This is bad. There are tons of people with physical disabilities who are not insane.

IMO she needs to make these points about Parker, but she needs to stress that he did not understand the depth of JS' illness (I think that's true)

You're right, the burden to prove insanity is on the defense. But they can't produce any doctor because she's obviously not insane. She's just another vicious, vindictive killer who was out for revenge. She not only knew what she was doing, she wrote it down so she could go back and enjoy her handiwork all over again.

JMO

IIRC the defense had two doctors - a Dr. Solomon who saw JS the night she was arrested, and Dr. Maher, who wrote a report of 130-some odd pages about JS (the longest report he'd ever written.) I found Dr. Maher particularly believable and would want to take a long hard look at his report if I were on the jury. IMO

If I were the State, during rebuttal, I'd just take about 3 minutes and repeat the points that Dr. Taylor (I think it was) made -- just went through the prongs of the insanity defense -- and gave 3 or 4 examples from her journal and statements in the day or two after the murders -- to prove she does not meet the criteria for insanity.

That's all that really matters.

And, if the Defense really wants to prove her insane --- that's all they need to do...use examples from her journal and statements to prove she was insane.

Importantly, when an Affirmative Defense is raised, the defendant must present some evidence to support the defense. If such evidence is presented, the burden shift back to the State to convince a jury beyond a reasonable doubt that the defense is not applicable.

I'm aware of the burden, but the burden starts with the Defense. Arguing the obligation is on the Prosecution is going to lead to an IAC appeal.

Defense saying she didn't sign the Hippa waiver because she didn't want him to find out about her gambling...she'd apparently confided to her docs about that.

And that's something I've been wondering about...he let her control the household finances (accdg to his testimony), and didn't find out about the gambling until after the murders. But wasn't there something said about a $10K loan to pay off the gambling debts or to pay the household bills or something?

He sure wouldn't be the first husband who trusted their wife completely with the finances and later learned the wife was very untrustworthy.

She was probably spending a lot of money on alcohol and gambling behind his back and not paying their monthly bills.

I think I read he had to take out a loan after she murdered the children to pay off her gambling debt.

How many 10 year olds kill two other people? JS wanted to have things her way that is her immaturity. Nothing else.
