IMO this plan sprung into action when she believed the email sent to family was PS getting a divorce. PS would take the kids and she would be alone in her bed.

Dr. Maher said before break he believes #JulieSchenecker was insane at the time of her children's murders.

Dr. Maher: #JulieSchenecker had very clear idea she wanted to kill herself, inconsistent though about killing the children.

Fascinating that she had a clear idea she wanted to kill herself but not the kids, and yet couldn't manage to kill herself, but had no issues with shooting her children in the head and mouth.

Actions speak louder than words, perhaps?

Dr. M has not testified on side of State in a criminal case. Has given testimony for a criminal defendant about a dozen time. Has been retained by defense for evals, etc. about a couple hundred times.

First interview w/ defendant was about 30 days after murder. JS told him she intended to buy gun to kill herself and take the children with her.

Never got a sensible response as to why she drove to Oldsmar to buy the gun. Apparently looking for a place that was open and available.

JS told the clerk at the gun store she wanted to buy the gun for self protection.

So...to some extent, JS understood that members of society would view her intent to be wrong.

State: In State of Florida, even if a person believes they are MORALLY right, it is not insanity if they know that it is against the laws of society.

How does this doc know what she understood? Diagnosis is one thing, but reading minds is something else.

State: Do you know that law of the State of FL states that a person is NOT insane if they understand their action violates the law?

Dr. M: Her state of mind was that...if people understand things the way I understand it, they would know what I'm doing is right...which is psychotic thinking. She didn't have a way to communicate her point of view so that others could appreciate it.

State: are you aware of the video taped interview conducted by Dr. Solomon, etc. at Tampa General -- conducted by defense team. When asked if she'd told her doctor about her intent to buy a firearm, she said she never told a soul because she knew they would thwart it.

Doc won't budge says #JulieSchenecker didn't have a way of communicating what she planned bc people wouldn't understand it.

IMHO, the defense is trying to liken her to Andrea Yates. Not working for me.

Andrea Yates heard voices audio hallucinations. More severe IMHO. My son has audio and visual. They are horrible much more debilitating.

Dr. M has prescribed Lithium and Lamotrigen. They are mood stabilizers. Lithium has ability to reduce suicidality. JS had been prescribed Lithium and Lamotrigen for several months before the murders. Dr. M may or may not advise abstention from alcohol while taking these drugs. If he knows a patient would not be completely abstentious, he would advise what they could do safely.

On the central nervous system, alcohol and Lithium have a synergistic effect.

At the time she was shooting them, JS had an awareness that when she was pointing the gun at her kids, that it would kill them.

She knew what she was doing. She did not know that it was wrong. She believed that she was protecting her children from something terrifying horrible; that she was bringing her children to heaven; that it was part of her necessary duty as a mother. She was not aware of it in any sense of the horror of it.

She indicated she wanted to protect them from the pain, the horrible life she'd experienced. She feared her children would be hurt. She was concerned about her children being sexually molested, as she had been. She was fearful that her daughter was bipolar.

Here's where my conflict lies with this case:

I do not believe she killed her children in order to save them from anything. I believe she killed her children because she was upset with how they treated her.
I feel it is quite a stretch to ask us to believe that her motive was to save them from molestation, and MI and to "bring them to Heaven with her". You can't claim that about her because she wrote in her journal that she shot her children in their "mouthy mouth" and told detectives that she shot her children because they were "mouthy".
That doesn't jive for me. If she truly believed she was saving them from something, in her delusional psychosis, she would have said what she was saving them from.

Having said that, if she killed her children out of spite while being in a delusion that everyone was against her, would that still be considered legally insane? Does that fall under the same category that she knew what she was doing, but didn't know it was wrong?
