Ugh this female defense atty is so blah

Seems like everytime she has objected and provided the reason she is overruled so she is reverting to the ole 'May I approach'. :P

She demonstrated understanding that other people in society would view her actions as wrong:

she gave a false reason to the gun shop owner for buying the gun
she placed notes on the door for car pool members that they'd gone to NYC
in her interview by Dr. Solomon she stated she didn't tell anyone about the plan because they would abort it, and she said had Parker been in town, she'd have held back.

She didn't express concern about rape or molestation in her journal entries.

Her concern for protecting the children did not rise to the level of a delusion.

In her journal, the reasons she gave for killing the children was concern that she was passing along her DNA to them, and they'd develop her disorder, along with the effect of how her suicide would affect them.

In her journal, she spoke of them becoming mouthy.

At no point in her journal or in the first 48 hours after the offenses did she make statements that sounded delusional. Those statements came later.

Her reasons were some degree of legitimate concern and some degree of resentment toward her family

This is one case where I can equally see the merits of both the defense and state cases. I don't think that's ever happened before lol

My opinion goes back and forth with each witness and even when a witness goes from direct exam to cross exam


Minor, so impressed with both pro experts...would rely on them if I were on jury...JMO. Legally sane.

Finally, an expert who brings up her anger at the family as a motivation! This man is doing a tremendous job explaining and using JS's own words against her defense of insanity.

No evidence that JS went doctor shopping to load up on oxy only that she told Dr O that she was out of script and wanted more.



IMO JS never meant to kill herself.


I guess she lied to Dr O then cuz she apparently took oxy's the night she killed the kids.

No evidence that JS was in a psychotic state at the time.

She was aware that what she was done was legally wrong, against the law, and likely to face criminal sanctions for it.

In interview with detectives:
"I don't want to go to jail or prison"
she stated she wanted to pay to stay out of jail.

Sort of like the 'scared of breakins' lie she told the Lock and Loan employee so that she would be issued the firearm.

I still can't believe that gun shop let a person load live ammo into a gun inside their shop.:eek::eek:

She did. JS is very good at projecting onto others thought and feelings she has for herself. She projected onto her children big time. IMO

Here's the model jury instruction for "clear and convincing" evidence:

1.4 BURDEN OF PROOF—CLEAR AND CONVINCING EVIDENCE

When a party has the burden of proving any claim or defense by clear and convincing evidence, it means you must be persuaded by the evidence that the claim or defense is highly probable. This is a higher standard of proof than proof by a preponderance of the evidence.

You should base your decision on all of the evidence, regardless of which party presented it.

Thank you for this information, and I also have a question for you.
When you are in trial, do you find that the gender makeup of a jury makes any difference at all when determining the verdict? There are 8 males and 4 females in this particular trial. Any thoughts?

It is unusual to feel so conflicted over a case. typically by now we all have a distinct opinion on what we feel the verdict should be.

For this case, we have to focus on the law.

I think we all can agree that she is clearly mentally ill. What the jury needs to determine is if she knew that what she was doing was wrong, even though she is mentally ill.
I was getting hung up on the possibility of her not knowing the wrongness of her actions because she was mentally ill.

The great points brought up by the last two witnesses have proven to me that she did indeed know that what she was doing was wrong. They provided insight as to the fact that her actions before and after the murders were very telling into her state of mind and her knowing that the murders were wrong.
