hope the prosecutor files charges.

That would effectively take care of the "re-applying for his license in 3 years" thingie.

A bit of magical thinking and defensive avoidance of reality I think. Barring a divine miracle, Jahi is still dead and not really better at all, but the mother desperately wants to think so. But it's a bit like wishing on a star, if you say your wish out loud it might not come true...and people might ask for videos and tests and proof and then it might turn out to be just wishful thinking after all.



"Jahi deserved it," Winkfield said. "She worked very hard."

I think the use of the past tense here (Jahi deserved the diploma, vs deserves it) might represent a tiny inkling of reality here.

A facility for coma patients would be a candy store for certain kinds of predators, you'd know that the victims wouldn't be able to complain and sue you.

I hadn't wanted to say that but yes, this is a fear of mine for Jahi. I would sincerely hope that she would not be able to get pregnant because her mother would just go beyond nuts with that. She would see it as a miracle, a virgin birth, demand that jahi be declared alive.

I have even considered the possibility that Jahi's mother would be so out there as to want Jahi to be pregnant because of the headlines it would bring. It would also give her a "little Jahi", "a miracle baby", etc and all that other BS. Sadly, considering what this family has done and how very bizarre their thinking is, I hadn't said anything because I didn't want to give them any ideas
